The man arrested in the incident was released from jail at the request of the Dane Co. District Attorney, who explained Wednesday that he believed the shooter was acting in self-defense, under the so-called Castle Doctrine.
Dist. Atty. Ismael Ozanne explained his office determined the man who was later released was in the room he rented when the person who died in the shooting entered “forcibly and unlawfully.” Then, that person reportedly refused to leave and took an aggressive stance against the former suspect. Based on that, the district attorney stated the state’s self-defense statute that is commonly known as the Castle Doctrine applied. |
PA: Landlord w/ Concealed Carry Permit Justified in Fatally Shooting Tenant

The landlord shot and killed his tenant, 36-year-old Leonard Williams Jr., after initially posting Williams’ property in arrears.
According to authorities, Williams then threw the notice on the ground and followed the landlord to his vehicle while fighting and threatening him.
Williams also tried to get into the landlord’s vehicle, and the fight continued over a struggle for control over the driver’s door. The landlord, who has a valid concealed carry license, then shot Williams, saying he feared for his life. |

If there is any doubt of life after death, we need only to look at the 10 mm cartridge.
It had a moment in the sun after the FBI chose it as a replacement for the (at the time) failed 9 mm, but many of the Bureau’s personnel couldn’t handle the recoil, so it soon rejected the cartridge. That resulted in 10 mm living in the shadow of obsolescence for decades.
Then, a few years back, the cartridge underwent a “rediscovery” with outdoorsy types, and it has risen to popularity again. Many are now using a handgun for hunting and for defensive carry in the wilderness. |

In New York Rifle & Pistol Association v. Bruen, to be argued on Nov. 3, the court will consider the constitutionality of a New York statute that restricts carrying a concealed weapon outside the home to instances where a person can show a need to do so for self-defense.
All five of the conservative justices—in their opinions on the Supreme Court or as court of appeals judges—have expressed strong support for protecting gun rights and limiting government regulation of firearms. Again, the real question is how far the court will go in this direction in this case. |

That did not stop Murphy from going further off the trail either using the question as a chance to sneak in talking points about firearms:
“And lastly, at some point we have to talk about guns. I’m proud of our record to make NJ the strongest gun safety state in America. But, again I feel sometimes my opponent is running for Governor of Texas. He wants concealed carry. He wants more rounds in magazines. He voted against banning 50 caliber weapons, against universal background checks. That’s a big part of the law enforcement reality here as well and we have to get that out there.” |

Beneath that surface, however, a more intriguing debate about the Second Amendment is taking place between two groups that usually aren’t at odds.
On one side is the American Civil Liberties Union and its New York state counterpart, which contend that the state law is justified to protect First Amendment rights in the public sphere. On the other side are a coalition of New York–based public defender groups who contend that the law actually gives cops a license to discriminate and harm indigent and minority New Yorkers who try to exercise their Second Amendment rights. The result is two starkly different visions of how the law affects civil rights, public safety, and the Constitution. |

A Fuel Fitness parking lot was the scene of a shootout on a recent Thursday afternoon. A Kalispell, MT man apparently got into some sort of dispute over a gym membership that spilled over into the parking lot. Fuel Fitness employees eventually asked the man to leave, and an argument ensued.
The man pulled a gun and opened fire on one of the employees, killing him. A bystander then retrieved a gun from his car and engaged the male suspect. The bystander managed to stop the suspect but was also shot for his trouble. The bystander was reported in stable condition, while the suspect was reported to be in critical condition. |

President Joe Biden’s failed pick to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives says the ugly and personal confirmation process hardened his resolve to focus on gun safety and push back against the industry’s outsize influence on the agency — even if he has to do so from the outside.
David Chipman, whose nomination to lead the ATF collapsed earlier this month following a bitter confirmation battle, said he received little backing from the White House or the Department of Justice even after a massive lobbying campaign erupted against him. |

When we think of the core essentials, we think of “water, food, shelter”. However, how about protecting yourself? No matter how proficient you believe you are in hand-to-hand combat, actual self-defense is much more nuanced. You don’t know how many opponents you could be facing, what the duration of conflict will be, or when you can expect basic things like an ambulance or medical care to arrive.
This is why making a plan for self-defense is so critical. |

A federal judge on Wednesday found that the District of Columbia is liable for wrongfully arresting six people accused of violating its laws on carrying handguns in public.
U.S. District Judge Royce C. Lamberth issued his opinion in a putative class-action case brought by six plaintiffs, four nonresidents and two residents of D.C., who allege they were wrongfully arrested under a combination of D.C. gun laws. |

The spike in guns itself may have multiple causes: people isolated at home because of COVID wanting more protection. Social unrest leading people to think (not necessarily correctly) that they needed them for self-defense. Political propaganda (and not much reality) about how Democrats were going to enact strict gun control laws. But as for more guns causing more murders, we may need to reconfigure the causation: to some extent both more gun purchases and more killings were results of a single cause—emotional and social stress from the pandemic. |

The FBI released the Uniform Crime Report which showed an abrupt rise in crime. It was hardly startling to those reading or watching the news. The report showed a 29 percent jump in murders in 2020. It is reportedly the largest increase since nationwide records began in the 1960s. That’s got gun control proponents banging the same drum: more guns mean more crime.
That’s just not true. A simple look at the data proves it. |

Gun manufacturer and designer Smith & Wesson announced Tuesday they were going to move their headquarters from Massachusetts to Tennessee.
“They feel that we have been left with no alternative. He specifically cited legislation recently proposed in Massachusetts that, if enacted, would prohibit that company from manufacturing certain firearms in the state,” a company press release said.
Jesyca Snoderly at USA Super Pawn in Maryville says Smith & Wesson firearms are some of their most popular.
“We in small Blount County are excited to get another manufacturer and a gun manufacturer. We are love our Second Amendment rights,” said Snoderly. |

But there is a larger takeaway from this: if you don’t like what’s on the menu, you can go to another restaurant.
Which is precisely what Smith & Wesson did in the face of legislation filed this year that would ban Massachusetts companies from manufacturing weapons and devices covered under the existing military-style assault weapons purchase ban, exempting those to be sold to law enforcement or the military. As Fox News reported, those products accounted for more than 60% of Smith & Wesson’s revenue last year, and the company announced it was moving to Tennessee. |

Since the legislation took effect, the ATF has warned Texas firearm dealers that federal law still stands, and the United States will pursue legal action on any citizen found in violation.
According to federal law, possession of an unregulated suppressor carries a penalty of up to 10 years in prison and/or up to $250,000 in fines. At this time, I ask all Texans to exercise caution when purchasing unregulated suppressors until H.B. 957 is litigated in court. |

Former New York City Mayor—and failed presidential candidate—Michael Bloomberg continues to utilize his vast wealth in an attempt to once again push his anti-Second Amendment agenda. This time he’s targeting Virginia, where elections will be held in just over a month.
Bloomberg is reportedly throwing upwards of $1.8 million behind anti-gun candidates in the Old Dominion via his anti-gun group Everytown for Gun Safety. Specifically, one million of that is earmarked for gubernatorial candidate Terry McAuliffe (D), who held the position from 2014 to 2018. |
