WI: Defense expert sticks to self-defense theory, says Rittenhouse justified in use of weapon

During cross-examination that lasted more than an hour Tuesday afternoon, an expert the defense hopes to use in the case against Kyle Rittenhouse continued to insist the teenager had reason to believe his life was in danger during three shootings last August.

Whether that expert’s testimony will ever be heard by a jury remains to be seen.

Kenosha County Assistant District Attorney Thomas Binger continued to pose the question of whether Rittenhouse’s life was in danger to John R. Black in testimony that ended late Tuesday afternoon.

Deputies have identified a man who was shot and killed in Coarsegold on Monday, according to Madera County Sheriff officials.

Authorities say Kirk Yeterian, 36 of Coarsegold, was killed after a man told deputies he had shot Yeterian in self-defense.

Deputies say the incident occurred just after 10:00 a.m. in the 35000 block of Douglas Trail.

According to officials, deputies responded to the scene after dispatch received a call from a man saying he had shot another man out of self-defense.

Authorities say a man has been fatally shot in downtown Phoenix and the suspect is claiming self defense. Officers responded to the shooting Tuesday around 3:15 a.m. and reported finding a man dead. The man was later identified as 28-year-old Pete Barnett-Gearhart.

Police say the suspect remained on scene and cooperated with investigators. The man told police that he shot Barnett-Gearhart in self defense after a fight. The suspect’s name and age were not immediately released by authorities.

The stakes in one of the most significant Second Amendment cases in U.S. history are high.

The Supreme Court’s ruling in New York State Rifle & Pistol Association v. Bruen, expected by mid-2022, could declare a New York state restriction on carrying concealed handguns in public places unconstitutional.

Such a ruling in favor of the plaintiffs, which include a National Rifle Association affiliate, could loosen gun regulations in many parts of the country.

One of the debatable tactics of home defense strategy relates to announcing one’s presence as the home defender in order to give the home invader warning that you are indeed home. For example, if you wake up to the sound of your alarm going off, or to the sound of breaking glass, and you hear someone moving through your home on the main level while you and your loved ones are all on the upper level, should you call out to announce that you are present and issue a warning not to come up the stairs? Many leading thinkers in the field of self-defense lean one way or another on this argument.

According to the law, the state’s hand in eliminating the ban was forced by the U.S. Supreme Court’s unanimous decision in Caetano v. Massachusetts (2016), which vacated the conviction of a woman who carried a stun gun for self-defense.

Also mentioned in written testimony by state Attorney General Clare Connors is the case of Andrew Namiki Roberts, who filed a federal lawsuit against former Honolulu Police Chief Susan Ballard and others for denying him a stun gun to defend himself, his daughter, home and business. That case is still active.

The new law makes it illegal for a person to use an electric gun except for self-defense, defense of another person, and protection of property.

The Center for American Progress, an anti-gun thinktank opposed to self-defense on campus, now says it has a new way to stop the spread of freedom: send in the feds.

In a report released last summer, the group cites two incidents (seven years and 1,700 miles apart), and “research” from the radically anti-gun group Giffords, to allege dire consequences if the campus-carry movement continues to win. “To prevent shootings on college campuses, Congress should ban carrying guns at higher education institutions, like it already does on K-12 school grounds,” the report announces.

“The inability to carry firearms on Corps land is inconsistent with regulations governing public, federally-owned lands, and a violation of the intent of the Second Amendment” said Senator Crapo. “Enabling Americans to carry firearms on land managed by the Corps will allow law-abiding citizens to protect themselves and provide needed consistency across federal lands to reduce the complexity of tracking where one federal agency’s land management ends and another’s begins.”
 

Guam: Barbershop Owner Forced to Shoot Early Morning Intruder

The Guam Police department is investigating a shooting of an intruder at a barbershop in Dededo by the owner who lives behind the shop.

The owner, David Cadaviz, and his wife were sleeping until they were woken up around 4:30 A.M. by glass shattering. The light in front of the shop was also broken.

“I heard this big boom, and I checked for someone inside, then I heard someone going through the cash register,” Cadaviz said via The Guam Daily Post.

Cadaviz obtained a gun and confronted the intruder who was making his way to their area.

