The above link is a .pdf file of USDOJ's Petition for Writ of Certiorari in U.S. v. Stewart. The 9th Circuit ruled that the federal government exceeds its authority by enforcing bans against homemade machineguns. Bush's "Justice" department disagrees and wants the Supreme Court to overrule the 9th's decision. Their arguments are on the link above. From that Petition:QUESTION PRESENTED
Whether 18 U.S.C. 922(o), which prohibits the private transfer or possession of a machinegun, is unconstitutional as applied to respondent’s possession of five “homemade” machineguns that he assembled from parts that had previously been shipped in interstate commerce. |

"Last week's elections may have led to victory for more conservatives, but on gun issues, an analysis of the results shows a trend towards greater support for sensible gun laws in some key battleground states that have not shown that support in the past."
"The results show that despite the extremist gun lobby's efforts to make a claim of victory, it actually suffered erosion of support in states where it once commanded clout. The National Rifle Association, post 2004, should be viewed as becoming more firmly dependent on high-performing Republican states as the source of the overwhelming majority of its strength." ... |

... "The battle is now over and advocates of activist government won. Far from reducing the role of government – or even slowing the growth of federal spending – the Bush administration enthusiastically enacts programs that expand the scope and reach of the federal government. From faith-based initiatives in social programs through a budget-busting Medicare drug benefit to the No Child Left Behind Act's nationalization of education, President George W. Bush and his allies in Congress embrace activist government – with a matching price tag. Two teen-age boys have been suspended from Hastings High School for playing with a laser pointer that looked like a derringer pistol.
The boys are 14 and 17 years old. They were suspended last Monday.
Police said the replica derringer had been part of the 14-year-old boy's Halloween costume. The boy apparently brought the fake gun to school to show friends.
A teacher saw a red dot in the hallway and suspected a laser pointer. The teacher later saw that the pointer looked like a derringer -- a small pistol -- and brought the boys to the principal's office.
The school has a zero-tolerance policy that extends to replica weapons. It's possible the boys could face a year-long expulsion. |

The need for mandatory handgun registration in Baltimore becomes more acute with every passing year ("City man, 22, is fatally shot while waiting for bus," Nov. 5).
This was the case of a law-abiding citizen, with no criminal record, waiting for a bus in a relatively safe section of Northwest Baltimore. He was shot in the head by an unidentified person who then fled. The victim thus became the 246th homicide of the year.
Isn't it time for the citizens of Baltimore to demand that every handgun owner be required to register annually? -------
