NE: Let justice be served

He has been in prison for 22 years for committing a murder that was deemed not a crime on the basis of self-defense by two separate Nebraska juries. In other words, his conviction had no basis in law or fact.

How is justice served by forcing a man to remain in prison for murder when a murder was not committed? I hope that the unicameral takes this up and frees Jackson in the next session, or the matter is appealed through the federal courts based on a denial of his constitutional rights.

Publicist Sydney Schiff moved to New York City nine years ago from Tampa, Florida, to attend FIT and always moved around the Big Apple in a carefree manner. But she now carries pepper spray with her everywhere — especially after moving to the East Village last year.

“I’ve had to call the cops four times in the last two months,” said Schiff, 27. “There is one person who has to be on drugs, that sleeps on my stoop and if you ask him to move he gets aggressive. So I always have my pepper spray.”

No doubt, Houck’s defense attorney will explore any and all defenses, starting with whether the man shoved by Houck even falls within the “obtaining or providing” requirement of the federal statute. It also may be a clear case of self-defense, since Houck apparently was defending his 12-year-old son from an adult who was harassing and intimidating a minor.

The fact is that the Justice Department, under Democratic administrations, has a history of misusing the FACE Act to go after abortion opponents.

An Illinois man has been acquitted of first-degree murder and unlawful discharge of a firearm after a fatal shooting on Feb. 13, 2021.

The two men involved in this incident had a history of having a dispute. On many occasions, including the day of the shooting, a Missouri man caused a disturbance at the home of the other man involved. It is alleged that this man brought a handgun and an AR15 with him, and he was high on drugs at the time.

The Destructive Legacy of the Federal Taxing Power

Excise taxes can be used to raise revenue, but they are also used to “modify” behavior.

For instance, gun control supporters proposed a 1000 percent federal tax on AR-15-style rifles. There wasn’t even a pretense of levying this tax to raise revenue. In their minds, a tax that turns a $1,200 rifle into a $12,000 rifle is perfectly justified in order to make the cost of gun ownership prohibitively expensive.

At what point did the federal government begin reading the constitutional taxing power so broadly it could become an instrument of social engineering?

...officers were called to a bar based on reports that a man was shot in a confrontation. Once they arrived, police and paramedics found a 26-year-old male suffering from gunshot wounds. He later died.

In the beginnings of the official investigation, the authorities moved quickly. They located their suspects in the shooting, brought them in to police custody for questioning, rounded up evidence, reviewed surveillance footage, and spoke with eyewitnesses.

After analysis and discussion of their findings with the Yakima prosecutor, the suspects were released from police custody after it was determined that the evidence supports that the shooting was a justified act of self-defense.

There are many good reasons for choosing a revolver for self-defense. They’re simple, reliable, and available in a double-action variety that is easy to use.

If you’re looking for an easy-to-use gun to get the job done, you might want to consider a revolver. The guns are not as popular as they used to be, but they’re still around and as effective as ever.

New Zealand’s Prime Minster Jacinda Ardern – the woman, you may recall, who insisted that her constituents simply believe the government’s line on COVID and reject all else off-hand, herded them into "quarantine camps," and is vehemently against the right of supposedly free people to own firearms for self-defense – is back with a new anti-speech, liberty-killing hot take: this time, on internet regulation.

Speaking before the United Nations this week, which tells you just about everything you need to know right there, Ardern called free speech online a “weapon of war,” saying that global leaders “must address” the “challenge of misinformation and disinformation online.”

A group of black gun owners with the Elmer ‘Geronimo’ Pratt Pistol & Rifle Gun Club marched in a “Second Amendment Unity Walk” in Austin, Texas Saturday, calling attention to illegal immigration and demanding reparations.

They also attacked the Biden administration for, as they said, pandering to Asians after hate crime killings in Atlanta, but ignoring the killing of blacks in Buffalo by an avowed white supremacist.

If good fences make good neighbors, then surely, well armed citizens make for good manners. Just as respect for another's privacy and personal boundaries paradoxically creates common bonds, the expectation that those around us are capable of standing up for themselves, or defending their own lives if necessary, establishes an equality among strangers otherwise possessing vastly different natural strengths. The "woke" victimhood cult dedicated to confiscating guns steadily ignores this point.

A year after 17-year-old Cedric Lofton died in custody, Sedgwick County commissioners remain divided over whether to seek an audit of the state self-defense laws used to justify not charging county employees who fatally restrained the teen.

Commissioners clashed Wednesday over whether to follow through on a recommendation from a juvenile justice task force to look into whether the "stand your ground laws" cited by District Attorney Marc Bennett were being appropriately applied. Under these laws, people who are threatened aren't required to retreat before using deadly force to defend themselves.

Texas is gearing up to fight a judge’s ruling that the state can’t ban adults under 21 from carrying handguns, a surprising move that’s drawing anger from some gun rights groups.

Last week, Attorney General Ken Paxton’s office filed a notice of an appeal of the ruling on behalf of the Texas Department of Public Safety. It came almost a month after U.S. District Judge Mark Pittman, who was appointed to the bench by former President Donald Trump, issued the original ruling on Aug. 25, writing that the Second Amendment protects all adults’ right to bear arms without an age limit.

NC: Jim Crow pistol permit remains a shameful blot on our state

Despite a new research paper by two Clemson University economists proving that black lynching decreased with greater firearm access, North Carolina still clings to its Jim Crow pistol permit. The state remains the only former Confederate state with the pistol permit law enacted here in 1919.

