A federal judge Thursday overturned California’s three-decade-old ban on assault weapons, finding it has no equivalent in early American history and is therefore unconstitutional.
U.S. District Judge Roger Benitez, of San Diego, found that modern semiautomatic rifles such as the AR-15 are common household items used for self-defense by millions of law-abiding citizens in the U.S. and that those citizens may not have their 2nd Amendment rights abridged by the state simply because others may misuse the same weapons in mass shootings and other deadly violence.

Colorado’s law is not just a waiting period on the right to possess peaceably purchased property. It is a delay on safety itself.
On October 1st, 2023, Colorado’s new 3-day waiting period law went into effect as passed by the state’s legislature and Governor Jared Polis, requiring those who purchase a firearm to wait three days before acquiring the gun. That is, once a citizen has passed a federal background check a state background check, and paid for a firearm upfront, the government then mandates an additional 72-hour delay before possessing a firearm. |

California Attorney General Rob Bonta today filed a notice of appeal to overturn a district court decision in Miller v. Bonta invalidating California’s decades-old assault weapons ban, the Assault Weapons Control Act. The U.S. District Court for the Southern District of California found elements of the Assault Weapons Control Act unconstitutional but granted the Attorney General’s request for a stay of the decision to allow the Attorney General to appeal to the U.S. Court of Appeals for the Ninth Circuit. At this time, the assault weapons restrictions, including those applicable to firearms defined as assault weapons under California Penal Code section 30515, remain in effect. |

The vast majority of Americans agree that gun violence has taken too many lives and shattered too many communities. No one should feel safe at school, in their home or work unless as a society we take steps to ensure that firearms are sold and used responsibly as an essential part of improving public safety. However, what has happened is that the gun lobby’s allies in Congress have shut down every attempt to pass critical reform. This epidemic of mass shooting must stop. Enough is Enough. |

The events that are occurring around the world and in the United States re-enforces my decision of owning firearms and training with them on a regular basis. The ownership of firearms for self-defense purposes comes with great responsibility and commitment. I am responsible for everything that my firearm does or doesn’t do. It is my responsibility to educate myself on the local laws pertaining to firearms and the use of them for self-defense. There also needs to be a commitment to get the proper training in the use of firearms and a commitment to continue that training on a regular basis. |

Is Oklahoma set to put an innocent man to death on Nov. 30?
Advocates expressed concern at the possibility during a Thursday press conference at the Oklahoma State Capitol in support of death row inmate Phillip Hancock.
State Reps. J.J. Humphrey (R-Lane) and Kevin McDugle (R-Broken Arrow), alongside Hancock's attorney Shawn Nolan and former chairman of the Oklahoma Pardon and Parole Board Adam Luck spoke at the conference.
They're calling for the pardon and parole board to grant a clemency recommendation and for Gov. Kevin Stitt (R-Okla.) to commute his sentence. |

Vermont is one of the safest states in the country. Radical gun-control legislators in Montpelier don’t want you to know that. In recent years, driven by so-called progressive voices from Burlington, they have mounted attacks on Vermont’s deep-rooted gun-owning heritage. They’ve pushed for eliminating due process for gun owners, introduced arbitrary waiting periods, and implemented magazine bans. The Massachusetts House approved a sweeping gun bill Wednesday aimed at tightening firearm laws, cracking down on unregistered "ghost guns" and strengthening the state's assault-style weapons ban.
The bill, which passed on a 120-38 vote, would also prohibit individuals from carrying a gun into a person's home without their permission and require key gun components to be serialized and registered with the state.
The 125-page bill -- a priority for Democratic Massachusetts House Speaker Ronald Mariano -- is in part a response to a 2022 U.S. Supreme Court ruling that U.S. citizens have a right to carry firearms in public for self-defense. |

Some social media users raised questions about the fair’s firearm protocol in the shooting’s aftermath; for a time, even Big Tex himself seemed confused.
When we checked the fair's FAQ page on Monday morning, contradictory language was used to describe its weapons policy. At one point, the FAQ stated: “No weapons of any kind are permitted on the fairgrounds. This includes firearms …” Shortly after that, the page said that attendees with valid handgun licenses can take their firearm with them, so long as they keep it concealed. |

As the battle over how to apply the Bruen standard rages on nationally, it is perhaps not surprising to find that the Ninth Circuit remains, at least in large part, committed to expanding its reputation for concocting convoluted logic to reach anti-2A rulings. And we saw in recent weeks how procedural tricks can be used to tilt the playing field.

House Democrats have pushed through a new gun-control proposal that calls for updating the state’s ban on “assault” weapons and high-capacity magazines, and setting new restrictions on the open carry of firearms.
The legislation, which was approved Wednesday by a vote of 120-38, will ban untraceable firearms, authorize tracking and monitoring systems for handguns, and set and impose tougher gun licensing requirements, among other provisions. A handful of Democrats joined with Republicans in opposition to the bill’s passage. |

On the other side of the gavel, Republicans have offered little to date. There is one idea that could shorten waiting periods for guns. However, many wonder if the GOP will do what some wanted earlier this year and didn’t get— the permit-less open carrying of guns.
Rep. Bobby Payne (R-Ocala) poured some water on the idea when we spoke earlier this summer. It was after he helped make last session’s compromise happen — permit-less concealed carry.
“If it's concealed, you're not a target,” said Payne. “If you're carrying a gun exposed open carry, which so many wanted open carry, I just think that that makes you a target.” |

A federal judge in San Diego ruled again on Thursday that California’s decades-old ban on semi-automatic weapons violates residents' Second Amendment rights, and their ability to defend themselves from armed would-be criminal assailants.
U.S. District Judge Roger Benitez ruled in a particularly astringent 79 page opinion in the long running case that, under a pair of landmark U.S. Supreme Court rulings expanding gun rights, the prohibition on semi-automatic rifles ownership is unconstitutional. The ruling orders an injunction on state statutes governing the weapons, though the judge granted a 10-day stay requested by the state to allow it to appeal the decision with the Ninth Circuit Court of Appeals. |

In the second week of Illinois’ gun ban registry, of more than 2.4 million Firearm Owner ID card holders, a total of 1,618 have disclosed they own an item banned by the state. A legislator says the registry needs to be put on hold.
Numbers Illinois State Police published for the first week of the registry that opened Oct. 1 showed 1,050 individuals disclosing a total of 3,202 now banned items. For the second week, an additional 568 have filed for a total of 4,678 items, 3,053 of which were banned firearms. |
