Contra Costa County officials will decide Tuesday whether they'll bring assault charges against a Richmond man who shot an intruder at his home.
It happened early Monday morning. Police say the homeowner saw someone in his backyard and shot several times with a small-caliber weapon.
The law allows homeowners to use deadly force on their own property if they fear for their lives. But the issue is whether excessive force was used.
Some neighbors say the man who was shot was drunk and wandered into the backyard. They say they heard six or seven shots fired.

The male victim fired several rounds from a handgun at the suspects during the robbery striking two of the suspects. The male victim sustained moderate injuries as a result of being assaulted by the suspects during the incident."

In plain language, they won't be hearing that case. The usual weasel words: Denial of a certiorari petition should in no way be construed as an opinion on the merits of the case. "Watch out. Be careful. State Sen. Greg Goggans, R-Douglas, with a little help from the National Rifle Association, wants to make it legal for those who 'reasonably' believe they are under attack to fight back, including the use of deadly force."
"On the surface it's difficult to argue with a person's right to defend one's self or one's loved ones. In fact Senate Bill 396 is not much different from present law with a couple of notable exceptions. The present law limits to one's home where deadly force can be used. But this revision would allow deadly force to be used 'any place where he or she has the right to be.' Basically that means on the street, in the mall or in a restaurant or bar. It's one thing to have the power to protect yourself in your home. We all know who is supposed to be there and who is not. However, on the street, where everyone has the legal right to be, misunderstandings can and do happen, from road rage to an accidental bump on a crowded road."

SHOTS have been fired by during a grocery store robbery in Sydney's south west.
Three men in a stolen white Audi entered the store on Slade Road in Bexley North and threatened a 16-year-old staff member with a handgun, police said. The robbers fired a shot into the ceiling, ordered the teenager to the ground and then fled the scene with a sum of cash and cigarettes, police said.
The teenager was not injured in the incident.
The thieves, who were wearing balaclavas, were last seen driving south on Bexley Road, police said. |

Larry Pratt, the executive director of Gun Owners of America, says South Africa should not make it harder for good citizens to get firearms to defend themselves.
Pratt is in the country to research the effects of the Firearms Control Act. He is currently visiting Bloemfontein.
Pratt says there are not enough police to protect people. He says criminals just get guns and use them. "We have found actually in the United States that the easier we have made it for people to be carrying guns on the street, the lower our crime rate has gone, but just in those states that have adopted those kinds of laws.
Prat says South Africa's crime rate could go up because of the gun control laws. |
