Watters then referenced an article from The Philadelphia Inquirer which interviewed several new LGBTQ+ gun owners, who cited fear of hate crimes and terror attacks as their motivation. One respondent said: “We’re not looking to arm up and storm the Capitol. We just don’t want to be put in concentration camps.”

An attempted burglary in Englewood, Ohio, turned deadly early Friday morning when a homeowner shot and killed the alleged intruder. The incident occurred at a residence around 2 a.m., and authorities are now investigating what they say appears to be a clear case of self-defense.
According to WDTN, the homeowner’s girlfriend called 911 after he woke her up to alert her that it sounded like someone was breaking into their home. |

“The government has not pointed to sufficiently analogous historical laws to establish why Daniels himself should be considered presumptively dangerous. And, as explained, even had the government supplied sufficient historical briefing to support a theory of dangerousness, the jury instruction employed in Daniels’s trial was too open-ended to support his conviction because it left open the possibility that Daniels had not even unlawfully used a controlled substance in several weeks.” — United States of America v. FIND Act – the Firearm Industry Non-Discrimination Act
The bill will fight back against “boardroom gun control” and protect our Second Amendment rights.
Large financial institutions and other corporations, many of whom benefit from federal contracts, have increasingly adopted policies designed to hurt the domestic firearm industry – from forcing restrictions on the products they can sell, to outright refusing to provide basic services. These policies have, in effect, restricted access to legal firearms well beyond the democratically-established firearm laws at the state and federal levels.

Two House Republicans introduced legislation this week that would abolish the Bureau of Alcohol, Tobacco, Firearms and Explosives, adding the Justice Department agency to a list of entities in Washington that could be under a microscope as the GOP pledges to restructure and downsize the federal government.
In a press release announcing the effort on Tuesday, Republican Reps. Eric Burlison of Missouri and Lauren Boebert of Colorado pointed to the Second Amendment as a driving force behind their bill, saying getting rid of the ATF would safeguard Americans’ right to own a gun. |

“They’re joining groups like the Socialist Rifle Association and Pink Pistols, which have seen a surge of membership. Why? Many think that a gun is the only thing standing in the way between them and concentration camps.”
It is also not explicitly clear whether gun ownership among LGBTQ+ Americans has risen, and Watters’ objection appears to contradict his beliefs on the Second Amendment. The right-wing host has often promoted the right to bear arms, famously telling Piers Morgan, in a discussion about gun safety in 2023, that “forks don’t make you fat”.

“...But it is troubling that information was provided today that the rules passed today would not actually be in effect because of the Governor’s veto of House Enrolled Act 49 earlier last year. That information contradicts the Governor’s statements that this approach would yield an actual solution protecting our Second Amendment Rights. The complete solution would have been for the Governor to sign 2024 House Enrolled Act 49, which would have ensured a uniform approach. The Governor’s explanations for vetoing this bill have been contradictory. I’m calling on the Wyoming Legislature to once again address this issue and protect our Second Amendment Rights by bringing back and passing House Enrolled Act 49 in the 2025 General Session.” |

Finally, even if all we got were the two cases I described, it is very unlikely that readers of this column are only interested in cases of that ilk. It stands to be an interesting term, both in regard to what the court decides substantively—such as important cases under the Second Amendment, Eighth Amendment, Clean Water Act, and Fourteenth Amendment (including transgender care for minors)—and how it acts (or doesn’t act) as the last check against a second Trump administration that promises to deliver this time around what it failed to do the last time. |

“Stop asking why schools don’t have bulletproof glass and metal detectors at all the doors. Ask why schools have to.”
...
In any discussion about gun violence, it is necessary to acknowledge three basic facts that inform the environment in which we live.
First, gun violence is the number one killer of children and teens in this country. The John Hopkins Center for Gun Violence Solutions reports that for the third straight year, firearms killed more young people than any other cause including cancer and car crashes. |

The Supreme Court of the United States has distributed the case of Snope v. Brown, which was brought by the Citizens Committee for the Right to Keep and Bear Arms against Maryland’s ban on so-called “assault weapons,” for a Friday, Jan. 10th, 2025, conference.
CCRKBA is joined by the Second Amendment Foundation and Firearms Policy Coalition in this long-running case, which was already granted certiorari in June 2022, when the high court vacated an appeals court ruling and remanded it back to the Fourth U.S. Circuit Court for further action based on guidelines established that month by the Court in its landmark New York State Rifle & Pistol Association v. Bruen decision. |

Reps. Lauren Boebert (R-CO) and Eric Burlison (R-MO) recently introduced a bill to abolish the Bureau for Alcohol, Tobacco, Firearms, and Explosives (ATF). They argue that the agency has been used to violate the Second Amendment.
The lawmakers stated that the objective of the measure is to “safeguard Americans’ Second Amendment rights and protect law-abiding gun owners from the relentless bureaucratic overreach of the Bureau of Alcohol, Tobacco, and Firearms”. |

At the heart of the case is whether modern semiautomatic rifles, such as the AR-15, are protected under the Second Amendment. The CCRKBA argues that these firearms, often labeled as “assault weapons” by critics, are among the most popular rifles in America and are used for a variety of lawful purposes, including hunting, recreation, and self-defense.
“We’re definitely hopeful the high court agrees to take this case again and schedules oral arguments soon,” said Andrew Gottlieb, CCRKBA Managing Director. “A ruling affirming the Second Amendment’s protection of modern semiautomatic rifles is long overdue.” |

Rep. Lauren Boebert (R-CO) has introduced a bill to abolish the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The Abolish the ATF Act (H.R. 129) would shutter the government agency that is responsible for regulating alcohol, tobacco, and firearms. The ATF was founded in 1866 as the “Revenue Laboratory” under the Treasury Department’s Bureau of Internal Revenue. It was made an independent agency of the Treasury Department in 1927. In 1930, the ATF was transferred to the Department of Justice before being transferred back to the Treasury Department in 1933, and it became the Alcohol Tax Unit (ATU). |

Lawmakers and lobbyists were back at the Colorado State Capitol on Wednesday for the first day of the 2025 legislative session. Senate Democrats wasted no time introducing a bill they believe will save lives, but one that's set to face a fierce fight from opponents.
Senate Bill 25-003 aims to ban the manufacture, distribution, transfer, sale, or purchase of a "specified semiautomatic firearm," which includes semiautomatic rifles and shotguns, along with gas-operated semiautomatic handguns that have a detachable ammunition magazine. |

The purchase, sale and manufacture of semiautomatic guns that accept detachable ammunition magazines would be banned in Colorado under a bill introduced Wednesday by Democrats on the first day of the state legislature’s 2025 lawmaking term.
Senate Bill 3 would affect many pistols and rifles, whose manufacturers don’t appear to make versions of the weapons without removable magazines.
The legislation also would outlaw rapid-fire trigger activators and bump stocks, which can make a semiautomatic firearm fire at a rate similar to that of an automatic weapon. |

QUOTES
TO REMEMBER |
The right of a citizen to bear arms, in lawful defense of himself or the State, is absolute. He does not derive it from the State government. It is one of the high powers" delegated directly to the citizen, and `is excepted out of the general powers of government.' A law cannot be passed to infringe upon or impair it, because it is above the law, and independent of the lawmaking power." [Cockrum v. State, 24 Tex. 394, at 401-402 (1859)] |
