NV: NLVPD investigating fatal shooting at apartment complex as self defense

North Las Vegas police are investigating a homicide near East Carey Avenue and N. 5th Street Wednesday morning.

About 8 a.m., authorities received a call about a man in his 30s shot multiple times at an apartment complex in the 1000 block of East Carey Avenue, near North 5th Street.

"A man who was identified as the shooter was detained and questioned by detectives. At this point, the event is being investigated as a 'self defense' shooting, but the investigation is still ongoing," according to NLVPD Officer Alexander Cuevas.

A federal appeals court ruled Tuesday it is unconstitutional to prevent adults under 21 from buying a handgun.

The case is titled Hirschfeld v. ATF. Tanner Hirschfeld is a University of Virginia alum and a plaintiff.

“We’ve decided with the courts that once you have reached the age of 18, your Constitutional rights vest, so I was happy that the court ended up finding that,” Hirschfeld said.

The court changed the law so that 18-to-20 year olds secure the right to purchase a handgun. The law formerly only allowed those 21 and up to purchase one, but Hirschfeld saw this as age discrimination. He just got the court to agree with him.

On Tuesday, July 13, 2021, the United States Court of Appeals for the Fourth Circuit ruled that 18, 19, and 20-year-olds share Second Amendment rights with every other U.S. adult and should have the ability to legally purchase handguns.

You can read the full decision in Hirschfeld v. Bureau of Alcohol, Tobacco, Firearms & Explosives.

The case involved Tanner Hirschfeld and Natalia Marshall, both of whom wanted to buy handguns for self-defense but were prevented from doing so by federal law because they were "under age."

So along with Everytown Law, a New York nonprofit dedicated to aiding gun control cases, the city is now suing Westforth Sports, alleging that the store knowingly sells guns to individuals who intend to resell them just across the state line in Chicago.

Chicago isn’t the first city to sue a gun dealer, but if the lawsuit is successful, it would be the first in recent history to win such a case.

The Jasper County Board of Supervisors has unanimously passed a resolution declaring rural and unincorporated areas of the county a “Second Amendment Sanctuary.”

It bars city or county employees in Jasper County from enforcing state or federal mandates that infringe on gun rights in those areas.

Jasper County Board of Supervisors Chairman Doug Cupples says the resolution changes nothing now and would only kick in if state or federal gun restrictions go into effect. “What we are saying is that if the state or federal government is going to enforce those laws, they are the ones that are going to have to come enforce them,” he says.

The State of Iowa has two Second Amendment sanctuary counties as of Wednesday morning.

On Wednesday morning, the three-member Hardin County Board of Supervisors' unanimously approved agenda item number 9, a "Resolution Declaring Hardin County A Second Amendment Sanctuary County."

The resolution came just a day after Jasper County voted to become the state's first Second Amendment sanctuary county.

Republican supervisors in Jasper County unanimously approved a resolution Tuesday and Republican supervisors in Hardin County did the same Wednesday, becoming the first Iowa counties to implement such measures.

Elsewhere in the U.S., at least 1,200 local governments have declared themselves sanctuaries insulated from state and federal gun laws since 2018, when high-profile mass shootings prompted calls for stronger regulations. An ordinance passed in Columbia County, Oregon, last year is the first to face a legal challenge over whether it can be enforced.

Yesterday, a Federal Appeals Court ruled that Federal Regulators setting a minimum age of 21 years old for purchasing handguns from licensed dealers violates the Second Amendment. The restriction was deemed unconstitutional by a three judge panel of the 4th U.S. Circuit Court of Appeals and the majority opinion written by Judge Julius Richardson says 18-to-20 year olds have second amendment rights.

Former President Donald Trump (R) delivered stirring remarks about your Second Amendment rights at the Conservative Political Action Conference (CPAC) in Dallas this past week.

