Prosecute crime — not guns, Hatch says

"Senate Judiciary Committee Chairman Orrin Hatch says new Justice Department figures support longtime GOP claims that the best way to fight violence with guns is not to outlaw the guns, but to prosecute criminals."

"Data released Wednesday showed that as federal prosecution of gun crimes increased 68 percent from three years ago under the Bush administration, violent crimes dropped 21 percent."

" 'Our law enforcement's tough-on-crime approach parallels what I have always advocated: protect the rights of law-abiding citizens to keep and bear arms and strictly enforce our gun laws,' Hatch said." ...

Get Ready for the U.S. National ID Card

"It's only a matter of time before driver's licenses become the de facto U.S. identification card. Our licenses already have most of the features of a national ID card, and state governments are hard at work improving what little they lack. From there, it'll be only a small step for America to adopt a full-fledged national ID card. What should freedom-lovers do about it? Reread the Constitution and 1984, and then buckle down for an impassioned debate that might challenge the way you think about the issue."

"The national ID card that civil libertarians fear most is one that is issued to all citizens, who must carry it at all times; contains a unique number and personal information; and is required by government agencies and businesses for those who transact with them. Libertarians fear the ability of governments and corporations to use a national ID as a means to know much about us and to use that information against us."

"Idaho Senator Larry Craig was at the center of controversy Thursday in Washington."

"The controversy surrounds legislation that overhauls the Patriot Act."

"The legislation was co-authored by Senator Craig and is called the Security and Freedom Ensured Act, or Safe Act."

"U.S. Attorney General John Ashcroft criticized the bill in a four page letter and threatened a presidential veto if the act makes it to President Bush's desk."

"It is not my intent to handcuff law enforcement. It is my intent to make sure that we lock some doors that we unlocked with Patriot Act," Craig said."

"Craig is particularly concerned with so-called 'sneak and peak' search warrants."

Repeal the Patriot Act?

"The basic idea behind the Patriot Act is simple: Give those investigating terrorism the same tools already used by those going after mobsters and drug lords. The Patriot Act does not give the government more tools or allow laxer standards for investigations."

-------
Actually, it does. According to Section 213 of the Act, police may conduct searches of homes and offices without notifying the owner that the search is being conducted. Furthermore, this section allows an officer to delay notifying the subject of the search that a warrant is being executed if reasonable cause exists “…to believe that providing immediate notification… may have an adverse result.” This same section also allows the government to delay notifying a home or business owner about the execution of a warrant if a court finds there’s a “reasonable necessity for the seizure.”

Section 218 is a radical provision in the USA PATRIOT Act, which amends FISA's wiretap and physical search provisions. Prior to the passage of this bill, FISA’s lax standards could only be applied if the actual purpose of the surveillance was the gathering of foreign intelligence. Section 218 relaxes that standard to apply to a domestic criminal investigation if the gathering of foreign intelligence information merely constitutes a significant purpose of the surveillance.

"A decision by federal Judge Collins in Los Angeles to strike down a portion of the sweeping anti-terrorism law looks like a heartening sign that the judiciary system might be ready to get back in the game of protecting the liberties of American citizens. Even better would be a decision by Congress to let those portions of the Patriot Act scheduled to expire this year to expire."

"Judge Collins' decision this week referred to specific language in the Patriot Act that prohibited anyone from providing 'expert advice or assistance' to designated terrorist groups."

"Before the Patriot Act it was already illegal to provide 'material assistance' to such groups, and people have been prosecuted for doing so." ...

"Last week the Supreme Court let stand the Justice Department's right to secretly arrest noncitizen residents."

"Combined with the government's power to designate foreign prisoners of war as 'enemy combatants' in order to ignore international treaties regulating their incarceration, and their power to indefinitely detain U.S. citizens without charge or access to an attorney, the United States is looking more and more like a police state."

"Since the Sept. 11 attacks, the Justice Department has asked for, and largely received, additional powers that allow it to perform an unprecedented amount of surveillance of American citizens and visitors. The USA Patriot Act, passed in haste after Sept. 11, started the ball rolling."

