Midterm voters in Oregon narrowly passed one of the toughest gun control laws in the nation, buoying the hopes of gun control supporters, but the new permit-to-purchase mandate and ban on high-capacity magazines now faces a lawsuit that could put it on ice just days before it's set to take effect.
A federal judge in Portland will hear oral arguments Friday on whether Measure 114, which is scheduled to go into law Dec. 8, violates Americans' constitutionally protected right to bear arms. Depending on the outcome, the groundbreaking law could be delayed for months or longer as it works its way through the courts, legal experts said. |

Walters, along with other city officers and even interim Police Chief Michael Sack say gun laws are stopping law enforcement from doing their job. That’s why state Sen. Steve Roberts is proposing a new bill, changing the minimum age to conceal or open carry a gun.
“The number one issue that comes up is crime and how do we do that. Right now, unfortunately our law enforcement officers are powerless from preventing children who are possessing firearms,” Roberts said.
Roberts’ bill would make the legal age to carry 18. He also says this wouldn’t impact parents taking their kids to gun ranges or hunting. |

A man accused of killing a California gas station clerk during a "botched" robbery will not face a murder charge because the victim had opened fire on the suspect despite his life not being in danger, officials said Thursday.
James Williams, 36, was killed during an early Saturday morning gunfight with Ronald Jackson Jr., 20, at a Chevron in Antioch, Fox San Francisco reported.
The Antioch Police Department said a gas station employee called to report a person had been shot at the Extra Mile mini-mart just after 2 a.m. When officers arrived, they found a man with a gunshot wound to the head inside the store. |

Arkansas State Representative Vivian Flowers, a Democrat in the 17th District, filed House Bill 1013. It provides a pathway for convicted felons to regain the right to possess and own firearms after serving the entirety of a sentence, followed by an additional 10-year span. Arkansas law states that no person shall possess or own any firearm if convicted of a felony.
“The bill seeks to restore the right to possess and own a firearm to felons, or ex-felons, I prefer to say, of felons of non-violent offenses,” said State Rep. Flowers.
A felon convicted of homicide, kidnapping, rape, or terroristic threats would not be eligible. |

It’s hard to believe that fewer deaths would have occurred if more people had been carrying guns as defense. But that’s what some gun advocates in Hawaii are saying in opposition to Bill 57, which would prohibit people from carrying concealed firearms in so-called sensitive places like schools, churches and parks. The Honolulu City Council passed the first reading of the bill on Tuesday.
In June the U.S. Supreme Court struck down a New York law that required people to show a specific need to carry a firearm in public. That means similar laws in five other states, including Hawaii, are now unconstitutional. |

After the tragic St. Louis school shooting on Oct. 24 where a shooter killed a 15-year-old student and a health teacher, Missouri Democrats vowed to push legislation establishing stricter gun safety regulations.
On Thursday — the first-day legislators could pre-file bills — state Rep. David Smith, D-Columbia, filed legislation to prohibit anyone under 20 from purchasing semi-automatic or automatic weapons.
“While we cannot stop all gun violence we can mitigate it, and one way we can do that is by limiting the sale of lethal weapons to those who may not yet have the developmental stability to use them responsibly,” Smith said in a press release Thursday. |

We’re quickly approaching the Georgia runoff, which will determine the ultimate balance of power in the Senate. While Democrats will maintain control either way, the outcome will affect how easily President Joe Biden and his party can push through judges and judicial appointments. On Friday, a federal judge in Portland will hear arguments related to the first emergency motion seeking injunctive relief. The motion, which looks to pause the measure from taking effect, was filed by the Oregon Firearms Federation, the Sherman County Sheriff's Department and a gun shop owner.
A second litigation was announced Wednesday involving the Second Amendment Foundation, Firearms Policy Coalition and others.
The Oregon State Shooting Association, two gun owners, a sporting goods store and the National Shooting Sports Foundation filed a third lawsuit Thursday. |