“The same far-left Democrats who are defunding police are also leading an all-out crusade to strip you, the law-abiding citizens of America, of your God-given Second Amendment rights,” said Trump. He went on to add that we “must never waver in demanding that the right to keep and bear arms shall not be infringed.”

Lewis County’s new “Citizens’ Rights” proclamation, passed Tuesday, is more subdued than the “Second Amendment sanctuary” vision sketched out by some law enforcement officials and locals.

When asked whether the proclamation made Lewis County a “Second Amendment sanctuary,” commissioners danced around the question.

“We took our oath to uphold the constitution of the United States of America and the state of Washington, and so if you want to label that as a sanctuary county, sure by all means,” Swope said. He later added, “the terminology is semantics.”

An Oklahoma State Senator has introduced a bill to reduce the age one can carry a handgun without a permit (constitutional carry) from 21 to 18 years of age.

“The people have a constitutionally protected right to keep and bear arms. Just as they have the right to vote starting at 18, they should not have to wait until turning 21 to exercise their right to self-defense,” said Senator Nathan Dahm.

At the urging of gun control activists, Lego sent the company a cease and desist letter, demanding it stop producing the Block19.

Culper Precision’s president, Brandon Scott, told the Washington Post a lawyer told him Lego might have a case if he kept offering the Block19. He decided to comply.

“They had a similar reaction to you,” he said. “Where it was like: ‘Is it wise to make a gun look like a toy?’”

Josh Marshall, founder of the liberal news site Talking Points Memo, claimed on Tuesday the right to own guns is "made up" by pro-Second Amendment activists.

"Just to remind everyone, the individual right to own and use firearms is completely made up and the product of NRA funded activism," Marshall wrote.

Cape Town arms and ammunition shops have seen an influx of patrons who want to protect themselves, in case the looting that started in KwaZulu Natal and Gauteng comes to the Cape.

Parow Arms & Ammo owner Thomas Serreira said they have seen an increase in demand for some of the products they are selling.

He said customers coming in his shop are not necessarily buying guns, because most of them own them already, but most are coming in for ammunition.

Brayman said his client is licensed to have the guns and was merely possessing his Second Amendment rights. They suggested the weapons made Casteel feel safer in a crime-ridden city.

“The fact that good people feel the need to arm themselves when traveling to Chicago is the real problem that our public officials need to address,” he said. “In Mr. Casteel’s case, there was nothing nefarious afoot.”

Brayman suggested that both the mayor and the superintendent purposely sensationalized the arrest to draw attention from the city’s rising violence.

Efforts in Newton to ban gun stores from the city hit a roadblock Monday after the City Council turned down proposed zoning changes to prohibit firearms retailers. But the debate over the issue will continue as councilors are expected to take up a separate ban measure in the fall.

While there is widespread opposition among the city’s elected leaders against firearms businesses, debate has swirled around whether an outright ban would invite a court challenge under the Second Amendment.

Several key Senate Democratic senators have remained undecided on support for President Biden’s pro-gun control nominee for Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), David Chipman.

The Hill is reporting that Democrats would likely need all 50 members of their caucus to vote in favor of Chipman in order to overcome the lack of support from Republicans.

But, they say, four of those senators – Joe Manchin (D-WV), Jon Tester (D-MT), Kyrsten Sinema (D-AZ), and Independent Angus King (ME) – have not committed to Chipman’s confirmation as of yet.

Chipman has made radical comments about the Second Amendment.

Lawmakers have to vote on whether they want to hold a veto override session this month but the fight to victory may not be as easy as some Republicans may hope.

Legislators have until midnight on Thursday, July 15, to submit their ballots or not. The problem for Republicans won’t be the simple majority needed to hold the session. Instead, they may have some trouble getting the supermajority needed to overturn any veto.

It would be the first veto override session held since the new Louisiana Constitution was ratified in 1974. The session could be triggered if a simple majority in both chambers call for it, something Republicans are almost certain will happen.
