KY: Judge Rules Man Acted In Self-Defense When Shooting Two Brothers

While the two men were fighting, the owner of a nearby gun shop saw the two struggling over a gun on the ground. He yelled at them to put the gun down, leave the gun alone. Seeing the danger to shoppers nearby, he ultimately fired at the men.

One was killed and the second injured but survived. It turns out these were two brothers in their 20’s. After an investigation, the shooter was arrested and charged with murder in the death of one as well as assault charges for shooting the other.

This past Friday, a judge ruled the Louisville man acted in self-defense when he shot two brothers. The Judge ruled the shooter had reasons to believe his life and the lives of others in the area may have been in danger. She dismissed all charges.

Smith & Wesson (SWHC) late Thursday crushed fiscal first-quarter earnings estimates and also boosted its fiscal-year sales and profit outlook thanks to recent acquisitions. But the stock, at critical technical levels, failed to hold early after-hours gains.

EPS nearly doubled to 62 cents, surpassing estimates for 53 cents. Sales jumped 40.1% to $207 million, beating views for $198.16 million.

Being able to hit stuff with a rifle has always been considered an essential skill for any outdoorsperson. But the activity has an increasingly negative image, with all the discussion about gun control, and as interest in the outdoors shifts to purely recreational pursuits, firearms training is increasingly neglected. Julia Brooks and Brian Kim, both 27 years old, were leaving Kim’s residence just after 10 p.m. when Kim was alerted through a cell phone app that there was a possible intruder at the home. They returned to the house, only to find the suspect come out from around and corner and move towards them in what the sheriff’s office described in a news release as a “threatening manner.”

The suspect was recognized by Brooks as her ex-boyfriend, 55-year-old Robert Peak. Brooks previously moved out of another state in an attempt to get away from Peak, but he was apparently still able to locate her.

Peak was armed with a gun, as was Kim. There was an exchange of gunfire between Kim and Peak, but Peak was the only one who was struck.

A man who police say was stabbed Wednesday on North Martin Luther King Boulevard died from his injuries.

Timothy Lee Jones, 40, died of multiple sharp force injuries at the UK Medical Center.

His body has been sent to the State Medical Examiner’s Office in Frankfort.

Funeral arrangements are incomplete at this time.

The investigation is ongoing, but police say that Jones and a 47-year-old neighbor were arguing when a physical altercation happened. Police say that the neighbor told them Jones came at him with a rifle.

A man who fatally stabbed another will not be charged, police said today.

Christopher Michael Kimbal, 22, of 602 South Road, was stabbed at least four times on Aug. 22, police said. The Guilford County District Attorney’s Office determined the 34-year-old man who stabbed him did so in self-defense and will not be charged, said police Capt. Tim Ellenberger.

An Oregon district attorney's office says it won't file charges against a man who apparently shot and killed his brother.
The Daily Courier reports that Josephine County District Attorney Lisa Turner said Thursday that the state doesn't believe it can prove beyond a reasonable doubt that Wayne Hansen wasn't acting in self-defense when he shot his brother.

Well-known firearms instructor Rob Pincus of I.C.E. Training drove up to his wife’s old home yesterday, and found out that the home—which was supposed to be vacant—wasn’t.

Rob was armed, had the skills and training, and did what any intelligent person in his situation would do.

He called the police, and let them handle it.

The Associated Press reports, “the 9th Circuit in its 3-0 decision agreed that it’s reasonable for federal regulators to assume a medical marijuana card holder is more likely to use the drug.” While this on its face is a laughably obvious statement, because of course legal users are more likely than non-users to consume a medication, the reasoning that this truism supports is utterly illogical and subversive to the future of effective medical care, for medical cannabis patients and non-patients alike. The 9th District court’s decision upheld the faulty logic used by the Bureau of Alcohol, Tobacco, and Firearms (ATF) in a memo issued five years ago on the same topic.

The number of Hoosiers who hold active licenses to carry handguns has grown by nearly 50 percent since 2012, according to an IndyStar analysis, and the state is on pace to issue substantially more licenses than it did last year.

IndyStar analyzed data kept by the Indiana State Police regarding handgun permit holders. In Indiana, residents do not need a permit to buy a gun or to carry a rifle, and permits are not required to go target shooting or to keep guns at home. Permits are needed only to carry handguns in public.

