Rep. Matt Gaetz (R) introduced legislation this week to abolish the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF).
------------
Submitter's note: I followed this closely in the last congress (sponsored last time by M.T. Greene and cosponsored by Gaetz who is sponsoring now, and two other heroes-Norman and Gosar), specifically trying to get more than the 3 measly cosponsors. To say it was ignored by almost every republican would be an understatement. I repeatedly tried, unsuccessfully, to get even gun restaurant owning Lauren Boehbert to cosponsor it. Keep publicizing the actual link to the bill, which strangely, Breitbart refuses to do: https://www.congress.gov/bill/118th-congress/house-bill/374/cosponsors? |

Firearms sales in Maine and across the country fell sharply for the second consecutive year in 2022, newly released federal data show. But with sales still higher than pre-pandemic records, industry members aren’t too concerned.
Gun dealers in Maine recorded over 114,000 sales last year, a 17% decrease from the pandemic high of more than 137,000. But the 2022 total was still the third-highest total since the FBI began compiling data on background checks in 1998. |

It doesn’t really make sense to ban guns, because in reality what that means is that you are actually trying to ban effective self-defense. Despite the constant hammering by a news media with an agenda, guns are used in America far more often to stop crime than to cause crime.
I’ve seen several different sets of numbers about how many times guns are used in self-defense every year. The problem with keeping track of this stat is that the vast majority of the time, when a gun is used in a legal self-defense situation, no shots are fired. The mere presence of the gun is enough to cause the criminal to stop. Notable firearms instructor Clint Smith had a saying: “If you look like food, you will be eaten.” |

The jurisprudence of the Second Amendment is: it was ratified to protect the existing right of the people to keep and bear arms. It did not create new rights. One reason to protect the right was to enable the creation of militias from the armed population.
It was well understood, at the time of ratification, the right to keep and bear arms included the right to do so for self-defense as well as community defense, for hunting, and included the ancillary rights to practice, buy, sell and make weapons, as well as ammunition and accessories for them. |

Crime happens anywhere and anytime. It was almost time to leave the office when an apartment manager at an upscale condominium complex defended her child. It is common for an apartment/condominium building to have some of its staff live in the complex. That means the staff is available to residents and apartment shoppers at all hours. The complex is their home. We don’t know where she lived, but this apartment manager, Shay Lindberg, had her young son with her at work at that moment. |

Senate Bill 805 prevents localities from passing their own restrictions on lawful carry, requires localities to sell any firearms they receive in so-called “gun buyback” events to licensed dealers, and prohibits localities from filing lawsuits against the firearm industry for lawful activities
Senate Bill 1236 prevents localities from passing their own restrictions on lawful carry.

A lawsuit aiming to block newly-passed gun limitations in Columbus has hit a new hurdle, as the judge overseeing the case disagreed with the state.
Attorney General Dave Yost, acting on behalf of the state, filed the lawsuit against the City of Columbus arguing that its new gun laws violate the Ohio Constitution. Passed on Dec. 5, the ordinance had three effects:
Bans civilians from having magazines that can hold 30 or more rounds Criminalizes selling guns to people prohibited from having them Gives penalties to people found storing firearms in a way that minors can get to them.

We won big, again!
“It is not a core municipal function to occupy an area that the Legislature has preempted, and local governments have no lawful discretion or authority to enact ordinances that violate state preemption,” – Florida Supreme Court Justice Ricky Polston
Florida public officials will continue to pay a steep price if they try to regulate firearms, according to an opinion of the Florida Supreme Court issued Thursday, which rejected attempts by former Agriculture Commissioner Nikki Fried and dozens of city and county officials who sought to remove the penalties from the state’s powerful preemption statute. |

The ISRA has joined forces with other gun rights advocates in filing a federal lawsuit challenging the state’s new ban on the sale and manufacture of semiautomatic weapons and high-capacity magazines.
It’s the latest legal challenge to the law, which went into effect upon Gov. J.B. Pritzker’s signature on Jan. 10, and the first filed in federal court.
The case, which will be heard in the Southern District of Illinois, was filed within a week of a similar case being filed in state court in Crawford County. Additionally, Thomas DeVore, a private attorney and unsuccessful candidate for attorney general in 2022, has filed suit in Effingham County and is seeking an emergency injunction to block the new law’s enforcement. |