On Tuesday, Oct. 5, 2021, the Senate Veterans and Public Safety Committee passed SB 185, sponsored by Senator Tim Schaffer, on a 5-2 vote.

Along with its companion, House Bill 325, sponsored by Representative Scott Wiggam, Senate Bill 185 seeks to prevent state and local governments from infringing on Second Amendment rights during declared emergencies. It is the most powerful and comprehensive emergency powers bill of its kind in the United States.

The NRA this past weekend promoted two top directors who have a history of making vile racist comments, spreading conspiracy theories, and enabling years of alleged fraud and wrongdoing by embattled leader Wayne LaPierre—who, among other things, has been accused of spending NRA funds on private jets for himself and his family, accepting free African safaris and yacht vacations without reporting them, and handing out no-show contracts to confidants.

At the same time LaPierre was handed a new term, attorney Charles Cotton and Willes Lee, a retired U.S. Army lieutenant colonel, were elevated to president and first vice-president of the struggling gun-rights organization.

In July, a conservative commentator wrote that we should be happy that the Supreme Court is less bad now than at any time during the last 50 years. Another view is that we live in the present, thus should support the court when it rules correctly and oppose it when it rules incorrectly or refuses to rule out of fear of Democrats’ court-packing and term-limit threats, or because no one on the court is comfortable with Americans being armed to the extent the Framers intended.

Republican lawmakers are introducing a package of bills that would open sandhill crane hunting in Wisconsin and allow residents to carry concealed firearms without licenses.

The package of 13 draft bills, dubbed the Wisconsin Sporting Freedom Package, was released Wednesday in conjunction with Hunter Nation, a Kansas-based hunting group, which is also suing the state over the ability to hunt wolves.

The bills range in topics from adding more pheasants and brook trout, to simplifying turkey hunting seasons, to reducing Department of Natural Resources regulations.

Viral video footage of a seven-year-old girl firing off two guns simultaneously has sparked an online debate over gun safety and Second Amendment rights.

In a clip posted to Twitter by LiVe2DaNceATL, a child by the name of Autumn Fry can be seen unloading two pistols, one in each hand, at an off-screen target.

Autumn Fry, who is wearing protective headphones and glasses in the video, then stops to check if one of the guns is empty before throwing it to the ground.

She then continues to fire off the remaining weapon until it too runs out of bullets. Once the firing has finished, she turns to the camera and smiles.

That’s the case with Smith & Wesson Brands, Inc., which recently announced it will move its headquarters and a large portion of their manufacturing from Springfield, Mass., to Marysville, Tenn. The Dallas County Supervisors unanimously approved a resolution Tuesday that declared the county a Second Amendment “sanctuary” and promised to oppose efforts to “infringe upon” the “natural right of the people” to “keep and bear arms.”

The language of the resolution, which was proposed to the board by John Strathman of Adel, was drawn from an Iowa Firearms Coalition (IFC) template and mirrors resolutions approved in 20 other Iowa counties.

The Second Amendment Foundation and two California gun rights groups have filed a federal lawsuit challenging the state’s restrictive regulatory scheme covering the sale of firearms and ammunition as it applies to gun show operations in the state.

Joining SAF are the California Rifle & Pistol Association, Inc., South Bay Rod and Gun Club, Inc., B&L Productions, Inc./Crossroads of the West, Captain Jon’s Lockers, LLC; L.A.X. Firing Range, Inc./LAX Ammo and six private citizens.

The Board approved to raise their court attorney fees from $63 to $66, along with approving a resolution to be a second amendment sanctuary county and ensure that Guthrie County is protected from infringement on the constitutional right to bear arms. The Board also appointed seven members to the temporary redistricting commission.

In the continuing trend for gun sales measured by the National Instant background Check System, (NICS), September 2020 was the second-highest in the history of NICS, coming in behind last years record number of about 1.61 million. September of 2021 had about 1.31 million gun sales recorded.

In 2019 the gun sales were less than a million, about 974 thousand guns were sold in September.

The number of gun sales traditionally picks up in September as hunting seasons are opening and approaching. This probably accounts for the converging numbers of handgun and long gun sales.
