Storeowner cleared in shooting death of teenage robber

HOUSTON, TEXAS -- A Houston convenience-store owner who fatally shot a teen-ager during a robbery attempt earlier this month was no-billed Wednesday by a Harris County grand jury.

Ngoc Thanh Le, owner of Westpark Food Store in the 9800 block of Westpark, shot 17-year-old Adan Avellaneda of Needville about 11:45 p.m. Sept. 15.

Avellaneda, armed with a knife, and an unidentified man armed with a gun entered the store and threatened Le's wife, said Assistant District Attorney Julian Ramirez. Le, who had been sleeping behind the counter, woke up and reached for a pistol he kept nearby, Ramirez said.

Le fired a shot, striking Avellaneda, who then died. The other man ran away.

Texas law protects the defense of property as well as defense of a third person, Ramirez said.
