A Cleveland Heights woman has been criminally charged after telling investigators that her husband attacked her, and the case now sits on the hardest version of a self-defense question: what happens when the person you had to defend yourself against is the person you married.

The charge and her account of the attack were reported by cleveland.com, which framed the case as “Self defense or murder?” No police release, charging document or court filing was available, so the public record at this point is her account as described in that report.

The petition’s author highlights that during military service, the state entrusts service personnel with combat weapons, including automatic rifles, machine guns, and grenade launchers. Military personnel undergo appropriate training, are responsible for these weapons, and gain practical experience in handling them.

However, after completing their service, even confirmed combat experience does not provide veterans with a distinct, legislatively guaranteed mechanism to obtain short-barrelled firearms for self-defence.

The investigating court of Santa Coloma de Farners has dismissed the case for the death of a 45-year-old man in Sils on April 28, 2019, concluding that the investigated person acted in self-defense.

The decision closes a case that had been open for more than seven years regarding a death that occurred in broad daylight in the bar of the Sils train station, but the resolution maintains that the single stab wound that caused death was a proportionate reaction to an imminent attack inside the premises.

Jerónimo Gómez, the prosecutor in the case, requested the dismissal, considering that there was a complete exemption for self-defense.

A federal judge in Texas this week found the Biden-era ATF’s "Frame or Receiver" Rule unconstitutional on both Second Amendment and due process grounds.

In the case of Defense Distributed v. Blanche (No. 4:22-cv-00691-O, formerly VanDerStok v. Bondi), the court found that ATF violated its mandate by expanding the definition of a "firearm" to include some kits such as partial "80 percent" frames and receivers.

U.S. District Judge Reed O'Connor found there were no historical texts or traditions that banned self-manufactured firearms, and that the Justice Department over-stepped in its Final Rule, which took effect in August 2022.

The Justice Department finalized a rule Monday that will pave the way for people who've been barred from owning firearms because of criminal convictions to apply to have their gun rights reinstated.

The process launched by newly confirmed Attorney General Todd Blanche is a victory for Second Amendment advocates, who have long pushed for nonviolent people with felony convictions to be given a pathway to regain their legal right to own firearms.

“This rule was such a mess that it not only violated the Second Amendment but was so terribly drafted that it managed to be ruled unconstitutionally vague,” said SAF Executive Director Adam Kraut. “The Court rightly held that the Biden ATF’s rule not only sought to outright prohibit Second Amendment protected conduct but was written in such a vague and vaporous manner as to chill that protected conduct by making it impossible to even know what was legal and what wasn’t.”

As the judge stated in the opinion, “The decision of when a hunk of metal or plastic ‘may readily be completed, assembled, restored, or otherwise converted to function as a frame or receiver’ is left to the subjective determination of the ATF...”

Can the federal government impose firearm regulations on an incomplete hunk of metal? One federal judge says no.

In 2022, the Biden administration's Bureau of Alcohol, Tobacco, Firearms and Explosives issued final rules entitled Definition of “Frame or Receiver” and Identification of Firearms. A federal judge for the Northern District of Texas said Tuesday, what the ATF regulates as a firearm changed 45 years of precedent to include partially manufactured frames and receivers as “firearms.”

The countdown has begun in Louisiana. Very soon we'll see the annual parade of camouflage as dove season is set to begin across the state on Saturday, September 5.

That's also the time we will see the annual Louisiana Second Amendment Weekend Sales Tax Holiday, which will begin on Friday, September 4 and continue through Sunday, September 6.

A federal court Tuesday blocked a rule issued by the Biden administration targeting so-called “ghost guns” on constitutional grounds.

Chief United States District Judge Reed O’Connor of the Northern District of Texas, a George W. Bush appointee, issued the ruling Tuesday in favor of Defense Distributed, accepting arguments that the “frame or receiver rule” enacted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) was unconstitutional on both Fifth Amendment and Second Amendment grounds. In the opinion, O’Connor said the rule deprived people seeking to manufacture their own firearms of due process and also unconstitutionally prohibited people from acquiring the means to manufacture firearms on their own.

The FBI’s new crime report is out, and it’s safe to say that those who listened to the predictions of anti-Second Amendment groups are wondering where the crime is.

Since the Supreme Court struck down New York’s discretionary system for issuing concealed carry permits in June 2022, groups like Everytown, Giffords and Brady United predicted public safety would be diminished by the decision. However, the FBI’s data noted that in 2025, the murder rate went down 18.1%, while violent crime fell by over 9%.

A federal judge in Texas has struck down the Biden-era “ghost gun” rule — also known as the frame and receiver rule — leaving gun-ban advocates reeling after yet another devastating court loss.