Gov. Roy Cooper vetoed a repeal of the Jim Crow law in 2021, despite support for repealing the law by the NC Sheriffs’ Association. In the past, the state Sheriffs’ Associations opposed repeal, but updates to the national instant background checks make the law redundant and a hassle for residents.

Hunters in Hardin, Marion, and Wyandot counties are enjoying extra dates to harvest a white-tailed deer as the Ohio Department of Natural Resources (ODNR) Division of Wildlife continues to monitor for Chronic Wasting Disease (CWD) in the region.

Since the fall of 2020, 11 wild deer have tested positive for CWD in Ohio, all in Wyandot and Marion counties. In response, a disease surveillance area was established in Hardin, Marion, and Wyandot counties. CWD is a fatal neurological disease that affects deer and other similar species, including mule deer, elk, and moose.

“Your shooting position should be balanced, comfortable and relaxed.” If that sounds like your first pistol instructor, you had a good one. I teach this myself, except I add a few words to the end of that statement: “whenever possible.” Life-or-death engagements are seldom any of those three things, so you must learn how to effectively use a pistol when positioning isn’t perfect and also realize your limitations. Here are some drills that will help you get more comfortable with being uncomfortable. Take them slowly and be extra vigilant of safety rules in these drills.

There’s only one problem with creating a law to restrict weapons from would-be criminals, Gary Maha says.

Law-abiding citizens will be the only ones to follow it.

“If they want a gun, they’re gonna get a gun,” the legislator said during Genesee County Legislature’s meeting Wednesday. “If you’ve got a shooting somewhere, do you want the good guy without a gun? You don’t just want the bad guy with a gun.”

Maha first proposed that Legislature sign a letter of opposition to the newly adopted Concealed Carry Improvement Act, and send it to Albany for Gov. Kathy Hochul and state Legislature members to see.

Section 1021.11 of the Code of Civil Procedure, added by SB 1327, would make attorneys and plaintiffs seeking to challenge gun laws or restrictions “jointly and severally liable to pay the attorney’s fees and costs of the prevailing party.”

Plaintiffs including San Diego firearms dealer Gunfighter Tactical, the San Diego County Gun Owners PAC and the Second Amendment Foundation allege in their lawsuit that the statute regarding legal fees is unconstitutional and “seeks to suppress firearms-related litigation.”

"The gun owners in this particular case are saying the explicit reason for this law, SB1327, is to chill the exercise of Second Amendment rights to keep and bear arms by making cost prohibitive to sue, because if they lose, they have to pay the government or whoever the defendants are attorney's fees," Dan Eaton, a constitutional law scholar, said. "And that effectively chills their First Amendment right to petition the government for redress of grievances. In this case, the grievance that their constitutional right to keep and bear arms is being unduly restricted,"

SB1327 is set to go into effect on Jan. 1, 2023.

The grassroots DC Project recently returned from its fifth visit to Washington, where its members brought their Second Amendment concerns to lawmakers.

The latest trip included 51 delegates from 48 states and met with legislators from both sides of the aisle. The mission: educate that gun rights are human rights and misguided concepts like gun bans and restrictions don't work.

This simple precaution — law in 14 states already — might have prevented one of the first mass shootings that shocked our nation. According to news reports of the 2012 Sandy Hook massacre, "The Lanza home was a virtual arsenal with guns and ammunition everywhere. Law enforcement even found a gun safe in Adam's bedroom." It apparently wasn't being well-used; the shooter grabbed a semi-automatic rifle, shotgun and two handguns, along with 527 rounds of ammunition, for his elementary school attack. Before leaving the house, he killed his mother. Had she secured her collection, many lives might have been saved that brutal December day.

What we need to rectify this situation is more policing and enforcement of the rule of law. Until then, we are going the wrong direction by focusing upon gun control. We need to be increasing funding to the police, not "defunding" them. And we need to ensure that law-abiding citizens are afforded their constitutionally guaranteed right to bear arms. It's an essential way for men and women to protect themselves.

People kill people. Guns do not. And it is obvious that overregulating gun ownership will have zero effect on the estimated 400 million guns that are already in private circulation. Gun control simply cannot stop violence in this country, which is being caused by a crime-ridden society that is out of control.

Yesterday, lame-duck Mayor Jim Kenney signed an executive order prohibiting individuals from lawful carry at all City of Philadelphia recreational facilities. The mayor’s actions are in clear violation of Pennsylvania law prohibiting these types of local gun restrictions. Within hours of Mayor Kenney’s signing ceremony, Gun Owners of America (GOA) filed a lawsuit to enjoin enforcement of this illegal gun regulation.

Under the novel California law, attorneys and plaintiffs seeking to challenge the state's firearms restrictions are "jointly and severally liable to pay the attorney’s fees and costs of the prevailing party," according to Section 1021.11 of the Code of Civil Procedure.

Groups challenging Newsom's measure include the Firearms Policy Coalition, the Second Amendment Foundation, firearms dealer Gunfighter Tactical, and the San Diego Gun Owners PAC. Their lawsuit alleges that the statute regarding legal fees is against the Constitution and that it "seeks to suppress firearms-related litigation."

The federal prohibition on convicted felons possessing guns is in line with the Second Amendment.

That’s the conclusion reached by the judge who recently ruled the ban on those under felony indictment receiving guns was not. Judge David Counts of the U.S. District of Western Texas found that contrary to the indictment ban, the convicted felon ban survived scrutiny under the Supreme Court’s new Bruen standard.

“Bruen did shake up the legal landscape,” Counts wrote in his ruling. “And the Court believes that faithfully following Bruen’s new framework casts doubt on some firearm regulations. But the regulation in this case is not one of them.”
