Subject: Arizona Republic Article

Judge Tolby,

I was shocked to read your article in the Republic, (http://www.azcentral.com/community/comstories/0808tolby0808Z8.html) where you fined a law abiding citizen of the state of Arizona $300.00, stating he was in violation of Arizona statute 13-3102.

You stated:

"The law says carrying a concealed deadly weapon without a permit within the immediate control of any person inside a means of transportation is a violation. Very plainly, the law says do not have a weapon within your reach that is concealed inside a car."

Did you not read this section of the law?

ARS 13-3102:

“A.2. Carrying a deadly weapon without a permit pursuant to section 13-3112 concealed within immediate control of any person in or on a means of transportation…”

“…Subsection A, paragraph 2 of this section shall not apply to a weapon or weapons carried in a case, holster, scabbard, pack or luggage which is carried within a means of transportation or within a storage compartment, trunk or glove compartment of a means of transportation.”

Notice it PLAINLY states that subsection A, paragraph 2 DOES NOT APPLY if the weapon is in a holster.

You stated:

“LESSON: If you carry a gun in your car, you had better have a permit and have it in plain view or have it out of reach.”

THE LESSON I GAINED: Some judges will ignore the law, and the Constitution, to promote their own personal political agenda with the harm of Arizona citizens.

Then as proof of your agenda you state:

"I fined the man $300 and tried to explain to him that regardless of the law, carrying a gun puts you and your family at risk."