On August 18, Chief U.S. District Judge Reed O’Connor of the Northern District of Texas, Fort Worth Division, ruled the frame and receiver rule unconstitutional on two separate grounds: it violates the Second Amendment, and it’s too vague to satisfy the Fifth Amendment’s due process protections.

The Second Amendment Foundation, a plaintiff in the case Defense Distributed v. Blanche, announced the victory in a Facebook post proclaiming yet another win over unconstitutional gun laws.

At the start of the meeting four people spoke in public comments about the same topic: Danny Taylor demonstrating his Second Amendment rights on F Street on Sundays.

Two of them were business owners who said his gun-toting presence is intimidating would-be shoppers from the downtown area.

...

“I know I’m going to catch two kinds of hell for this, but I think we need to look into options like making downtown a gun-free zone. Or other alternatives to create public safety and economic vitality.”

She reminded her fellow council members that the city is funded by sales tax, and Taylor’s display is “detrimental to business and tourism more than we realize.”

The Department of Justice (DOJ) has finalized a way for people convicted of certain, nonviolent felonies to restore their gun rights, Attorney General Todd Blanche announced Monday.

It’s a move that will placate gun rights advocates who’ve been at odds with the administration over its continued defense of federal firearm restrictions.

“The Second Amendment is not a second-class right, and the federal government should not permanently deprive Americans of a constitutional right without regard to whether they pose a danger to public safety,” Blanche said in a statement.

A Colorado prosecutor on Monday asked a judge to once again dismiss him as a party to a suit against the state’s tax on firearms, weeks after a previous motion was denied.

Colorado voters approved the tax via Proposition KK, which imposed the 6.5% duty on firearms, firearm parts and ammunition in the November 2024 election, prompting pro-Second Amendment groups, including the National Rifle Association (NRA), the Colorado State Shooters Association (CSSA), Second Amendment Foundation (SAF) and the Firearms Policy Coalition (FPC) to file suit in March 2025 to block the measure from taking effect. In the court documents filed Monday, El Paso County District Attorney Michael Allen argued many of the suit’s arguments didn’t apply to him.

Defense Distributed and the Second Amendment Foundation (SAF) won a significant victory in court by successfully challenging the frames-and-receivers rule as applied to the named plaintiff.

This is the latest ruling in the long-running challenge to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) April 2022 Final Rule, titled “Definition of ‘Frame or Receiver’ and Identification of Firearms.” The Rule expanded the definition of “frame or receiver” to include partially complete, disassembled, or nonfunctional frames and receivers, as well as certain parts kits that “may readily be completed.” It also allowed the ATF to consider extrinsic items such as jigs, templates, and marketing materials when classifying them.

A federal judge denied a motion by attorneys representing the Virgin Islands Tuesday, questioning their knowledge of basic court procedure.

United States District Judge Evan Rikhye of the District of the Virgin Islands, a Trump appointee, rejected a “motion to strike” from the territorial government filed on July 22, the day the territory’s attorneys were supposed to file a brief regarding a newly-enacted gun control law. In an opinion that came with the order, Rikhye tore into the territory’s attorneys for missing another filing deadline, the latest rebuke since Assistant Attorney General for Civil Rights Harmeet Dhillon sued the territory in December.

For nearly a century, the National Firearms Act of 1934 (NFA) has stood between law-abiding Americans and the right to keep and bear arms. In order to purchase suppressors and short-barreled firearms, Americans have been forced to comply with federal registration, application, fingerprinting, and photograph regulations, as well as a $200 tax-stamp requirement. These unconstitutional restrictions suffered a historic setback in August because of a lawsuit brought by Gun Owners of America (GOA), Gun Owners Foundation, Silencer Shop, a coalition of manufacturers and individuals, and 15 states.

Turner’s Outdoorsman on Mohawk Street in Bakersfield, California, sits on a busy intersection across from an oil drilling site. Over the past three years, this sporting goods store sold more than 16,000 firearms — and also appeared hundreds of times during criminal investigations as the source of guns found at crime scenes.

In Bakersfield alone, law enforcement traced 83 guns to the store from 2023 to 2025, according to newly released data from the California Department of Justice. That was the highest number for a store with an active firearms dealer license in any of the state’s 10 most populous cities.

The proposal restricts those under temporary restraining orders from purchasing or possessing a firearm and extends protections to domestic violence survivors who have been abused by their dating partners, the group said in a statement.

“This legislation closes a gaping loophole — to save lives when current law leaves domestic abuse victims most vulnerable to violent partners with guns,” said Blumenthal. “The link between domestic violence and guns is deadly. The Lori Jackson-Nicolette Elias Domestic Violence Survivor Protection Act would prevent the purchase and possession of a firearm by someone who is subject to a temporary restraining order — protecting survivors of domestic violence when courts recognize the danger.”
