CO: Rights are NOT “Privileges” and are NOT lawfully subject to license or licensing requirements

I wrote the following letter to my state representative. I’ll share the response with you when it arrives, and will let you know if it doesn’t.

I’m writing you today concerning a point of Constitutional law I recently uncovered that appears to put much of Colorado’s licensing efforts in a dim light. In particular, I’m licensed by the El Paso County Sheriff’s Office to carry a concealed handgun, and fully understand all the privileges and restrictions associated with that permit.

Massad Ayoob visited the Suwannee County Library on Thursday, Sept. 1 to give a presentation on the Florida “Stand Your Ground” law and related principles to the law.

The law—which passed in Florida in 2005—encompasses different principles and removed the obligation to retreat when the use of deadly force is justified because of an imminent threat of bodily harm or death.

Ayoob, the author of more than a dozen books on firearms, self-defense, and related topics, presented to a group of around 40 people at the library. He explained why giving seminars like these were important.

So I started reading about guns and gun politics and why such a horrible thing was able to happen and why nothing legislative happened in its aftermath to ensure it would never happen again. I read a lot of nonfiction, including Gunfight by Adam Winkler, Gun Guys by Dan Baum. Ricochet: Confessions of a Gun Lobbyist by Richard Feldman. These books, among others, helped give me an idea of the environment and history and politics behind gun violence.

But for a small subset of the community, Orlando has become a call to arms.

When the firearms instructor at the range near Piru asked each person in the class why he or she was there, Fischer ticked off several reasons and mentioned the Pink Pistols.

“What is the Pink Pistols group?” a man asked.

There was a pause.

“We’re — a gay gun group,” Fischer said hesitantly. He tried quickly to explain.

“No, that’s awesome,” the man said, nodding reassuringly.

An Englishman named Neelan Tailor is getting the vapors because he discovered that citizens of a free country who haven’t cravenly given away their natural right of armed self-defense sometimes post pictures of their “everyday carry” items to the Internet.

Without knowing anything about the individuals who have posted to the subreddit, or the process of obtaining concealed carry permits in the United States (concealed carry permit holders are the most law-abiding citizens in the nation), Tailor has haughtily decided that all of these people should be fired.

The Second Amendment Foundation says the city of Seattle violated a state public records law for not releasing revenue data regarding the city’s gun violence tax, according to the lawsuit filed in a Washington court Wednesday.

The lawsuit centers on a request by Dave Workman, an editor of SAF’s online publication entitled TheGunMag.com, in April asking for documents regarding revenue generated by the tax in the first quarter.

In the course of this God-awful, drink-inspiring, litter-runt of a presidential election, it has become common to hear it said in certain of the Right’s more histrionic quarters that conservatism has failed and needs to be burned swiftly to the ground.

As a proposition, this has little to recommend it. One rarely improves upon the prospects of anything by setting fire to it, and, besides, the claim itself has the intractable problem of being false. In fact, conservatism has achieved an enormous amount in the last half century, and, had it been permitted to take the Republican party’s reins this year, it could have continued to do so into the future.

MO: NRA’s Home Invasion Attack Ad Targeting Missouri Senate Candidate Is Debunked By NRA’s Own Website

A new attack ad from the National Rifle Association (NRA) depicting a woman as a victim of a home invasion falsely attacks Missouri Democratic Senate candidate Jason Kander with the claim, “You have the right to protect your home with a firearm. But liberal politician Jason Kander voted against your right.”

But the legislation cited in the ad wasn’t about “the right to protect your home with a firearm”; instead -- as explained by a since-deleted post on the NRA’s website -- it was a bill to expand self-defense rights outside of the home, similar to controversial Stand Your Ground laws.

Over the past seven days, America witnessed seven mass shootings that left five dead and 32 wounded. These attacks bring the US mass shooting body count so far in 2016 to 291 dead and 1,037 injured.

Meanwhile, Europe suffered one mass shooting over the same period of time: On Saturday at about 5:00 PM, at least 15 men came to the home of a businessman in Yekaterinburg, Russia, to confront him over a dispute he'd had with guests at a local Roma wedding the previous night. The businessman responded by opening fire with a Kalashnikov-type weapon, killing two people and injuring seven before fleeing.

So, let’s break this down and explore the first part about “A well regulated Militia.” According to Merriam-Webster dictionary, a militia is “a group of people who are not part of the armed forces of a country but are trained like soldiers.” In America today, we do not have a militia and have not had one since the early 1900s.

We have the strongest military in the world, composed of powerful branches along with a coast guard and reserves. In short, we do not have a militia nor do we need one.

Massachusetts’ controversial Attorney General, Maura Healy, who was elected last year, is being sued by two prominent and popular gun manufacturers, Remington and Glock. They contend that Healy is using the power of her office to harass them. From bostonglobe.com:
Both Remington and Glock have sued Healey in Suffolk Superior Court, arguing that she is abusing her authority by casting a broad net for documents, including those related to accidental discharges, past lawsuits, legal settlements, and product recalls.