A narrowly divided Wyoming Supreme Court on Thursday reversed the conviction of a man who shot someone two years ago in a campground near Centennial, concluding the trial judge should have allowed him to use the state’s castle doctrine in his self-defense argument.
Lawyers for John Gerald Howitt successfully argued that jurors at his trial should have heard instructions related to the castle doctrine, which allows people to use deadly force if an intruder is “in the process of unlawfully or forcefully entering” their home or habitation. |

The United States is home to almost 400 million firearms, as documented by World Population Review, yet the amount of times these firearms are actually used for self defensive purposes is far lower. Nonprofit journalism publication The Trace reports that 2% of nonfatal violent crime victims and 1% of property crime victims used firearms in self-defense. Clearly, the instances in which firearms are used in self defense are not very common, at least in comparison to the instances in which firearms are used in an aggressive manner. |

New York Time columnist David Brooks is reminding America why they shouldn’t put faith in opinion writers pontificating from their metropolitan ivory towers.
Brooks recently said America would be a much safer country if Americans would simply give up their freedoms and become more like Europe. If America wouldn’t hold onto the individual right to keep and bear arms spelled out in the Second Amendment, and affirmed by the U.S. Supreme Court, he argues it would be a much safer place.
In his estimation, giving up the ability for self-defense and defense of loved ones would make crime just go away. |

Earlier this week, Broomfield City Council advanced a gun control package to impose on law-abiding citizens. The second reading will be held in January. In truth, none of the slew of regulations will stop criminals from stealing firearms, getting them on the black market, or getting them from straw purchasers. According to the Department of Justice (DOJ), 75 percent of criminals in state and federal state prisons who had possessed a firearm during their offense acquired the firearm through theft, “Off the street/underground market,” or “from a family member or friend, or as a gift.” |

After recent weeks marred by multiple mass shootings, U.S. Sen. Chris Murphy (D-Connecticut) is suggesting restricting federal funding to police departments that do not enforce state and national gun laws.
In a CNN interview this week, Murphy claimed local governments in the majority of counties in the U.S. have declared they will not enforce certain gun laws.

Americans like the Supreme Court’s recent expansion of Second Amendment protections.
A new poll from Marquette University’s law school released on Wednesday shows 64 percent favor the ruling in New York State Rifle and Pistol Association v. Bruen. On the other hand, 35 percent said they oppose the decision.
The poll found a sizeable enthusiasm gap as well. 36 percent of respondents, the largest single share, said they strongly favor the Court’s ruling. Only 16 percent strongly oppose it. |

Illinois House Democrats plan to introduce a massive gun control bill that would outlaw the sale of assault weapons and prevent most residents under 21 from legally buying a gun.
It comes five months after shooting suspect Robert Crimo III was accused of killing seven people and wounding more than 48 at the Highland Park Fourth of July parade — and four months after legislators began meeting to try to hammer out legislative fixes they hope will prevent similar tragedies.
State Rep. Bob Morgan, D-Deerfield, who was at the parade with his family, said Democrats hope to pass the bill in the lame duck session in early January, with public hearings about the measure to be held this month in December. |

Attorney General Daniel Cameron joined a coalition of 18 attorneys general in seeking clarification from FedEx regarding new policies related to the tracking of firearm sales. The updated policies could enable FedEx to create a database of American gun purchasers.

Yesterday, the plaintiffs and the Fish and Wildlife Service stipulated to a settlement of the case. The suit was dismissed without any changes to the expanded hunting and fishing opportunities—all of the expanded hunting and fishing opportunities remain open, which is a victory for America’s outdoorsmen and women.
But the fight is not over. In exchange for dismissing the suit, the Fish and Wildlife Service agreed to respond to a separate petition submitted by the same plaintiffs by June 2023. That petition asks the Fish and Wildlife Service to phase out the use all traditional ammunition in the National Wildlife Refuge System. |