"While the Bush Administration never tires of reminding the American people that the president's war on terrorism, his invasion of Iraq, and the Patriot Act I and II are all rooted in the 9/11 attacks on the World Trade Center and the Pentagon, it has tired of one little bitty aspect of this post-9/11 period: the investigation by the ten-member bi-partisan independent commission."

"White House officials, along with House Speaker Dennis Hastert (R-Ill), have decided to oppose extending the time limit for work by the National Commission on Terrorist Attacks Upon the United States, 'virtually guaranteeing that the panel' will have to be done with its work by the end of May, the Washington Post reported on January 19."

"Sir John Stevens, Commissioner of the Metropolitan Police, was one of the first people to sign the pledge board when it was first used last year during a special conference to discuss ways to reduce and prevent gun crime."

"CALLOUS cops fell about laughing at a terrified mum who believed their gun training exercise was for real."

"Vicky Gabriel, 28, cowered in bushes with her two babies as armed officers cornered a screaming 'gunman'."

"And when she finally emerged sobbing they cracked up over her misunderstanding."

"Vicky had taken her tiny son and daughter to feed the ducks at her local park when police cars screeched to a halt and armed cops got out."

-------
This is a sad commentary on British society. The citizens are vulnerable, terrified and indoctrinated into the victimhood mentality. Meanwhile, the cops, who are charged with defending a disarmed citizenry, are incapable of protecting them and laugh at their fear.

"One of the scariest bills to be introduced so far in this session of the Tennessee General Assembly would allow lawmakers to carry their firearms without a conceal-and-carry permit." ...

"Vincent's bill is dangerous. Allowing off-duty law enforcement officers to carry their weapons without a conceal-and-carry permit makes sense because they have been properly trained in their use. Law enforcement officials are thoroughly schooled in laws governing when weapons can be drawn and fired in public. Allowing law enforcement to carry without a permit can help prevent crime."

A lot of regular citizens are better trained than the law enforcement officers.

This editorial is scary in its elitism.

"A woman was hijacked, another badly hurt, two schoolgirls were injured, shots were fired - and a car smashed through a kitchen wall."

"This was not a B-grade movie, but a hijack drama and a police chase in the early morning hours in Johannesburg on Wednesday."

"The chaos started at 6.50am when a 54-year-old woman arrived at the home of a friend for their usual early morning walk."

"As she drove into her friend's driveway, three men in a golden Honda Ballade ambushed her."

"Recounting her ordeal, the woman said she had just stopped when two men jumped out of the Ballade. One of them approached her friend with a gun before turning towards her, demanding the keys to her car."

-------
And the South African government continues to disarm its citizens against thugs such as these.

"One of the men accused of killing Roman Catholic priest Father Michael D'Annucci described how the clergyman was first shot in the hand and foot before he was finally killed by a third bullet."

"In a statement handed to the Pretoria High Court, Boetie Mashego said they decided to rob D'Annucci and take his vehicle."

"The priest was shot because he refused to hand over the car keys. D'Annucci was killed on December 8 2001 in the driveway of a member of his congregation in Soshanguve."

"Minutes before being killed, the 61-year-old priest had said a prayer for the member of his flock. Apart from his car, the accused also made off with his Bible and cellphone."

Pretty soon thugs, rapists and robbers will be the only ones armed in South Africa.

" 'It's galling to know that taxpayer dollars are being used to fund this politically-motivated publicity stunt,' said ISRA Executive Director Richard Pearson."

It's also galling to know that taxpayer dollars are paying for a police department that abuses sick leave more than any other department in the country, that their tax dollars are being used to destroy their rights, and that the city is absolutely incapable of protecting them against armed thugs, while it disarms them with unconstitutional law.

There's a lot to be galled about in Chicago.

But it will never happen if we continue to vote as if it is a test with 'multiple choice' answers D) and R). Now it is time to vote 'none of the above', and some day we might see in the White House a person who will respect the Constitution and the Rule of Law, and that will be a wonderful day. "As expected, lawmakers this year will get a chance to clarify what many thought was already clear — the Utah Legislature, and no one else, has the absolute right to enact gun laws throughout the state."

"Sponsored by Sen. Michael Waddoups, SB48 responds to a state court ruling that said the University of Utah could ban concealed weapons on its campus."

"Under SB48, no local authority or state entity could establish or enforce a rule prohibiting concealed weapons permit-holders from carrying their guns."

