Gun Facts: Yelling 'FIRE' in a crowded theater

"I've always found the 'can't yell fire in a crowded theater' argument to be a false one, and invalid on most fronts." ...

"Given the above, what the 'fire principle' actually details is the prohibition of 'endangering behavior'. When one exercises a reserved right in a manner that deprives others of their rights (such as the right to life being squashed by a stampeding audience), then the conflict of rights must be resolved."

"The comparison breaks down further when it is noted that the 'yelling fire' prohibition requires the act to be committed first, whereas most gun control legislation creates prohibitions or bureaucratic hoop-jumping exercises in advance of an endangering act . . . that might never happen (for those who like the legal terms, we are talking about 'prior restraint')." ...

"The Illinois Senate on Tuesday overrode the governor's vetoes of a controversial gun bill and a measure to boost truck speed limits ..."

"Each of those actions must still be approved by the other chamber."

"SB 2161 was prompted by an incident in the Chicago suburb of Wilmette, where a man was charged with violating a municipal handgun ban after he shot a burglar in his home. The bill would allow a court to clear a defendant of charges of violating such a ban if the gun was used in self-defense or in defense of another on the owner's property." ...

"The bill now heads to the House, where it must get at least 71 votes in order to become law in spite of the governor's objections. It got 90 votes in the House in May." ...

"Had it gone as allegedly planned, Gilbert and Chandler would have been thrust into the national spotlight with alarm bells ringing."

"The assault-weapons ban controversy and memories of the Columbine tragedy would have taken center stage as the American media converged on the southeast Valley. Arguments over the U.S. Constitution's Second Amendment would have been rehashed, ad nauseam."

FULL TEXT BELOW:

A man told Richland County deputies he shot to death a hitchhiker Monday who tried to rob him at gunpoint, Sgt. Chris Cowan said.

Gregory T. Olden, 41, of Columbia bled to death from two gunshot wounds in his back, said Ted Kennedy, Richland County chief deputy coroner.

No charges have been filed against John Sox who said he picked up Olden on Beatty Road Monday night, Cowan said.

Sox said Olden tried to rob him and told him to get in the rear cab of his pickup truck, Cowan said.

Sox, 64, of Irmo, had a gun hidden in the back of the truck and said he shot Olden in self defense at about 10 p.m., Cowan said. The shooting happened in the parking lot of an apartment complex at 3130 Kay St., off Beatty Road in the St. Andrews area, Cowan said.

The incident remains under investigation.

In choosing between solutions that actually work and those that have never worked, the writer of the letter "It's time for the city to register handguns" (Nov. 9) selects an old remedy that has never worked in reducing crime - mandatory handgun registration.

The criminals never register their illegal handguns, and studies show that these gun control measures fail to protect the citizens from the violent criminals responsible for the number of homicides a city such as Baltimore suffers year after year.

However, studies have shown that states with "shall-issue" concealed-carry laws have reduced violent crime. So isn't it time for Maryland to join the other "right to carry" states and pass such a concealed-carry law?

"I’d like to counter a few claims made by Adam Noble in his letter, "Firearms have no place on Campus" (Thursday). First, regarding personal ownership and carry of handguns. It has been proven statistically that when states stop prohibiting concealed carry, crime rates drop. Why, because criminals prefer targets that they know are helpless."

"Second, there are several problems with depending on the police and the military for your safety. They can only protect you if they are already there. The courts have established that they have no legal responsibility for your safety. They have proven that they are no more likely to be pillars of virtue than the average person. Many examples of this can be found in the news (or at www.keepandbeararms.com) without looking very hard." ...

In October the justices of the U.S. Supreme Court declined to review an unsuccessful challenge to a 1999 Alameda County law barring gun shows on its property.

Now it's time for our elected leaders to demand an end to gun shows held at the Contra Costa County Fairgrounds in Antioch. Visit a gun show there and you will find a thriving business of young men lined up to buy handguns.

I resent and dread the proliferation of handguns in our communities, and their sales conducted on public property supported by my taxes.

The Antioch fairgrounds are on state property controlled by the state fair board, precluding local control of what takes place there. Our local elected officials should persuade the state fair board to ban gun shows on public property, specifically the fairgrounds in Antioch.

 QUOTES TO REMEMBER
The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of a republic; since it offers a strong moral check against the usurpation and arbitrary power of rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them. — Joseph Story, Commentaries on the Constitution of the United States; With a Preliminary Review of the Constitutional History of the Colonies and States before the Adoption of the Constitution [Boston, 1833].
