“We must fervently resist any effort to pass gun control legislation,” Maddox said in December.
"Any type of red flag law proposal, or ERPO, or the CARR act has the potential to violate at least three constitutional rights - in addition to due process and the presumption of innocence, which is a principal that is well enshrined in our American legal system," Maddox added.
Maddox explained that she believes Second Amendment rights are not negotiable. She also expressed frustration with some of her fellow Republican lawmakers for proposing gun control measures. |

The House Consumer and Public Affairs Committee passed three firearm-related bills along party-line votes after extensive debate on each of the pieces of legislation Thursday.
The committee first discussed HB 129, which seeks to enact a 14- business-day waiting period for buying firearms.
“We unfortunately have an open loop where the firearm seller can actually hand over that firearm without the background check having been accomplished so this closes that critical loophole, where one could obtain a firearm where background check was not completed,” bill sponsor Rep. Andrea Romero, D-Santa Fe, said. “In conjunction with that, this is also a bill that we hope will save a lot of lives.” |

A Republican and a Democrat are co-sponsoring a bill called the “CARR Act.” It stands for Crisis Aversion Rights Retention.
It’s similar to red flag laws, but supporters say it’s better equipped to help people in crisis situations and does not totally take away their guns.

In Illinois, law enforcement can present the order of protection but do not have the right to search the property or take away firearms. HB 1404 would require law enforcement to remove any guns from a person who is facing an order of protection. However, it is still unclear how long the process would take from granting the order until firearms are removed. |

A St. Louis rapper has been acquitted on charges of murder after being involved in a fatal road rage incident in 2022.
Michael Henderson, 19, was found not guilty of first-degree murder and armed criminal action in the shooting death of 42-year-old Joseph R. Shaw. Henderson, whose rap name is CTS Luh Wick, claimed self-defense in the shooting, which was being investigated as a road rage incident. |

President Joe Biden is coming for your guns— if you needed any more of a reason to vote him out of office.
On Thursday, the White House announced that Biden would use executive action to further restrict law-abiding American citizen's right to the Second Amendment.
However, this time, the president's actions will be designed to take action against gun storage.
Biden's executive action will "promote safe storage of firearms that implement President Biden's Executive Order on promoting safe gun storage in order to reduce gun violence and make our communities safer," according to a White House statement. |

A panel of three judges from the United States Third Circuit Court of Appeals has ruled it is unconstitutional for the Commonwealth of Pennsylvania to ban young adults from openly carrying firearms.
Pennsylvania Governor Josh Shapiro (D) issued an emergency order along with two other statutes banning the open carrying of firearms by residents between the ages of 18 and 20. The order led to the Firearms Policy Coalition (FPC) and the Second Amendment Foundation (SAF) suing the state over the order in Madison v. Commissioner Pennsylvania State Police. The Plaintiffs lost in District Court before appealing to the Third Circuit.

As a law-abiding citizen of this great country, I can form my own militia if I so choose, appoint myself colonel, enlist my friends as privates or PFCs, and we can run around the woods until we all keel over from heatstroke or heart attacks – whatever comes first. It’s all perfectly legal, at least for now.
We have the right to criticize our government. We can sit around the campfire at our secret militia base nursing our sore muscles and fire ant bites and talk about how Joe walks like a penguin, or how it would take Kamala a good 20 minutes just to tell you you’re on fire. It’s all perfectly legal and protected speech, at least for now. |

An Indiana House committee passed a bill to prohibit financial institutions operating in the state from using a credit card merchant category code that enables the tracking of firearm and ammunition purchases.
The Committee on Financial Institutions voted to advance House Bill 1084 (HB1084) on Jan. 25 in a 9-4 vote. The bill would prohibit financial institutions from requiring merchant category codes for a purchase that identifies a merchant as a firearms retailer. It would also prohibit the Indiana Department of Justice from maintaining a list of firearm purchases based on information from its background checks. |

A man died after a family member stabbed him inside their home in Lanham, Maryland, early Thursday in what may have been self-defense, authorities say.
Prince George’s County police responded to Greenfield Drive after a woman stabbed a man at about 7:15 a.m. and then called 911, police said.
The man was taken to a hospital, where he died. His name was not immediately released.
“Preliminarily, we are investigating this as a possible self defense case amongst family members,” Cpl. Antonia Washington said. |

In a recent home invasion incident in Mountain Home, Arkansas, a homeowner successfully defended their property using a .22 caliber rifle. The 29-year-old suspect was shot in the shoulder during the break-in.
The altercation began when the suspect, reportedly highly intoxicated, attempted to gain access to a residence by knocking on the front door. After being denied entry, he proceeded to break the glass of the back sliding door, prompting an immediate response from the homeowners. During the ensuing scuffle, both homeowners suffered injuries from the broken glass. |

Newsweek breathlessly reports on a Christian School in Iowa that’s training up some of its teachers to pack heat in their schools. The purpose, of course, is to provide an active response to a murderous lunatic, terrorist or criminal until law enforcement can arrive. In other words, give teachers and staffers the ability to use guns in self-defense at the schools.

State and federal agencies routinely issue "guidance" in the form of public statements and private letters that are actually veiled commands and threats of adverse consequences for failure to obey. Interpretive regulations, which supposedly only express an agency's opinion and are non-binding, may serve the same function. Such communications may be beyond the agency's legal authority or may be a way to circumvent required notice and comment procedures for formal legislative regulations. This type of coercion may violate rights under the Second Amendment and other constitutional rights, not to mention required administrative procedures. |

The death of a child is already a tragedy, but when the loss might have been preventable the heartbreak is compounded. In a few short weeks, two children were able to access loaded guns in the community and a three year old lost his life. This incident has not only caused the community to grieve but also sparked a vital conversation about the measures needed to avert similar occurrences in the future.

As this year’s legislative session gets underway, there’s one wedge issue already getting lots of attention. Rest assured that any and all gun control proposals, no matter how reasonable, will get plenty of attention by the usual band of Second Amendment reactionaries and their demagoguing leaders.
Remember last September when an Gov. Michelle Lujan Grisham issued an executive order limiting the carrying of firearms in Bernalillo County? It was specific to metro Albuquerque, but some of the most aggressive demonstrations came in the more rural areas of our state. |

Anti-gun Pennsylvania lawmakers last week approved five restrictive gun control measures in the House Judiciary Committee, setting the stage for all five to be considered by the full House of Representatives.
On Jan. 17, the committee approved House Bill 335, HB 336, HB 777, HB 1157 and HB 1190, all of which would trample on Pennsylvanians’ Second Amendment right to keep and bear arms. |
