Texas laws take self-defense very seriously. Penal Code Section 9.31 makes it clear that, on the facts, Daniel Perry was justified in using self-defense, and Section 9.32 adds that, once a person believes he is at imminent risk and has an right to be at the location in which violence finds him, he has no obligation to retreat.

Daniel Perry’s conduct met every metric of reasonableness, given that Perry had done nothing at all while Foster was waving a gun at him as Perry sat in his car. Perry should have walked away a free man.

Today, California Rifle & Pistol Association, Second Amendment Foundation, and the Second Amendment Law Center took the somewhat unusual step of filing an amicus brief in a unique criminal case out of Oregon. US v. Kittson involves an individual charged with violating 18 U.S.C. § 922(o), which prohibits the possession or transfer of an unregistered fully-automatic firearm. The United States District Court for the District of Oregon upheld the ban despite Mr. Kittson’s Second Amendment arguments, and now he is appealing to the Ninth Circuit Court of Appeals.

A new Delaware gun law is problematic, especially when looking at the history of how governments have selectively treated marginalized people, according to the lead plaintiff challenging legislation enacted Thursday.

The law will require residents to complete a firearm training course and obtain a permit before purchasing a handgun, a process that can take up to a month.

"If you're on a list, you're not going to get a permit," said Attorney Thomas S. Neuberger, one of five plaintiffs who filed the lawsuit less than four hours after Delaware Gov. John Carney signed the permit to purchase law on Thursday.

Senators Katie Britt and Tommy Tubberville have signed onto a joint resolution of disapproval under the Congressional Review Act (CRA) to strike down the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule on the definitions of “Engaged in the Business” as a Dealer in Firearms. This rule ignores the law and congressional intent and flagrantly violates the Constitution to try to require anyone who sells a firearm to register as a federal firearm licensee.

Former President Donald Trump is expected to address thousands of members of the National Rifle Association in Texas a day after campaigning in Minnesota in the midst of his hush money trial.

Trump has pledged to continue to defend the Second Amendment and has called himself “the best friend gun owners have ever had in the White House” as the United States faces record numbers of deaths due to mass shootings. Last year ended with 42 mass killings and 217 deaths, making it one of the deadliest years on record.

In a Wednesday press release, Republican Senator Tom Cotton of Arkansas introduced S. 4344 — the Repealing Illegal Freedom and Liberty Excises (RIFLE) Act — which, if passed, would remove the $200 registration fee imposed under the 1934 National Firearms Act (NFA).

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) receives more that 70,000 requests a month from gun owners seeking to have their firearms registered under the act. Apparently the $200 fee to register their firearms in a national ATF gun registry isn’t much of a deterrence today, but 90 years ago it was a major — and intended — deterrence.

McGrath said she has also increased training on handling gun cases, with a special focus on illegal homemade firearms known as ghost guns. “We are evaluating gun cases on a daily basis, in conjunction with law enforcement partners both local and federal ... And we have more than doubled the amount of prosecutors who are handling gun cases; we’ve expanded our prosecutions to include ghost guns.”

The Chinese military recently showed off numerous robot dogs outfitted with machine guns on their backs during the country's biggest-ever drill alongside Cambodian troops, as Agence France-Presse reports.

The terrifying gun-toting robodogs were part of a massive 15-day military exercise called "Golden Dragon" in a remote training center in central Cambodia and off the country's coast.

During the drill, journalists watched as staff took the robodogs for a walk — but reportedly never fired the machine guns strapped to their backs.

Governor Jared Polis signed House Bill 24-1348 on May 16. The new law will change the way gun owners can stow a handgun or rifle in an unattended vehicle come January 1st.

Enforceable by a $500 fine, gun owners will have to stow handguns in a hard-sided box in an inconspicuous area and store rifles out of sight either in a locked trunk or in a hard or soft-sided container with a locking mechanism installed on the rifle.

The man was taken via helicopter to a Fort Wayne hospital, where he is listed in critical condition.

While deputies assisted the injured man, other deputies were able to make contact with a 25-year-old man in the area who claimed he shot the man in self-defense according to the press release. Both men lived at the home where the injured man was found.

All names are being withheld at this time, as it is a pending investigation. Grant County Sherriff’s Department claims there is no threat to the public and no arrests or charges have been made at this time.

That there are government officials who politicize the law is about as foundational to the discourse as any complaint I can think of. The criticism is sometimes quite fair. And for the latest example of a soft-on-crime politician flouting law and order, we can look to Texas Gov. Greg Abbott.

Abbott, of course, is no self-styled progressive. But his recent decision to pardon Daniel Perry, who was convicted last year of murdering Garrett Foster, channels the spirit of the progressive prosecutors he criticizes for allegedly refashioning the law to suit their ideological preferences. He just has different targets.

Today’s gun control politicians are making it clear. It’s not just guns they despise. There are two other primary obstacles to civil disarmament that they loathe.

One is the Second Amendment itself. The other, well, it’s you – the gun owner.

It wasn’t that long ago when President Barack Obama lambasted gun owners who refused to roll over to his gun control agenda. Stumping for his first election to The White House, he told fundraisers at a San Francisco event of smalltown Pennsylvania voters that were left behind, especially by the political elites.

Despite how delicious a good pizza can be, everyone knows it isn’t great for their health, but for one would-be robber, it actually proved fatal. Such was the case in Houston last weekend when a pizza delivery driver delivered more than just the pepperoni when he fatally shot one of two men who attempted to rob him, police reported.

The suspect who was arrested Sunday in connection with a deadly stabbing in Waianae has been declined by prosecutors due to “self-defense issues.”

Police say before 2 a.m. Sunday, on Farrington Highway near Plantation Road, Honolulu Police Department officials responded to an incident involving a man being stabbed. Two men got into an argument with another man near Pili-la'au Community Park.

The “protestor” in question, Garrett Foster, was among the crowd of George Floyd-inspired agitators blocking Austin’s busy Congress Avenue on July 25, 2020. The rowdy group not only held up traffic, but attempted to intimidate drivers like Perry by assaulting his vehicle.

Perry shot Foster with his handgun when the bandannaed 28-year-old confronted him with what Abbott’s proclamation described as a “Kalashnikov-style rifle in the low-ready firing position.” Seconds after the shooting, Perry called law enforcement to report his act of self-defense.

A tiny, inexpensive device is all it takes to modify some semi-automatic handguns into illegal automatic weapons capable of firing multiple rounds with one pull of the trigger. Douglas County commissioners aren't waiting for Gov. Jared Polis to sign a bill banning firearms in government buildings into law.

Tuesday, the commissioners passed a resolution stating they would "opt-out" of following Senate Bill 24-131, which bans firearms in polling locations, schools, government buildings, and by lawmakers at the state Capitol.

The bill contains a provision allowing local governments to opt out of the legislation, which the commissioners did during their May 14 meeting.
