MI: U.P. couple challenging gun rules in foster homes

A gun-owning couple in the Upper Peninsula has cleared a key hurdle in challenging Michigan’s restrictions on firearms in foster homes.

William and Jill Johnson of Ontonagon are licensed foster parents. They’re suing the Department of Health and Human Services over a rule that requires them to keep a gun locked up and unloaded and stored separately from ammunition. They say it violates the U.S. Constitution.

Western Michigan federal Judge Paul Maloney says the lawsuit can go forward. In a recent decision, he says storing guns “in an inoperable condition makes them useless for the defense of hearth and home.”

It's back to school for students across northern Michigan.

And one school district is taking an extra step to keep your child safe.

Glen Lake Community Schools installed new security systems over the summer, which will help protect students in the event of an active shooter.

“One thing we’ve heard loud and clear is whatever it takes to keep kids safe,” said Superintendent Sander Scott.

Starting this year, their school is now equipped with a new system, one their team came up with themselves by combining systems from multiple companies.

“We didn’t want to have a single point of failure for a system,” said Director of Administration and Instructional Technology Marcus Mead.

"We know that he's armed with two guns," said Sutton. "He's holding his pistol to the victim dragging her out." Sutton said.

But the woman quickly turns the tables on the suspect who has been identified as 27 year old Mario Trejo.

"He's got the wrong victim here," said Sutton. "First of all she is exceedingly courageous and second she's familiar with a firearm."

The video shows the woman confidently disarming the suspect and then running away giving police officers a clear shot.

In trying and failing to corner Supreme Court nominee Brett Kavanaugh on guns, Sen. Dianne Feinstein, D-Calif., ended up confirming what Second Amendment advocates believe about “assault weapon” bans: They’re usually based on flawed talking points and written by and for people who either don’t understand or choose to ignore the facts about guns and the Second Amendment.

Feinstein’s foible came during the same line of questioning on Tuesday in which she got caught fudging the facts about school shootings.

But a new study bolsters the contention that the real power of the organization rests in the commitment — and political involvement — of its membership.

And it’s a contention that all citizens, regardless of cause or inclination, should consider carefully.

Political scientists at the University of Kansas recently released a study they says that gun owners are more politically active, including in their voting, than are those who don’t own guns.

Gun ownership is a stronger predictor of a person’s political activity than factors such as gender, age and education, according to a study that helps explain why mass shootings have done little to advance the cause of advocates calling for stiffer laws.

The intensity of gun owners has made them an outsized political force over the past four decades, according to the study, released this week from the University of Kansas.

“In virtually every form you look at — ing elected officials, signing petitions or contributing to campaigns ­— you see higher participation rates amongst gun owners versus non-gun owners,” said Don Haider-Markel, chairman of the university’s political science department and one of the study’s authors.

The National Rifle Association Political Victory Fund (NRA-PVF) today launched a six-figure TV ad campaign highlighting that Sen. Joe Manchin cannot be trusted to support the rights of West Virginia's law-abiding gun owners.

“Voters deserve the facts before they head to the polls,” said Chris W. Cox, chairman, NRA-PVF. “Contrary to what Joe Manchin says in West Virginia, he has supported the agenda of Barack Obama and Chuck Schumer by voting in favor of gun control in Washington, D.C.”

By July 2019, any Chicago police officer who points a gun at someone during an arrest or street stop would have to inform dispatchers by radio of the incident under a deal between Mayor Rahm Emanuel’s administration and Illinois Attorney General Lisa Madigan’s office that was introduced Thursday.

Cops would not have to fill out a use of force report, as they do when they use a Taser or fire a gun, but supervisors would have to review the gun-pointing incident and it would be recorded in city data. The department also would have to develop training on when to point a weapon.

Feinstein quickly sought to shift from “common use” applying to possession or ownership, and suggested that “common use” instead means using the guns for the same purposes.

She asked rhetorically, “You’re saying the numbers [of guns owned] determine ‘common use’?” She then added, “‘Common use’ is an activity. It’s not common storage or possession, it’s use. So what you said is these weapons are commonly used. They’re not.”

The media’s pro-gun-control bias doesn’t just distort news coverage. TV networks have used their primetime entertainment shows to portray gun rights advocates as dishonest, extremist and unconcerned about the loss of innocent lives. At the same time, advocates of gun control are portrayed as caring, upstanding and responsible citizens.

The reality is that Hogg and his fellow crusaders don’t actually care about a handshake — they’re simply mortified by the prospect of a judge joining the Supreme Court who is willing to enforce the Second Amendment as written. Hogg admitted as much in a tweet, imploring people to lobby their senators to vote against Kavanaugh, because “Gun violence prevention is on the line.”

With the recent increase in mass school shootings, state legislators around the country have contemplated the idea of arming public school officials, yet Virginia Attorney General Mark Herring completely disagrees.

The unfortunate Valentine’s Day mass shooting that occurred at Marjory Stoneman Douglas High School in Parkland, FL., collectively killing 17 students and staff members, has led to a national outcry of whether more thorough federal background checks, resulting in stricter gun control laws, are enough at this point.

The status of open carry was not resolved in District of Columbia v. Heller, the 2008 ruling written by Justice Antonin Scalia that established an individual right to firearms. But it’s widely assumed that “bearing” arms as an individual means carrying them. So Heller’s individual right may eventually require allowing either concealed or open carry — or both.

“This is one of the great unresolved issues in Second Amendment jurisprudence,” said UCLA law professor Adam Winkler, author of “Gun Fight,” a history of guns and the law.

Then, Manchin was touting his endorsement from the National Rifle Association. Now, the same powerful lobbying group has come out with a six-figure ad buy against Manchin and in favor of his opponent, state Attorney General Patrick Morrisey.

Manchin drew the NRA's ire after he teamed up with Pennsylvania Republican Senator Pat Toomey to champion legislation that would have expanded gun background checks in the aftermath of the deadly shooting at Sandy Hook Elementary School in Newtown, Connecticut that claimed the lives of 26 people, including 20 schoolchildren in December 2012. But the so-called "Manchin-Toomey" bill fell short of the 60 votes needed to move forward in 2013, and again in 2015.

By now, you’ve probably heard of Andrew Cuomo’s latest attack on the National Rifle Association – the weaponization of bank regulations to silence this civil rights organization’s voice. That effort has drawn belated criticism from the ACLU.

Let’s lay it out here – Cuomo’s had a long-running feud with supporters of the Second Amendment and your Right to Keep & Bear Arms.

If you have not read the NRA’s complaint against Cuomo, that is very understandable. It is 45 pages of legalese. But inside that lies the origins of the feud – which started with a lot of lawsuits.

During the third day of his Senate confirmation hearings, the topic of Brett Kavanaugh's assault weapons ban dissent was brought up more than just once. Seven years after he initially wrote the dissent, which argued that a specific ban on assault weapons was unconstitutional, Kavanaugh was willing to stand by his argument once more. Even more surprisingly, he ventured to argue that gun laws have more to do with legal precedent than common sense.

Chip Bergh, the President and CEO of Levi's, wrote an oped this week, titled 'Why Business Leaders Need to Take a Stand on Gun Violence.' He wrote in part, "you may wonder why a company that doesn't manufacture or sell guns is wading into this issue, but for us, it's simple. Americans shouldn't have to live in fear of gun violence."

Bergh pledged $1 million in grants to non profits and activists working to end gun violence.

He's also partnering with Everytown for Gun Safety and is encouraging other business leaders to get involved and push for change.