When Illinois legislators passed a far-reaching ban last week on selling certain high-powered guns and high-capacity magazines, the Democrats who run the state celebrated it as a lifesaving law that would help prevent mass violence. But on Friday, in the law’s first judicial test, a state judge in Effingham County temporarily blocked it from being enforced against hundreds of people and several gun dealers who sued.
That ruling, a preliminary step and one of several legal tests the law is likely to face, came amid broad uncertainty about whether sweeping gun controls like those in Illinois can withstand judicial scrutiny following a Supreme Court decision in a New York case last year. |

An Effingham County judge ordered a temporary restraining order regarding the state's recently-passed assault-style weapons ban on Friday, securing a win for the moment at least for gun rights advocates.
Judge Joshua Morrison wrote in his 11-page decision announced just before 5 p.m. on Friday that the state did not "follow the procedural requirements" in passing House Bill 5471, also known as the Protect Illinois Communities Act. The order would only apply to the more than the 850 defendants in the case. |

Only by tightening our gun laws are we truly protecting the rights of responsible gun owners and strengthening the Second Amendment.
The State of Minnesota is in a unique position to undertake a leadership role concerning a crisis threatening the very fabric of our society: the epidemic of gun violence spreading throughout our rural and urban areas. Gun violence is now the leading cause of death for American youth. It has been more than 10 years since the Sandy Hook shooting, and schools are still a place of fear for our children. |

“My bill would abolish the ATF,” Gaetz said, acknowledging that his proposal has little chance of passage in the Democrat-controlled Senate and in the face of a potential presidential veto.
But Gaetz has a follow-on strategy.
“If that doesn’t work, we’re going to try defunding the ATF,” he explained, relying on the U.S. House’s so-called “power of the purse.”
“If that doesn’t work, we’re going to target the individual bureaucrats at the top of the ATF who have exceeded their authority in rulemaking.
“And, if that doesn’t work, we’re going to take a meat cleaver to the statutes that the ATF believes broadly authorize their actions.” |

New involuntary manslaughter charges filed against actor Alec Baldwin for the shooting death of cinematographer Halyna Hutchins have ignited a totally unlooked-for straw man debate that is currently trending on Twitter and other social media platforms. Although their cases are dissimilar in nearly every way save for the involvement of a firearm (and perhaps not even that), some are trying to draw comparisons between Kenosha shooter Kyle Rittenhouse and Baldwin — and plenty of other users are happily pouring kerosene on the blaze. |

Street-fighting weapons, such as brass knuckles and blackjacks, would be made legal in New Hampshire under a bill filed by Republicans at the State House.
The bill introduced Friday afternoon would lift the ban on brass knuckles, blackjacks and slungshots.
"There's no reason to have a prohibition on these items anymore," said state Rep. James Spillane, R-Deerfield. "We've allowed knives of any length to be legal over 12 years ago. We have people able to carry firearms for self-defense, and the truth is that blackjacks, slungshots and brass knuckles are purely non-lethal defense weapons." |

A judge issued a temporary restraining order Friday blocking the new Illinois law banning assault-style weapons and high-capacity magazines.
Effingham County Judge Joshua Morrison issued the order after former Republican candidate for attorney general Tom DeVore sued to block the law. DeVore said he’s representing hundreds of people from dozens of counties who argue the law violates their constitutional rights.
Morrison’s ruling only applies to 850 plaintiffs listed in the lawsuit in Effingham County and four licensed gun dealers. |

Legislative Bill 77 recognizes that a law-abiding adult who is already legally allowed to carry a concealed firearm, can do so without obtaining government permission. This ensures that citizens have the right to self-defense without government fees, red tape, or delays. Additionally, this legislation maintains the existing concealed handgun license system, so citizens who still wish to obtain a permit may do so. |

Kaylor wrote that he won’t be checking to ensure that “lawful gun owners” register such weapons with the Illinois State Police.
Perhaps he doesn’t understand that these gun owners cease to be “lawful” if they fail to register their firearms by Jan. 1 of next year.
Like many self-styled defenders of gun ownership, Kaylor wrote “One of those enumerated rights is the right of the people to keep and bear arms presented under the 2nd Amendment.” The Second Amendment to the U.S. Constitution actually states: “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” |
