LITTLE ROCK, ARKANSAS -- A Little Rock restaurant owner shot and killed a man who was trying to rob him Friday night.

Police say the owner of Sim's Bar-B-Que in Little Rock was working the cash register when two armed gunmen stormed in demanding money.

It happened around eight o-clock during the restaurant's dinner rush. According to investigators, the owner pulled a gun out from behind the counter but one of the robbers shot at him first, hitting him in the hand. The owner then shot that man in the chest and the other suspect in the back.

One man died at the scene, the other suspect was captured about ten minutes later.

LITTLE ROCK, ARKANSAS -- An unusual murder case has prosecutors invoking a rarely used state law. It stems from a fatal robbery that happened Friday night at Sims Bar-B-Que in Little Rock.

Police are still waiting for autopsy results from the medical examiner to determine which bullet led to the death of 20-year-old Willie Tully. Detectives say Friday night, Tully and 17-year-old Otis Brewer went into the restaurant to rob it.

In the process the owner, Ron Settlers, shot the two robbers, killing Tully. Investigators say they're not certain who fired the fatal shot. But, prosecutors have filed charges against 17-year-old Brewer for capital murder and aggravated robbery.

They say he's responsible, whether or not his shot killed Tully.

Pulaski County Prosecutor, Larry Jegley, tells KARK News 4 "if you put into effect a cause of events that results in someone hurt or killed then you should be held liable for your actions." Jegley says the intent is to make sure there are consequences for such violent actions.
