"District Judge Reggie B. Walton last night dismissed a National Rifle Association (NRA)-backed lawsuit challenging the constitutionality on Second Amendment grounds of Washington, DC's ban on the sale and possession of handguns. Judge Walton's 68-page ruling in Seegars v. Ashcroft upholds the ban, which was adopted by the City Council in 1976."
"In his opinion, Judge Walton, who was appointed to the federal bench by President George W. Bush, wrote: '[T]he Court must conclude that the Second Amendment does not confer an individual right to possess firearms. Rather, the Amendment's objective is to ensure the vitality of state militias.' " ... |

"The constitutional right to bear arms doesn't apply to the District of Columbia's residents, a federal judge ruled yesterday in rejecting the claim of several city residents who contended that a 1976 city law banning the possession of guns left them unfairly vulnerable."
"U.S. District Judge Reggie B. Walton said he dismissed the lawsuit, led by taxicab commissioner and activist Sandra Seegars, after determining that the District was a 'uniquely designed governmental entity' and that the founders were not considering the city when they wrote the Constitution's Second Amendment allowing state militias to take up arms against the federal government."
------- If Washington DC is in America, US law applies to the citizens of that city. US law happens to be the Constitution.

WASHINGTON — "A federal judge on Wednesday upheld the District of Columbia's gun control law that prohibits ownership of handguns, rejecting a legal challenge by a group of citizens backed by the National Rifle Association (search)." "U.S. District Judge Reggie B. Walton [a G.W. Bush appointtee] dismissed the lawsuit in which the plaintiffs argued that the 28-year-old law violated their Second Amendment (search) right to own guns. The D.C. law prohibits ownership or possession of handguns and requires that others, such as shotguns, be kept unloaded, disassembled or equipped with trigger locks."

TUCSON - The leader of a citizens' border patrol group was found guilty of two misdemeanors for carrying a firearm while on national forest property.
U.S. District Court Magistrate Judge Nancy Fiora ruled Wednesday that Chris Simcox was guilty of knowingly entering the Coronado National Memorial with a weapon and giving false information to a law enforcement official.
Simcox was arrested in January 2003 amid allegations that he walked onto the property while carrying a firearm.
Simcox is founder of Civil Homeland Defense, a Tucson-based citizens border patrol group.
Simcox, who said he's not guilty because he was in an area that was not marked by any sign, will appeal the ruling.
Sentencing on the misdemeanors, which carry penalties ranging from probation to eight months behind bars, is scheduled for March 23. |

"Why would inhabitants of two large urban areas outlaw handguns, the best home-defense firearms? It can't be for tactical reasons." ...
"No, in both cases the laws banning handgun ownership are rooted in prejudice. Wilmette's gun-ban ordinance was enacted in 1989 after a deranged woman shot several children in a local school. "The ink is barely dry on the Supreme Court's devastating decision in McConnell v. FEC -- the so-called campaign finance case that GOA was involved in. That decision severely restricted broadcast communications, thus making it more difficult for GOA to hold legislators accountable on Second Amendment issues."
"Now, the IRS is already leaping forward to expand the Court's ruling to include GOA newsletters, e-mail alerts, and other Second Amendment communications."
"Put out for comment on December 23, 2003 -- when, presumably, no one would notice -- proposed IRS Revenue Ruling 2004-6 creates a broad new set of ambiguous standards which groups like GOA must follow in order to avoid losing all or part of their tax-exempt status."
"Under the proposed Revenue Ruling, the IRS would create a vague 'balancing test' to determine whether GOA communications would be 'permitted' by the government."
"If the communication occurred close to an election, mentioned an officeholder who was running for reelection, and was targeted to put pressure on congressmen through constituents in each representative's district, all of these factors would push toward outlawing the communication."
------- We knew it was only a matter of time before the government started using this nefarious legislation to limit gun rights. Now, if the petty tyrants want to foist some other odious legislation upon an unsuspecting populace, they can just ensure they do it close to election time. |