" 'My intention is that this bill makes it very clear that the University of Utah is part of the state of Utah and that they are going to have to adhere to the state law regarding concealed weapons on their campus,' said Waddoups."

-------
How about making it clear that the state and its universities will adhere to the US Constitution and will ensure that the students have the ability to defend themselves against criminal scum?

"Joshua Cary heard a noise in the basement, grabbed a sword from his big brother's collection and went downstairs to investigate."

"The 14-year-old didn't mince words."

" 'I'm going to give you until the count of three to come out, or I'm going to stab you,' he yelled Thursday, according to his mother, Rebecca Cary."

"Soon, a handcuffed man emerged, saying, 'I didn't do it.' "

"Joshua led the man upstairs at sword-point. His mother ran outside and found police searching for an escaped prisoner. The man, Mark A. Brown, who had broken free after he was picked up on a parole violation, was taken back into custody."

And yet, the neo fascists in this country routinely disarm this young man and others like him, claim he is too young to exercise his Second Amendment rights and treat those young people who would use swords, firearms or knives to defend themselves like criminals.

"What Governor Pataki has in mind for New York's more than 1 million handgun permit-holders is outrageous, defies common sense and deserves to be scrapped pronto."

"The short item in the governor's budget proposal released a couple of weeks ago seemed to refer strictly to a revenue raiser -- namely, imposing for the first time a $100 state 'fee' for a pistol permit." ...

"That for the first time the state wants to stick up legal handgun owners without offering services or compensation in return is bad enough, but the totality of the proposed changes to penal law make it clear to me that the agenda goes far beyond raising about $31 million over 10 years." ...

"Changes to the penal law would include a $100 fee on new and renewal handgun licenses; a $25 fee for each permit amendment (adding or subtracting specific guns); a $100 fee on gunsmith and dealer licenses; a $25 fee on duplicate licenses, and a $25 fee on license transfers (from one county to another when the holder changes residence.)"

"Plus, statutory caps on local fees would be removed."

"Which means, in effect, one stickup after another is being proposed."

"That's not even the worst of it."

"But this fight is a real one, not a visual image on television. It is part of the self-defence training conducted by the Crime Against Women cell of the Delhi police. "Ivorian police, gendarmes and military have committed serious human rights violations—including torture, sexual violence, arbitrary arrests and detentions, and summary executions—since the military coup in 1999 and widespread election-related violence in 2000. Victims of these abuses have consistently been northern Ivorians, generally supporters or perceived supporters of the Rally of Republicans (Rassemblement de Republicains, RDR) opposition party, and West African immigrants. Throughout the months of open conflict in 2002-2003, hundreds of civilians perceived to be supporting the northern-based rebel movement and the RDR were harassed, assaulted, arbitrarily arrested, detained, tortured and often executed on the basis of their real or imputed ethnic, religious, and national affiliation. Ivorian police, paramilitary and armed forces were also responsible for brutal security operations in Abidjan, Daloa, Man and Monoko-Zohi that resulted in several massacres of civilians. To date, there have been no national or international investigations into these abuses, nor have any individuals been charged for any of these crimes."

-------
But police and the military would never abuse their monopoly on force, right Sarah? You and the UN try to disarm us daily, leaving us at the mercy of thugs with badges, and we're supposed to give up our guns quietly? Hardly.

"A national and campus-wide trend suggests a decline in interest among students to address sexual assault and rape, despite statistics that say sexual assault is as prevalent as ever."

"On campus in recent months, there have been two high-profile sexual assault cases, one involving the infamous 'serial groper' and the other involving alleged sexual assault at a Delta Delta Delta sorority pledge event, though charges were never filed in the latter case."

"Nationally, the number of rapes has not declined like other violent crimes in recent years. According to the Bureau of Justice, rape and sexual assault numbers nationally have held steady and even slightly increased since 2000."

"A former deputy constable was sentenced to seven years in prison for molesting a teenage boy who was later wounded in a shootout when the man attacked him a second time."

"Patton had fired his .40-caliber service revolver 10 times during a shootout with the 14-year-old boy. Eight of the shots hit the boy and resulted in permanent disabilities and the loss of the boy's liver, Hernandez noted."

