FL: New trial granted for Trevor Dooley, years after failed 'Stand Your Ground' defense

In a decision handed down Wednesday from the Second District Court of Appeal, a panel of three judges overturned Trevor Dooley’s manslaughter conviction.

In 2012, Dooley unsuccessfully used a "Stand Your Ground" defense after shooting and killing a 41-year-old father at a neighborhood park. At the time, a jury didn’t buy the defense, and took just 90 minutes to find him guilty of manslaughter.

Dooley appealed the decision. His attorneys argued jury instructions provided at the time not only fell short of an adequate explanation of the law, but that prosecutors also gave jurors erroneous information about what the law states just before they had to make their final ruling.

A spokeswoman for the NRA said the group "opposes domestic violence and all violent crime" and spends millions of dollars every year teaching Americans how to safely use firearms for self-defense.

"The gun control lobby and anti-gun politicians are intentionally politicizing the Violence Against Women Act as a smoke screen to push their gun control agenda," said NRA spokeswoman Jennifer Baker, who called the actions of Democratic leaders "appalling."

The NRA feels so strongly about the gun-control provision that it is evaluating the domestic violence law as a "key vote" that will help determine whether it will back a member a Congress for re-election.

On April 8th, the Oregon state Senate Judiciary Committee will be holding a work session and committee vote on Senate Bill 978 and its proposed amendments. SB 978 and the amendments received a public hearing on April 2nd. A bill that would add churches to Alabama’s 2006 Stand Your Ground law has been reintroduced into the Alabama Legislature. The Stand Your Ground law permits the use of deadly force as a defense against perceived threats.

The Alabama Church Protection Act, filed by State Rep. Lynn Greer (R-Dist. 2), of Rogersville, would allow churchgoers to defend themselves with guns at church.

Previous bills adding Stand Your Ground rights for churchgoers have stalled in the Legislature, but Birmingham attorney Eric Johnston, president of the Southeast Law Institute, believes the law is a good idea.

“Small churches don’t have the budgets to have a policeman,” he said. “All he’s saying is you authorize someone in the church to have a weapon.”

If 16-year-olds are mature enough to vote in national elections, they should be given the right to purchase firearms as well. Children are the future, and it’s about time we nudged these kids towards greater civic engagement.

And if Democrats want automatic voter registration for teenagers, whether these kids have any interest in participating in elections or not, let’s pass national concealed carry reciprocity and automatically sign them up so they can embrace the inalienable right to self-defense, one of our nation’s oldest and most sacred ideals. Don’t worry, they’ll be able to opt out if they’re not interested.

While this approach is surely well-intentioned, it strips low-income Americans of their right to defend themselves, when poor Americans are far more likely to be victims of violent crime. Americans earning the lowest incomes (less than $10,000 per household) are 206 percent more likely to be the victim of violent crime compared to Americans earning the highest incomes ($75,000 or more per household), according to a 2017 report.

Gun ownership, on the other hand, increases significantly at higher socioeconomic levels. A 2014 study found that 44 percent of American households with an annual income of at least $90,000 owned firearms.

It took less than two hours Thursday for a Houston County jury to acquit a man charged with murder.

Jeffrey Lloyd Culpepper, charged with murder in connection with the 2017 shooting death of Cornell Johnson, was found not guilty. Culpepper claimed he acted in self defense.

Once again, a guy who looks like me killed those who don’t. The heart-wrenching murder of 50 Muslims at the hands of a white supremacist on March 15 played out as it has so many times in the past, with a narcissistic male high on hate wreaking carnage on innocent families engaged in prayer.

But because it happened in New Zealand, this time the response was different. And mind-bogglingly swift.

Within six days, the national government had banned “military-style semi-automatic assault rifles” (read: AR-15s) and mandated that all such weapons be surrendered. There was virtually no opposition — because, in New Zealand, there’s no legal provision affirming an individual’s right to own weapons.

Having said all that, I now have to admit that I’ve recently signed on with the anti-gunners.

On one issue, at least.

Working its way through the Ohio House is a bill, sponsored by a couple of downstate Republicans – Tom Brinkman of the Cincinnati area and Ron Hood of Ashville – and supported by 27 other GOP legislators, that would end the license requirement for people wishing to legally carry a concealed weapon.

One of the Democrats running for president and getting a lot of air time is Senator Cory Booker of New Jersey. Booker had a bit of a star turn before he even reached the Senate due to the documentary Street Fight, featuring his effort to defeat a political machine in Newark. On Tuesday, April 2, CRPA, with the support of NRA, filed a comprehensive opposition to California’s request seeking an immediate stay of enforcement of Friday’s decision in the case of Duncan v. Becerra, which found California’s restrictions against so-called “large-capacity” magazines unconstitutional and unenforceable.

This is the second opposition filed in response to California’s request for a stay. As reported yesterday, DOJ filed a request seeking an immediate stay while the court considered an additional request to stay the judgment while the case gets appealed.

However, anybody who tries to cast those numbers as Republican indifference to violence against women isn't telling the whole story.

Rather than simply reauthorize the law, Democrats used the opportunity to add more federal gun control to legislation originally aimed at combating domestic violence and sexual assault.

"Republicans are committed to reauthorizing VAWA, however, Democrats have refused to engage on the issue in a meaningful, bipartisan manner and instead rushed a partisan bill to the floor," reads a statement to Blaze Media from the office of Minority Whip Steve Scalise (R-La).

HB 1651 then, would allow for the names to be submitted to NICS for background checks in the event that a “dangerous” person attempts to buy another firearm. If, for example, a “dangerous” person sought to purchase a gun one day after having their firearms confiscated, they would be flagged as prohibited from buying another weapon.

The bill would also strengthen due process and clarify vague language in the definition of a dangerous individual, replacing “emotionally unstable” with “suicidal.”

An additional component in the legislation regarding the grant of confiscated guns to a responsible third party for safekeeping caused major concern for committee member Sen. Greg Taylor, D-Indianapolis.

The California Attorney General's office now admits that magazines are flooding the California market and represent
“an unacceptable danger to public safety.”

The AG's office has set a deadline of 5 PM today for the judge to rule on the stay, or they will go to the Ninth Circuit Court to file for an emergency stay.

CEO of Michel & Associates, P.C., C.D. Michel, told AmmoLand that they are trying to “put the genie back in the bottle,” and expressed doubts that the AG's office actually thought that no magazines were coming into the state.
