U.S. Senator Steve Daines applauded new guidance from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), saying the agency will no longer enforce the National Firearms Act’s (NFA) onerous federal registration and approval requirements for untaxed suppressors, short-barreled shotguns (SBSs), and short-barreled rifles (SBRs).
“This is a massive victory for law-abiding gun owners and a historic win for the Second Amendment. The Constitution is clear: we have the right to keep and bear arms. The NFA’s tax and registration scheme was unnecessary, unfair, and unconstitutional, and I’m glad to see it dismantled,” said Daines. |

A Tennessee district attorney ruled that a man will not face charges after fatally shooting 24-year-old Dalton Spaulding outside a Gray smoke shop in August. The altercation began when Spaulding accused the man of disrespectfully looking at his grandfather, then threw him to the ground, detaching his prosthetic leg during the continued assault.
The District Attorney General’s office determined Spaulding was the primary aggressor, citing witness statements and surveillance video supporting a self-defense finding. The man fired four shots, three of which struck Spaulding in the chest and arm, resulting in his death at the scene. The shooter has not been publicly identified. |

A federal appeals court on Tuesday ruled that a federal ban on gun possession by convicted felons cannot be constitutionally applied to some people whose prior offenses did not involve violence or threats indicating a risk of misusing firearms.
The U.S. Court of Appeals for the Third Circuit issued two rulings clarifying when the federal prohibition on gun possession by convicted felons can be enforced under the Second Amendment.
The court, which includes several judges appointed by President Donald Trump, upheld the firearms restriction against a man with a conviction stemming from a carjacking but ruled that the ban could not be applied to another man based on his prior drunk-driving convictions. |

The Bureau of Alcohol, Tobacco, Firearms and Explosives has suspended enforcement of certain federal approval and registration requirements for suppressors, short-barreled rifles and shotguns, and other concealed firearms, but warns the policy could be reversed.
The guidance, issued Friday, follows a federal court ruling and Justice Department decision to extend nonenforcement beyond those covered by the court’s injunction.
Texas Gun Rights President Chris McNutt welcomed the ruling but called for Congress to permanently remove the restrictions.
McNutt told Texas Scorecard that although the announcement is “a tremendous temporary victory,” ... |

The Florida Moms Demand Action, a gun control group, reported Monday that “not a single college or university” has opted into the program so far.
Meanwhile, only one school, the University of South Florida, told the Florida Phoenix that it is considering participating.
The law, which went into effect in May, expands Florida’s School Guardian Program by allowing public college and university presidents to designate faculty and staff to be trained to carry concealed firearms on campus.
To qualify, employees must complete 144 hours of training, as well as drug tests and psychological evaluations, according to the Phoenix. The program also is in K-12 schools. |

U.S. Rep. Barry Moore (R-Enterprise) lauded the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for ending some restrictions when it comes to being able to buy certain types of firearms.
The ATF announced last week that it will stop enforcing federal National Firearms Act prior-approval, registration, tax-stamp, and related requirements for short-barreled rifles, short-barreled shotguns, silencers, and certain other firearms.
The guidance follows an announcement by Attorney General Todd Blanche that the Department of Justice will not appeal an August decision made by the U.S. District Court for the Northern District of Texas, which held that certain provisions of the NFA were unenforceable. |

New Jersey has some of the strictest gun laws in the country, according to the National Rifle Association’s Institute for Legislative Action (NRA-ILA). Assistant Attorney General for Civil Rights Harmeet Dhillon said in a Wednesday release that the investigation was intended to correct unconstitutional practices.
“I have directed the Civil Rights Division, through our Second Amendment Section, to defend law-abiding citizens from local authorities who infringe on the right to safely carry legal firearms,” Dhillon said. “Our investigation aims to discover if allegations of unconstitutional delays in firearm permitting are true, and if so, to fix it.” |

The clock is ticking toward a deadline that could determine whether the Supreme Court hears a case that could eradicate bans on standard-capacity magazines holding more than ten rounds.
In a petition filed with the Supreme Court on Oct. 1, Democratic New Jersey Attorney General Jennifer Davenport asked the justices to review a case decided by the United States Court of Appeals for the Third Circuit, Cheeseman v. New Jersey, in which the appellate court declared the state’s ban of magazines holding more than ten rounds unconstitutional on Second Amendment grounds, citing widespread ownership of the accessories for lawful purposes. |

The Second Amendment Foundation (SAF) has compiled a new fact sheet refuting 85 documented claims from anti-gun groups, advocates and public officials who stated pro-Second Amendment court rulings and reforms would produce more shootings, more deaths and immediate surges in violence.
FBI data and other sources instead show three consecutive years of declining murder rates (-9.1% in 2023, -13.7% in 2024, and -18.1% in 2025), the largest one-year drop in violent crime on record in 2025, and a 2026 trajectory that would put the national murder rate at a modern low of roughly 3.2 per 100,000 based on data through July. The sheet also links all 85 predictions researched and the underlying crime data for transparency. |

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) today released guidance for dealers and consumers in response to the landmark National Firearms Act (NFA) injunction granted in Jensen v. ATF, a Second Amendment Foundation (SAF) supported case.
The documents released today provide guidance for both licensed firearms dealers as well as those wishing to purchase, transfer or make a previously regulated NFA firearm. The guidance states that the ATF will cease enforcement on Oct. 9 "…of NFA provisions as applied only to short-barreled rifles, short-barreled shotguns, silencers, and 'any other weapon[s].'" It further states the "…nonenforcement only extends to firearms on which Congress eliminated the making and transfer taxes." |

There’s really no better place for a gun show to be held than a local Veterans of Foreign Wars post.
That was the case on the weekend of Sept. 26-27 at Buddy Howell’s sixth annual gun show at the Libby VFW Harper Erdman Post 148.
Of course, long and hand guns of various vintages, makes and models were the major draw for the hundreds of people who attended the show. But ammunition and other outdoor gear were also for sale.
Howell is the owner and operator of Eagle Outfitters, located at 214 Mineral Ave. Howell's parents settled in Libby following World War II and he has plenty of family here. His father's work took them to Missoula and many other locales. Buddy was born in Missoula. |

I’ve said it before, and I’ll say it again: Second Amendment support shouldn’t be confined to one side of the aisle. It would be better for everyone if both parties stood up for the right to keep and bear arms. But poll after poll puts the share of self-identified Democrats willing to defend that right at roughly a quarter — and the party machinery around them is working the other direction. TTAG has walked through what it actually looks like to be a liberal gun owner at the ballot box this cycle, and the answer isn’t comfortable. |