Glock Inc.’s lawsuit asks the court to quash Healey’s inquiry.

In May 2000, Tim Kaine, then-mayor of Richmond, Va., used more than $6,000 in public funds to charter eight buses. The buses were used to transport city residents from Richmond to the anti-gun, and inaccurately named, Million Mom March in Washington, D.C.

On Wednesday, the United States Court of Appeals for the Third Circuit held that some individuals who have been denied their right to keep and bear arms might be able to recover their rights.

Unlike the rights to vote or to hold public office, which are often restored upon completion of sentence, restrictions on the right to keep and bear arms last long after completion of sentence and often extend to a lifetime ban. This is the case for even some non-violent misdemeanor convictions, and that is what the plaintiffs in this [Second Amendment Foundation] case challenged.

I support a long-term solvency plan for Social Security. I support a strong defense to fight Islamic extremism and protect Americans. I support expanding individual freedoms, not limiting them as our current congresswoman would on issues such as the Second Amendment. And, unlike my primary opponent, I support repealing Obamacare. It has destroyed the jobs market, increased premiums and limited access to health care.

Clinton’s “extremist judges,” he said, “would allow her to completely take over the American health care, the American economy, the Americans’ religious liberty, not to mention your Second Amendment, which is on very thin ice right now, as you know, because of the fact that we’re at 4-4. If they even pick one judge who’s wrong, you can kiss the Second Amendment goodbye.”

Those who defend or minimize the EEOC’s decision say that it was not definitively declaring the cap’s wearer to be racist, citing the EEOC’s statement that “we are not prejudging the merits of Complainant’s complaint. Instead, we are precluding a procedural dismissal that would deprive us of evidence that would illuminate the meaning conveyed by C1’s display of the symbol.”

But that misses the point. Even if the cap’s wearing did have a veiled, racist meaning (which seems extremely unlikely), the EEOC still had no basis for demanding an investigation, as the Title VII statute only covers harassment that is “severe or pervasive,” not subtle or ambiguous. Defenders of the EEOC’s decision simply ignore the “severe or pervasive” requirement.

The word “assault weapon”, as you use it, is again more misinformation. Automatic weapons, (i.e. machine guns), are much more heavily regulated by the government and it’s nearly impossible for anyone to legally obtain or possess one. The semi-automatic rifle you write about is often seen and used for hunting purposes across this great nation of ours. By the way, hunting in general has nothing at all to do with the Second Amendment. Just another misguided reference you use.

Dozens gathered at the Summit County Republicans headquarters in Frisco for a campaign stop by U.S. Senate candidate Darryl Glenn. The event was a who’s who of the county’s GOP, featuring appearances by local candidates and state lawmakers.

In a stump speech, Glenn urged the crowd to vote for candidates with integrity — regardless of their party — and gave a strong endorsement to all of his down-ballot Republicans, particularly Derek Woodman, who is running against interim Sheriff Jaime FitzSimons.

Miller's Democratic challenger, Beth Tuura, said gun control has become a huge issue after the massacre at Pulse, which is in the district. She criticized Miller for voting for a bill allowing concealed weapons permit holders to carry guns on college campuses.

"When I was just going door to door that was a big topic," Tuura said. "Generally people are pro-Constitution, pro-Second Amendment, but they also think there's common sense measures that can be taken."

Slinging legal arguments that never mentioned the right to bear arms, gun rights advocates argued before the Wisconsin Supreme Court Friday for the right to carry handguns on city buses.

The dispute began when Wisconsin Carry Inc. sued the City of Madison in January 2014, challenging Madison's Transit and Parking Commission for passing a rule forbidding "weapon[s] of any kind" on Madison Metro buses, according to a case summary provided by the Supreme Court's public information office.

So far, Wisconsin Carry has been unsuccessful both in the state court and in a lower appeals court.

I'm not one to inject my politics into an article, so here's simply the facts.

Devil You Know has announced that it has partnered up with cable television show Legally Armed America for use of their music throughout the show. The Louisiana-based show calls itself a show and "web community dedicated to those who wish to stay abreast of the latest firearm-related products, news, events, and anything gun-related." Paul Glasco, who is the President of the show, says Devil You Know was chosen because their music matches the channel's energy, much like their former partners Five Finger Death Punch, who made the theme song for the show.

On Monday, September 12 2016, the New Jersey Senate Law and Public Safety Committee is scheduled to consider S.152.

Sponsored by state Senator Fred H. Madden Jr., S.152 would criminalize the possession of the SS190AP (armor piercing) cartridge for the FN Five-Seven handgun. This ammunition is already banned under existing law.

 QUOTES TO REMEMBER
The whole of the Bill of Rights is a declaration of the right of the people at large or considered as individuals. It establishes some rights of the individual as unalienable and which consequently, no majority has a right to deprive them of. — Albert Gallatin of the New York Historical Society, October 7, 1789.