When we asked Ryan’s office to provide backup for his claim, a spokesman pointed to a 2010 U.S. Government Accountability Office report. That report states the FBI is alerted when a federal background check for a gun transfer is performed on someone whose name is on a terrorist watch list.

We confirmed the same with Dave Joly, a spokesman for the FBI’s Terrorist Screening Center, and Second Amendment expert Adam Winkler, a law professor at the UCLA School of Law.

Such background checks are mandated under a federal law called the Brady Handgun Violence Prevention Act — commonly known as the "Brady Bill."

In the Hawkeye State, Senate Judiciary chairman, longtime defender of our firearm freedom and NRA A+-rated Sen. Chuck Grassley is being challenged by former Lt. Gov. Patty Judge.

Grassley’s support of the Second Amendment is unquestioned, including his leadership as chairman of the Senate Judiciary Committee. He has opposed Feinstein’s semi-automatic and magazine ban; supported national Right-to-Carry reciprocity legislation; opposed “universal” background checks; opposed gun control laws for Washington, D.C.; and voted to prohibit gun confiscation during states of emergency, as happened after Hurricane Katrina.

More than half the nation now supports gun rights over gun control, but a new survey finds that the issue has become one of the most divisive in the race for president.

The Pew Research Center revealed that 52 percent of the country believes it is more important to protect the Second Amendment right to own guns compared to 46 percent who want gun control.

Why a “long gun”? It’s because state law says any firearm under 12 inches long is a concealable weapon — and Bledsoe believes the law requiring a state permit to carry a concealable weapon is unconstitutional. So he carries a bigger gun — in Bledsoe’s case, a Brown Bess flintlock rifle dating to the American Revolution — to make a point.

“At the State House here and in D.C. we have criminals — they’re breaking the law,” he tells Free Times. “To require a permit is against the South Carolina constitution. What I’m doing is trying to point out where these guys are taking our rights.”

In Illinois, citizens must have a firearms owner’s identification card to make a purchase. That process is designed to screen out people with criminal records or a history of mental illness.

But other states, like Indiana, do not require a permit as a condition for purchase. So it’s easy to see why those with suspect intentions would go to Indiana to obtain their weaponry and bring it back.

The new law won’t have any impact on what occurs in other states. But it puts real bite in the effort to discourage and penalize those who choose to traffic in firearms.

It would be nice to think that legislation of this kind would put a major dent in the problem. But no one should be so naive as to expect grand results.

This is counter-strike video to the anti-gun crowd who want to keep people unprotected. In this short film created by a group of North Texas activists we see an innocent college student that’s excited about meeting Shannon Watts. Shannon you will remember is the Head of Moms Demand Action, a staunch anti-gun group who parades around the country trying to disarm everyone. They even engage in scripted rhetoric at state capitols, and prance around happily at their sparsely attended rallies. In the film, the student then gets her home invaded by an intruder and has nothing to protect herself with except for her large dildo that she was using as a prop like Rosie Zander did on the University of Texas Campus.

In essence, the bill would require all gun sales, and (here’s the hidden kicker) all “transfers” of firearms, to be processed through a federally licensed dealer.

The licensee would, for a fee, perform a federal background check to be sure the recipient is legally entitled to possess the transferred weapon.

Requiring all sales to be processed would void the current state law permitting private sales without background checks (sometimes called the “gun show loophole” – though most private sales do not occur at gun shows, and the organizers of most shows require a check for any transaction).

The Second Amendment, only being a couple of hundred years old, will be a piece of cake for a Mrs. President to put a end to it. I am sure she and the Democrats will start the second inning (the first inning was eight years long with Obama laying the groundwork) preaching to us Americans that those who wrote the Second Amendment (the right to bear arms) only did so in order to have a means to put meat on the table for the family, NOT to protect their family from overseas enemies and CERTAINLY not from within their own government! Heads up.

While I’m depressed about the election and America’s economic future, the news isn’t completely grim. Advocates of personal freedom are winning on the issue of guns.

Gun ownership has become more pervasive and legal protections for the Second Amendment have expanded, all of which is very good news for those of us who want a more law-abiding society.
