New Mexicans can’t use machine guns for self-defense, the 10th U.S. Circuit Court of Appeals ruled Tuesday.
The appeals court made the ruling based on a case out of Kansas. New Mexico is in the court’s jurisdiction, meaning the decision affects our state.
A man argued possessing a machine gun should be protected under the Second Amendment. The court rejected his petition, stating machine guns are not commonly used for self-defense and are not protected by the Second Amendment. |

The Santa Barbara County District Attorney’s Office on Wednesday announced amended charges in the fatal stabbing on State Street during Fiesta weekend, including the complete dismissal of all charges against suspect Juan Fernando Rios in connection with the stabbing.
The stabbing occurred after a fight broke out on the 500 block of State Street on August 1 and produced three victims, including one who lost his life, Anthony Bisquera-Hartley, a 30-year-old father of three. Three men were arrested and charged in connection with the incident soon after. |

A federal appeals court has upheld an Illinois law banning concealed firearms on public transit, finding it does not violate the Second Amendment.
A panel of the 7th Circuit Court of Appeals overturned a ruling last year from a federal judge in Rockford, who had declared the law unconstitutional. That ruling had applied only to four gun owners who had sued over the law, and so the ban had remained in effect for everyone else. |

The Multnomah County District Attorney's Office decided not to press charges against Eric Salisbury, a security guard involved in a fatal shooting outside a Portland Jewish preschool, ruling the act as self-defense.
Melissa Garza, the sister of the man who was shot, expressed her family's frustration with the decision not to charge Salisbury. "At the end of the day, this is my brother who was 32 years old. He has parents and siblings who love him," she said. "It's completely unfair, completely biased." |

In a mashup of left- and right-wing hot-button priorities, the First Circuit heard oral arguments on Wednesday over whether the Second Amendment protects the right of people in the country illegally to own guns.
A three-judge panel didn’t tip its hand, although it seemed somewhat skeptical of the Trump administration’s position that the government can completely disarm people without legal status.

Hunters and competitive shooters will get a break on a variety of purchases this weekend during the Second Amendment Weekend Sales Tax Holiday, which runs Friday through Sunday.
Items that qualify for a break on sales taxes are firearms, ammunition and specified hunting supplies, including archery items, hunting apparel and certain types of knives, according to the Louisiana Department of Revenue (see all exemptions). Binoculars, hearing protection, range finders, decoys, hunting stands and blinds also qualify. |

The Douglas County District Attorney’s Office on Tuesday said it will not be pressing charges against a driver accused of fatally shooting a man during a planned gun sale in late January.
Family members had questioned why the shooter was not formally charged after the Jan. 29 killing of 20-year-old Malachi Mitchell. Prosecutors said law enforcement found the driver covered in blood, with Mitchell dead in the passenger seat from several gunshot wounds. |

A viral video showing a man confronting and fatally shooting a bear inside his home has sparked widespread interest online. The incident occurred in the early morning hours when the homeowner, now widely referred to as “The Bear Guy,” encountered a black bear in his kitchen.
The homeowner, armed with a suppressed 11.5-inch Geissele Super Duty AR-15 chambered in 5.56, descended the stairs after suspecting something was amiss. As he entered the kitchen, the bear charged. A judge has dismissed all claims filed against Los Angeles County and a sheriff’s deputy that were filed by the mother of an 18-year-old man who alleged he was unjustifiably shot and killed during a 2019 traffic stop in East Los Angeles.
Plaintiff Leah Garcia had also alleged that her son, Paul Rea, feared that the deputies were part of an internal gang. On Tuesday, Los Angeles Superior Court Judge Rolf M. Treu found that there were no triable issues in Garcia’s case against the county and Deputy Hector Saavedra-Soto. One of Garcia’s daughters, Jaylene Rea, also was a plaintiff. |

In an amazing turn of events, the Department of Justice (DOJ) Civil Rights Division is asking to take part in oral arguments against Illinois’s Protect Illinois Communities Act (PICA) at the United States Court of Appeals for the Seventh Circuit.
PICA is a so-called “assault weapons” ban law with restrictions on the allowed capacity of firearm magazines that went into effect in 2023. The law prohibits almost all semi-automatic rifles with certain cosmetic features, including the most popular long gun in the United States, the AR-15. Following the law’s passage, various lawsuits emerged across the state. These various lawsuits got consolidated under Barnett v. Raoul. |

York Regional Police Chief Jim MacSween told residents not to take justice into their own hands when confronted by criminals, saying, “The best defence is to comply.” His comments come as Premier Doug Ford and Conservative Leader Pierre Poilievre demand reforms to Canada’s self-defense laws. “The premier can make his own statement and his own mind up about that. A three-judge panel from the United States Court of Appeals for the Seventh Circuit has upheld an Illinois law that bans the carrying of loaded firearms on public transportation.
Following the Supreme Court’s Bruen decision, Illinois enacted the Firearms Concealed Carry Act (FCCA), which permits its residents to obtain a license to carry a concealed firearm in public. The law enumerates places where citizens are prohibited from carrying a gun, even with a concealed carry license. One of the areas highlighted by the law is public transportation. |

Louisiana's only sales tax holiday celebrates the Second Amendment by promoting gun ownership Sept. 5 through Sept. 7 with a tax break for consumers and a sales spike for retailers.
The Second Amendment Sales Tax Holiday suspends both local and state taxes for firearms, ammunition and hunting supplies Friday, Sept. 5, Saturday, Sept. 6 and Sunday, Sept. 7.
Most consumers will save 10% percent or more depending on local sales tax rates. |

The Second Amendment Foundation (SAF) has filed its opening brief with the Third Circuit in its case challenging the federal ban on gun ownership by medical marijuana users.
Greene v. Bondi is now on appeal before the Third Circuit from a district court opinion dismissing the suit. SAF is joined in the case by two private citizens – Warren County, Pa., District Attorney Robert Greene and James Irey. Greene currently possesses a medical marijuana ID card (MMID) under Pennsylvania law and desires to possess firearms and ammunition. Irey is a disabled veteran who wishes to obtain a MMID to treat his service-related injuries but not forfeit his Second Amendment rights in the process. |

Melynda Vincent, a Utah social worker specializing in drug harm reduction, was convicted of bank fraud in 2008 because she paid for groceries with a bad check. Seventeen years later, Vincent is still not allowed to own a gun or even temporarily possess one.
A new Justice Department program aims to help people like Vincent by reviving a moribund relief process for Americans who have lost their gun rights due to criminal convictions. That is good news for Second Amendment advocates, because it promises to ameliorate the impact of an illogical, constitutionally dubious law that deprives people of the right to armed self-defense even when they pose no plausible threat to public safety. |

The U.S. Court of Appeals for the Eighth Circuit upheld the lifetime firearms restriction for an Iowa City man, convicted in a 1991 gang affiliated shooting, after his lawsuit against the Governor and Johnson County sheriff failed.
Anthony Arthur Browne, 54, was convicted in 1991 of willful injury causing serious injury and criminal gang participation, both felonies. He was sentenced to 10 years in prison and was discharged from the Iowa State Penitentiary in Fort Madison in 1998.
Iowa law forbids anyone convicted of a forcible felony from possessing firearms. |