"After Patton shot the boy, the deputy constable also grabbed a chair and beat the boy until he was unconscious, according to an affidavit filed in the case."

-------
Molesting him, shooting him 8 times then beating him unconscious with a chair = assault and 7 years in prison?!? That's it?

"Wisconsin residents will find out on Tuesday if conceal and carry will be the new law, when the Assembly votes on whether to override Gov. Jim Doyle's veto. The bill's passage would grant students the right to lawfully carry a firearm in some public places after obtaining a permit and going through the proper training required under the law."

"Likewise, many students would be able to obtain a weapon's permit and carry a handgun if the override is successful, a thought that worries some University of Wisconsin students."

" 'If you have a gun, chances are you're more likely to use it,' UW student Laura Nelson said. 'There's already been a lot of violence recently with the Ogg Hall and University Square attacks, so I don't think adding more handguns is what we need.' "

"Nelson, 34, walked the streets carrying a 9mm Browning semi-automatic pistol fitted with a laser sight in a shoulder holster."

"The gun he called 'my special thing' was seized by police when they raided his Woolwich riverside apartment. "There were 18 non-fatal hunting accidents recorded in Nebraska during 2003, but it was the third year in a row that the state had no hunting fatalities..." ...

"We are very concerned about the increase, especially when we know none of the accidents would have happened if the shooter or the victim would have followed the rules of firearm safety." ...

"Though any accidents are too many, the figures should be put into the proper perspective. Last year approximately 139,594 habitat stamps were sold and there were only 18 hunting accidents reported, which means that only .0001 percent of those who hunted or trapped in Nebraska during 2003 were the victims of hunting accidents." ...

"Controversial rapper Maurice Young, better known as 'Trick Daddy,' served as a motivational speaker at an FCAT event focused on the impact the test might have on this year's graduating class."

"The choice of speakers left some at the event, which was hosted by the Florida Black Caucus, feeling uneasy, but organizers defended the rapper (pictured)."

"...Whether we like it or not, because of his lyrics and what he does, he's a role model to kids," said Rep. Edward Jennings.

"The speech at Miami Edison Middle School added to a tally of community service hours Trick Daddy must complete for his conviction on drug and firearm charges last year."

" 'I signed the nation's first 'smart gun' technology law, creating the first such program to protect our children from handgun violence and accidents,' - see above. You're the same governor who ran on the platform that while you were in office, no NJ citizen would ever have the right to bear arms outside their own homes. "North Yorkshire Police have given a warm welcome to new legislation aimed at ridding the streets of toys that could result in deadly consequences."

"It is now an offence to have in a public place an air weapon, toy gun or replica that looks like a real firearm. The Anti-Social Behaviour Act says no-one may carry an air weapon or imitation firearm in a public place without lawful authority or reasonable excuse. And an imitation firearm is defined as one that 'has the appearance of being a firearm' whether or not it is capable of discharging a shot, bullet or missile."

"Anyone who has effective gun control in his or her sights needs to take a walk around town to figure out why the law not only should remain on the books, but be strengthened: If U.N. inspectors had visited certain Baltimore neighborhoods, they may have found more weapons of mass destruction there than they did in Iraq."

"With luck, the U.N. Security Council could have stemmed some of the 271 murders that occurred in Baltimore last year, up by 18 from 2002. Too many of these were from multiple gunshots, clearly a statement from the drug dealers responsible for the high murder rate regarding the consequences of getting on their wrong side."

-------
What amazing drivel! The weapons are already illegal, and obviously these laws are doing nothing to prevent criminals from obtaining said firearms. The use of these weapons in crimes has risen slightly after the implementation of the 1994 ban. And considering that they are used in less than two percent of crimes, comparing the streets of Baltimore to Iraq, while attempting to blame "assault" weapons, is not only hysterical but an outright misrepresentation.

"The recent debate over public records provisions in Ohio's concealed carry law sent the media into full blown fits about infringing freedom of the press and their self-proclaimed position as protectors of the common person from abuses by Big Brother. Hearing them describe their defense of the commoner conjures up images of valiant crusades headed by knights in shining armor - and reeks of elitism and shameless self-righteousness."

Yeah, it would be tragic if they didn't get to use the deaths of their loved ones to steal money from legitimate businesses. Right.
