Judge Tolby:
In the adjudication of this case, you have
wittingly or not, violated your oath of office. The Arizona Revised Statutes are
quite clear on the definition of concealment concerning a weapon. Promoting your
personal agenda through judicial acts is in itself a crime.
Further, it casts serious doubt on your ability
to serve impartially as a JP, AND your knowledge of the fine points of the law.
Judicial activism has no place in a free society, and destroys the credibility
of the Judiciary, and the citizenry's faith in its government. The Judiciary is
looked to by the people to be the safeguard of the law itself, and the final
resort to just application of law as protection of their rights and as the
ultimate defender of liberty.
FWIW, it is not necessary for you to agree with
a legitimate defense. As long as the defendant is within his RIGHTS, you MUST
apply the law as it is written. Further, your statement regarding the so-called
"studies" reveals a familiarity with, and possible involvement with
leftist anti-rights, anti-defense organizations that seek to promote disarming
the citizenry. In the strongest terms possible, I urge you to educate yourself
on the TRUTH about gun ownership and possession, and the many lives it saves.
There are a number of well-documented books available that expand on this. FYI,
always under the guise of "safety", "crime prevention", and
"for the children", in the last century, over 170 MILLION citizens
have been murdered in cold blood by their own governments. This subsequent to
the commonly consistent chain of laws that ALWAYS preceded such atrocities,
disarming the people being a necessary component for such inhuman activity.
Absent an immediate reversal of your faulty
(and illegal) judgment, AND admonishment of both the City Prosecutor and police
officer for bringing this unethical and invalid charge before the court, you
have betrayed the people of the City of Glendale, your office, and law itself.
While a judicial impeachment or recall is a difficult and complicated process,
and possibly not a practical response to this particular breach of conduct and
faith, be advised that your re-election is not likely unless you rectify this
travesty forthwith. Hopefully, the victim of your abhorrent abuse of judicial
authority will appeal your improper verdict, and possibly file charges against
you after reversal of it. Perhaps making an example of this totalitarian abuse
of authority will give pause to others in Arizona that may be tempted to emulate
such contempt for justice.
