Subject: For the NRA ...
Dear Sir,
This is just a quick note to point out to you
an error in your piece titled "For the NRA....".
You accept the undocumented word of an anti-gun
group, the Brady Campaign, concerning the individual right to own arms. You
quote,
" 'Every modern court that has dealt with
this issue has ruled that there is no such individual right'..."
I refer you to the 1990 ruling in US vs. Verdugo
which says
"The Second Amendment protects the right of
the people to keep and bear arms"
and further goes on to define "the people" as
being the same people who may vote to elect the US House of Representatives
every second year. In 1992 in the case of Planned Parenthood vs. Casey, they
held that
"... by the express provisions of the first
eight amendments to the Constitution...guaranteed to the individual... It
is a promise of the Constitution that there is a realm of personal liberty
which the government may not enter."
Please note that the Second Amendment falls
within the first eight amendments and that the Supreme Court held that these
amendments are guaranteed to the individual.
I guess that the Brady Center, aka Handgun Control
Inc., conveniently disregards those pronouncements, while crying that a 1936
case, US vs. Miller, in which the deceased defendant, Miller, was not able to
rebut the US government's position, and which did not rule on the right of an
individual to bear arms, but ruled that a sawed-off shotgun was not a standard
militia weapon, should keep us from asserting our right.
I respectfully suggest that you verify these
claims made by the Brady Center and submit a corrected version of your article
for publication.
