The court this week allowed the man to withdraw the plea and ordered that the indictment against him be dismissed.
The new ruling stops short of declaring that the law against firearm ownership by cannabis users—18 U.S.C. § 922(g)(3)—is itself unconstitutional. As applied to the defendant in the case, however, it says that government lawyers failed to demonstrate that the restriction aligns with the nation’s history of regulating gun ownership, noting that that they did “nothing in the way of proving that Defendant was intoxicated by marijuana at the time of this incident.” |

While medical marijuana becomes legal in Kentucky on Jan. 1, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and organizations such as the U.S. Conceal Carry Association warn that under federal law, users will have to choose between the drug and gun ownership.
The Conceal Carry Association states federal law prohibits medical marijuana users from possessing or buying firearms and ammunition, even if state law allows the drug’s use. An individual can’t have both licenses. Under federal law, any marijuana user is an unlawful user of a controlled substance. |

As the Liberals’ continue to expand the scope of their 2020 order-in-council banning nearly 2,000 models of firearms, this year is an important one for Canadian gun owners.
The ban was introduced in May 2020 when some 1,500 models of firearms became prohibited overnight following an order-in-council the Liberals said was prompted by a mass shooting in Portapique, N.S.
Weeks ago, the Trudeau government announced an additional 324 firearms would be added to the ban, on the eve of the 35th anniversary of the École Polytechnique massacre. |

A man was fatally shot Tuesday night in the Germantown neighborhood after allegedly charging at a security guard with a knife, police said.
Officers from the 14th District responded to a report of a “Person with a Gun” at the 5500 block of Germantown Avenue at approximately 8:15 p.m. Upon arrival, they found an unresponsive Black male with a gunshot wound to the chest and multiple self-inflicted stab wounds. |

New Orleans rang in the New Year with tragedy as a 42-year-old Texas man drove a rented pickup truck into crowds on Bourbon Street, killing 10 and injuring at least 35 others. The attack occurred in the early hours of New Year’s Day, disrupting celebrations and raising serious security concerns. Authorities have postponed the Sugar Bowl, originally scheduled for later that day, as the investigation unfolds.
The FBI identified the suspect as Shamsud-Din Bahar Jabbar, a U.S. citizen and Army veteran. Jabbar was killed during a shootout with police after he crashed the truck and fired on officers, wounding two who are now in stable condition. |

As violent crime rates appear to be falling after a pandemic-related spike, gun violence continues to plague communities around the country.
In 2024, there have been nearly 500 mass shootings, according to a database maintained by Gun Violence America. The deadliest occurred in a Chicago suburb in January, killing eight people.

As America continues to debate gun control laws, personal defensive rights, and the Second Amendment, we have a prime example of what I have been saying for years, “regardless if someone has access to a gun or not, if someone is determined to create mayhem, they will; most likely with a vehicle or chlorine “bomb.” Last night in New Orleans, while people were enjoying an evening of partying and fun, someone came out in a Ford F-150 Lightning pickup truck (with a long gun as backup, though it was not used) and rammed down Bourbon Street, plowing through a large number of party revelers, killing 10 and injuring at least 30 people |

That being said, my gift to the ATF this holiday season is pointing out something they are actually helping with.
In North Carolina alone, 474 firearms have gone missing this year, stolen from Federal Firearms Licensees (FFLs), up from 259 in 2023, marking an 83% increase. With the ATF overseeing FFLs and conducting periodic inspections, WCNC Charlotte recently took a closer look at the agency’s efforts to help business owners secure their shops, employees, and livelihoods from criminals.
“We reduce violent crimes and we protect the public … We make sure to educate our FFLs on ways to best secure their premises,” said Regina Milledge-Brown, Director of Industry Operations for the agency’s Charlotte Field Division. |

The First Amendment is an example. At the height of the COVID-19 panic, state and local officials tried to close churches and synagogues while leaving pot shops and liquor stores open. The Supreme Court applied the First Amendment to vindicate religious liberty (pdf).
The only one of the first eight amendments not in full force is the Second, the right to keep and bear arms. Yet, we are still better off having the Second Amendment, because the Supreme Court relies on it to protect the right of personal self-defense (pdf). |

House File 2556, another measure now in effect, bolsters state-level protections on gun rights. The law allows citizens to sue cities that enact firearm regulations conflicting with state laws, with damages ranging from $100 to $2,500 per day depending on intent.
“What that reminds me of, is a concern that the state legislature has for some of the cities that are more liberal-leaning,” said Hagle. “For example, a city like Iowa City, which is very liberal, may be inclined to pass restrictive regulations or laws regarding gun rights.” |

The justices are also expected to hand a decision down on a case brought before them in October concerning the legality of so-called ghost guns – unregistered, homemade weapons made without serial numbers from separate parts.
The challenge to Garland v. VanDerStok, from firearm kit manufacturers and some retailers who sell them, is a response to the Fifth Circuit of the United States Court of Appeals upholding a ruling by a federal district judge at Fort Worth earlier this year that the ATF had exceeded its authority by mandating that weapons parts kits and partially completed gun frames should be classified as firearms. |
