The 9th U.S. Circuit Court of Appeals over the weekend reversed an earlier order which put a hold on a lower court ruling that blocked California’s new law prohibiting concealed carry in most public places.
The law, known as SB2, prohibits licensed carry in so-called “sensitive places.” U.S. District Judge Cormac J. Carney granted a preliminary injunction against the law in December, the state quickly sought a stay from the 9th Circuit, which was initially granted. But over the weekend, a merits panel on the court reversed and dissolved the stay, so the law is once again blocked, pending an April hearing. |

Months after a Bay City man was shot to death inside a Saginaw house, prosecutors have declined to bring criminal charges against the woman who killed him. Rather, they found the woman acted in self-defense during a domestic altercation when she shot 27-year-old DaShawn M. Skinner. Saginaw County Chief Assistant Prosecutor Blair N. Stevenson said his office decided in December that Skinner’s death was a justifiable homicide and that charges were not warranted. The prosecution based its decision on police and autopsy reports. |

California's sweeping restrictions on public gun possession are on hold again. The new rules had taken effect on January 1, thanks to an adminstrative stay issued by the U.S. Court of Appeals for the 9th Circuit. But on Saturday, the appeals court dissolved that stay in May v. Bonta, allowing the preliminary injunction that U.S. District Judge Cormac Carney granted on December 20 to take effect. That means Californians with carry permits can now use them without risking prosecution for entering the state's newly created gun-free zones, which cover most public places.

On November 7, 2023, the U.S. Supreme Court held an oral argument for United States v. Rahimi, a case that challenges the federal ban on gun possession by a person subject to a domestic violence restraining order (DVRO). Stephen Halbrook, an author and attorney who has argued cases before the Supreme Court, had the opportunity to attend the hearing for America’s 1st Freedom. As this could be an important ruling, he wrote a feature article for Freedom that traces the arguments on both sides, blow-by-blow. |

President Joe Biden reportedly has no intention of having Defense Secretary Lloyd Austin leave his administration over a secretive hospital stay. Senior administration officials told POLITICO the president would not accept the defense secretary’s resignation if offered. “Austin’s going nowhere,” one of the sources said. The report follows a White House official telling Reuters that Biden has “full confidence” in Austin and is “looking forward to him being back at the Pentagon.” |

The U.S. Supreme Court denied Illinois state Rep. Dan Caulkins’ challenge to Illinois’ gun and magazine ban that included questions about conflicts of interest at the Illinois Supreme Court. Following Friday’s conference of the U.S. Supreme Court, the court released an order list Monday where it denied requests for review from about 200 separate cases. One of those was the case Caulkins v. Pritzker, which was decided in favor of the state of Illinois in August by the Illinois Supreme Court.

Tomorrow, the Senate Public Safety Committee will be hearing Senate Bill 53, formerly a taxation bill that was recently amended to now place additional requirements on the existing mandatory storage laws regarding firearms. Under the proposed legislation, firearms not only have to be secured, but secured in a California DOJ approved device. Persons who have firearms that are stolen or are accessed without authorization, that are not stored in compliance with this legislation, will face penalties including loss of their Second Amendment Rights for a year!

"America has a life expectancy crisis," asserted a recent headline in The Washington Post. Why a crisis? Because American average life expectancy has been flat and then declining for the past decade or so. One bit of recent good news: The Centers for Disease Control and Prevention (CDC) reported in November that average life expectancy at birth in 2022 was 77.5 years. While that is down from its 2014 peak of 78.8 years, the CDC notes that this is a post-pandemic increase of 1.1 years from its nadir of 76.1 years in 2021.
