ME: Auburn Man's Acquittal in Shooting Death is Rare Example of a Successful Claim of Self-defense

Wednesday's acquittal of Gage Dalphonse in a 2019 shooting death at the Auburn Walmart was just the second time in more than two years that a jury has found a defendant not guilty of both murder and manslaughter. It's rare for Maine juries to hand up "not guilty" verdicts in murder trials. What's even rarer is what happened Wednesday: A jury concluded a defendant who claimed he was acting in self-defense was guilty of neither murder nor manslaughter. More often than not in that circumstance, a jury that finds a defendant not guilty of murder finds him guilty of a lesser manslaughter charge.

Texas is one of the most populated states in the US, and more than 1 million of its people are active holders of hand and long guns. The state’s gun regulations usually focus on controlling gun-carrying rather than prohibiting gun ownership. The Texas constitution grants every Texan the freedom to “keep and carry weapons mostly in the legal defense of himself or the State.” But, it also provides the government the authority to “regulate the wearing of arms” to avoid harm. This means that people can legally keep and carry a firearm in their houses or public, but with strict restrictions and only if the government has lawfully approved the owner.

Declaring Michigan suffers from a leadership void, retired Detroit Police Chief James Craig, who raised eyebrows when he said seven years ago one solution to growing crime is more armed citizens, has jumped into the campaign to replace Gov. Gretchen Whitmer.

He may have some horsepower, because gun owners in the Great Lakes State know this fellow isn’t just a flash in the pan on gun rights. He’s been saying the same thing for years, that the problem with violent crime is criminals, not guns.

In our previous data study on the initial effects of the pandenmic on our business, we outlined increased sales due to the public’s growing leeriness of COVID-19, starting from February 23, 2020 when the news coverage became ominous.

That's only part of the story, however, because over the last 18 months, we've experienced a particularly charged election year, BLM protests amid calls to "defund the police," a contentious transfer of power, and most recently a surprise ban on popular Russian ammo.

Beto O’Rourke (D), the guy President Joe Biden (D) once said would help him “take care of the gun problem,” is reportedly seriously eyeing a run for the governorship in his home state of Texas. You remember Beto, right? Surely, you must. He’s that former congressman from Texas who, in his rather bold attempt to run for the office Biden currently occupies, said, “Hell, yes, we’re going to take your AR-15” during a primary debate.

Like the many gun safety bills that have come before it, the one just signed by Gov. Gavin Newsom is borne from tragedy. In 2019, John T. Earnest, a then-19-year-old Rancho Peñasquitos college student, opened fire on a Poway synagogue using a rifle he bought at a Grantville gun shop.

A man in a Natchez, Miss., Walmart became irate over a self-checkout machine “shorting him” 21 cents on July 3. A witness tried to de-escalate the situation by offering to reimburse the irate man the amount he believed he was shorted. The two men and a woman accompanying the complaining individual walked out together. But then, according to witnesses, the angry man drew a knife and threatened the man who’d offered to reimburse him, who then showed his firearm in response.

The Heckler & Koch P7, which initially fell under the company’s PSP (Police Service Pistol) designation, is unusual in design, function and even manual of arms. Its squeeze-cocking mechanism sets it apart from virtually every other semi-automatic pistol, and the finger-grooved cocking bar on the grip’s gives the handgun a distinct profile.

A little-known unlicensed Walther PP with a bona fide Cold War pedigree, the Zella Mehlis P1001-0 hailed from East Germany and are tougher to find over here than the Berlin Wall. Carl Walther's famed firearms works were founded in the Thuringian town of Zella-Mehlis in 1886. However, by 1945, with the Soviets knocking on the door at the end of World War II, Walther pulled stumps and left what would later become East Germany (officially the Deutsche Demokratische Republik, or DDR) for the more easy-going West Germany on the other side of the Cold War.
