PHILADELPHIA -- Emanuel Glover, 40, a ParaTransit driver, has a license to carry a gun.

He wants the weapon for protection.

On Dec. 1, 1999, he used it.

The gun may have saved his life, Assistant District Attorney Thomas Malone said yesterday.

Glover shot and wounded an angry robber as he was being led at gunpoint into a dark, vacant lot on Tioga Street near 15th, said Malone.

James Marshall, 18, of 18th Street near Rockland, was later arrested after he checked himself into Temple University Hospital with a gunshot wound to his buttocks.

Glover's automatic bank teller card was found in one of Marshall's pockets, Malone said.

After a jury heard the case, Marshall was convicted of robbery and conspiracy charges.

Common Pleas Judge Eugene E. J. Maier committed Marshall to prison to await sentencing in April.

Marshall did not testify.

His lawyer had filed an alibi notice before trial, claiming Marshall had been shot at 6th Street and Allegheny Avenue, but didn't produce any evidence of that during the case.

Malone said Marshall was with an unknown accomplice when they approached Glover at 8:15 p.m. at Broad and Tioga streets.

Marshall pointed a gun at Glover and snapped, "You know what this is, give it up."

When the robbers realized that Glover had only $5, "they got really upset and started screaming at me," he said.

"Come on, you're taking a walk with us," one said.

"I thought they were going to kill me," said Glover. "They already had everything I had."

So he decided to pull out his gun and begin shooting.

Marshall staggered to a getaway car, and the two bandits drove away.

"Mr. Glover acted in self-defense," said Malone. "He only used his gun when he felt his life was in peril. This is why we offer people licenses to carry guns. This gun not only saved his life, but it assured us that we were going to catch the person who robbed him."
