It doesn’t grant a right.” The exchange was later highlighted in a video published by Colion Noir.
The Constitution, in Thomas’s telling, created the federal government. It didn’t create the individual rights that government exists to protect. Those rights came first. The government came after, and it received its authority from the people who already held those rights. |

A Barbour County judge dismissed a murder charge and a charge of discharging a firearm against 21-year-old Devin Brooks on Monday, ruling Brooks acted in self-defense under Alabama’s Stand Your Ground law.
Brooks was charged with the June 2024 murder of 16-year-old Davion Green.
Alabama’s Stand Your Ground law allows people to use deadly force if they are in a situation that causes them to fear for their own life.
The judge determined through evidence and testimony that Green was there to kill Brooks the day Green died, according to News Leader 9. |

Court records show Alston was also charged with a felony count of aggravated assault and a misdemeanor count of simple assault after allegedly throwing what is believed to be a soup can at Madonna, hitting Madonna in the head before the shooting.
Police said in the criminal complaint that officers found Alston, who gave them a description of Madonna and said he hit Madonna in the face multiple times, in Lancaster before being taken to the hospital. |

At the first step, courts ask whether the Second Amendment’s “plain text” covers the conduct regulated by the challenged law. As the court clarified in the case of Wolford v. Lopez, decided this term, this is a simple and straightforward linguistic inquiry. The key terms are “people,” “Arms,” and “keep and bear.” A law implicates the plain text of those terms if it “appl[ies] to the people,” “concern[s] any form of Arms,” and “place[s] any restrictions on either the … possession … or the … carrying … of arms.” In other words, it is a simple question of whether the law in question regulates conduct that falls within the plain-text meaning of the terms used in the Second Amendment. |

The National Shooting Sports Foundation (NSSF), the firearm industry trade association, released its 2026 Congressional Report Card this week grading lawmakers on their records on Second Amendment and firearm industry issues.

Firearms Policy Coalition (FPC) announced today that it filed a petition for writ of certiorari with the United States Supreme Court in Christian v. James, asking the Court to strike down New York's sweeping ban on peaceable firearm carry in public parks and resolve major conflicts among lower courts over how the Second Amendment must be applied.
New York criminalizes firearm possession in public parks across the State, from major urban parks to bike trails, wooded recreation areas, and remote state forests. FPC's petition argues that there is no Founding-era historical tradition supporting such a categorical prohibition. |

Prosecutors with the Adams County District Attorney’s Office will not file charges against an 18-year-old arrested on suspicion of fatally shooting a 33-year-old man in Brighton on Sunday, the agency officials said this week.
Jeness Torres was arrested on suspicion of second-degree murder after Brighton police responded to a shooting in the 3100 block of Eagle Boulevard at around 12:30 a.m. and found a man who had been shot. ...
“After a thorough examination of the evidence, our office determined that the facts do not support the filing of criminal charges, as we cannot disprove self-defense or defense of others in this incident,” the district attorney’s office said in a news release. |

Second Amendment Foundation (SAF) attorney and Director of Legal Research and Education Konstadinos T. Moros has published his second law review article today, arguing that special taxes targeting common firearms and ammunition violate the Second Amendment.
The paper, Excising the Second Amendment: Why Taxes Targeting Common Firearms Are Unconstitutional, applies the historical test required by New York State Rifle & Pistol Association v. Bruen. It concludes that excise taxes singling out firearms, ammunition and related items – rather than applying generally to all goods – have no well-established analogue in the nation's tradition of firearm regulation and are therefore unconstitutional. |

Knife Rights submitted a request for an extension of the filing deadline in our appeal of the Ninth Circuit's absurd panel ruling and denial of en banc review in our case challenging California's switchblade ban under the Second Amendment. A cert petition is the formal request asking SCOTUS to review that ruling and denial. On September 11th Justice Kagan granted our request, and the cert petition is now due December 14th. |

The challengers filed their opening merits brief on August 28. They argue that AR-15s are “arms” under the Second Amendment’s plain text, are commonly possessed by law-abiding Americans, and cannot be supported by any historical tradition of banning an entire class of ordinary rifles.
