Charges have been dismissed against a man accused of pulling a knife in a confrontation on a city street.
Rochester police arrested 43-year-old Paul Jason Allen on May 19, 2017. They say he was crossing near the intersection of 14th Street and 12th Avenue NE when Allen began yelling and swearing at three men in a truck. One of the men said he got out of the truck and that’s when Allen pulled out a knife.
Allen was accused of 2nd degree assault but that charge has been dropped. Olmsted County Attorney Mark Ostrem says Allen notified the court he was planning to claim self-defense and, after further investigation, it was decided they could not refute that claim beyond a reasonable doubt. |

The 2018 Washington Legislative Session is set to convene this upcoming Monday, and the Senate Law & Justice Committee has indicated it will hold a public hearing on multiple gun bills on the following Monday, January 15th from 10:00AM-12:00PM. The committee agenda has not yet been posted for which bills will be heard; however, anti-gun legislators have already made it clear they are going to push several sweeping gun control bills this year.
Senate Bill 5050, sponsored by Senator David Frockt (D-46), and House Bill 1134, sponsored by Representative Strom Peterson (D-21), would prohibit all possession, purchase, sale or transfer of commonly owned semi-automatic rifles and ammunition magazines holding ten or more rounds. |

The Idaho legislative session starts in just three days. Next week we continue our efforts to get Stand-Your-Ground passed in Idaho!
The battle to pass Stand-Your-Ground is not going to be easy, and we are going to need your help to do it — more on that in a minute.
In a state like Idaho, you would assume that these bills would be a slam dunk. With the large pro-gun majority we have now, you would think this bill would be easy to pass.
But history has proven differently.
Politicians rarely like major changes in the law or do anything that is controversial. They prefer to do what is easy, and not necessarily what is right. |

Black Guns Matter, a Second Amendment education group with an urban focus, will be featured in and sponsoring SHOT Show, the largest gun show in the world.
Maj Toure founded Black Guns Matter in 2015. The group is focused on providing Second Amendment education and information to urban communities that are plagued by violence.
“I don’t think there’s a black gun culture or white gun culture,” Toure says on the group’s website. “I think there’s an informed gun culture and an ignorant gun culture.” |

My previous post outlines the facts in more detail, but briefly: Defense Distributed is a Texas based non-profit committed to defending gun rights through digital manufacturing. This case arose after the State Department instructed Defense Distributed to remove several files from its website, saying that they were controlled by International Traffic in Arms Regulations (ITAR) and that they had been posted without required prior authorization. The files in question would have allowed users to 3-D print, for example, parts for making an AR-15 rifle. Defense Distributed, along with co-plaintiff the Second Amendment Foundation, challenged the State Department’s regulation as a violation of their First, Second, and Fifth Amendment rights. |

When any handgun maker offers a full-size service pistol, typically it quickly starts work on a follow-up model. It is a familiar pattern, and the subsequent model is invariably a shorter-barrel, shorter-frame version of the full-size gun. Most of the former are well-suited for police and military handgunners and even some civilian applications. But the strong and steady demand for smaller guns intended for concealment use by military and police shooters is probably exceeded these days by the demand of legally armed citizens. In record numbers Americans are exercising their constitutional right to not just keep, but also bear arms. |

Government Accountability Office employees posing as sketchy buyers tried and failed in 72 attempts to purchase firearms on the internet, part of a failed investigation called for by a trio of Congressional Democrats.
While the Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF) insisted in its most recent strategic plan, as cited by the GAO, that "the privacy of the Internet makes it an ideal means for gang members, violent criminals, terrorists, and juveniles to traffic and obtain illegal firearms," the new report released by the (GAO) could not corroborate any of it. |

"Based on incontrovertible evidence, it was clear to us that we would have a burden to overcome regarding a self-defense claim on the part of (Yeaple)," he told The York Dispatch.
Can't meet burden: "And based on that evidence, we're of the opinion that we could not meet that burden beyond a reasonable doubt," Sunday said. "We would not be in a position to prove ... that he was not entitled to a self-defense claim." |

Ohio and Pennsylvania begin medical marijuana programs this year but on Thursday, the U.S. Attorney General reversed previous policy, giving federal law enforcement the ability to fight state marijuana operations.
Twenty-nine states have legalized some form of marijuana but now a U.S. Circuit Court of Appeals ruling says the federal ban on gun sales to medical marijuana card holders does not violate the Second Amendment. |

With a newfound majority in the Washington Senate, state Democrats have found an early target in firearm regulation as the 2018 legislative session gets set to begin.
Senate Bill 6049 would regulate the ownership and manufacturing of large capacity magazines and make them all but illegal in most cases. “Large capacity” refers to any magazine that can hold more than 10 rounds.
The bill was requested by state Attorney General Bob Ferguson, who cited a motivation in mass shootings across the country, including a 2016 shooting at a house party in Mukilteo in which three were killed and one was injured. |

A Maryland Dem is trying to change House rules so that the chamber observes a moment of silence for every shooting victim in America, not just mass shootings and terror attacks.
The House has recently observed moments of silence for victims of the October mass shooting in Las Vegas, the Halloween bike path terror attack in Manhattan, and the November mass shooting at a church in Sutherland Springs, Texas.
Freshman Rep. Jamie Raskin (D-Md.) introduced H.R. 666 this week "to observe a 60-second moment of silence in the House for those killed by gun violence in the United States on the next legislative day after any such individual dies." |

Attorneys for 5 California gun owners and 4 civil rights advocacy organizations have filed for an injunction against the state’s Department of Justice regulations on so-called “assault weapons.”
In the request for an injunction, the plaintiffs argue that “they, and many others similarly situated, will suffer irreparable injury if they are forced to comply with the registration requirement in accordance with the Challenged Regulations by the statutory deadline of June 30, 2018. In essence, they and many others would either be illegally forced to register or illegally denied the ability to register their firearms.” |

State Attorney’s Office memo: “After thorough review of this case, it is clear that the use of deadly force by Rivers was justified and lawful and no further action is warranted by this office.”
The State Attorney’s Office has determined that a man suspected of fatally shooting an armed teenager in front of his Ocala home is immune from prosecution under Florida’s Stand Your Ground law.
Jeffery Scott, the 18-year-old Vanguard High School senior he killed, was pointing a gun at another teenager at the time, according to the Ocala Police Department. The shooter, Edrige Rivers, also hit — and paralyzed — Marcus Cooper, now 19, who was with Scott. |

The Citizens Committee for the Right to Keep and Bear Arms today announced its legislative priorities for 2018, noting that the threat to Second Amendment rights remains formidable as Congress and state legislatures get back to business.
At the federal level, CCRKBA will focus its efforts primarily on passage of concealed carry reciprocity and the Hearing Protection Act that deregulates noise reduction devices for firearms. The reciprocity legislation was passed by the House of Representatives late last year and is now facing a difficult fight in the U.S. Senate. The hearing protection act also faces a tough battle on Capitol Hill, where opponents have pulled out all the stops. |
