NY: Judge Stays New York City's Suit Against Gun Industry

"A federal judge in Brooklyn on Monday stayed New York City's lawsuit against gun manufacturers as he prepares to consider whether recently passed legislation bars such claims."

"In a brief order, Eastern District Judge Jack B. Weinstein put the Nov. 28 trial on hold. On Nov. 21, he will have a hearing to consider the gun industry's motion to dismiss the suit, which alleges that the sales and marketing practices of gun makers allow criminals to obtain guns, creating a public nuisance."

"Monday's ruling came two days after the gun industry petitioned the 2nd U.S. Circuit Court of Appeals for a writ of mandamus directing Weinstein to vacate the trial date and stay the case. Weinstein had previously agreed to hear arguments on the newly enacted legislation, but did not decide until Monday to vacate the trial date and impose a stay."

"This past legislative session has been good for Blagojevich and his gun control allies. He vetoed two NRA-backed initiatives that would have destroyed the firearm purchase database and made it easier for some convicted criminals to own guns. He also vetoed a House bill that would have eliminated the waiting period for gun owners that trade firearms."

"It is amazing to me that some of these bills even passed through the state assembly in the first place. It just goes to show the clout the NRA has. I realize that most gun owners are law-abiding citizens who pose no threat to public, but guns are very dangerous and can cause catastrophic damage if handled irresponsibly. The state keeps track of all automobile owners, most of whom are law-abiding citizens, through a database. There's no reason why we should not have a similar system for gun owners."

1 - The right to keep and bear arms is specifically mentioned in the Constitution. Your right to own a car or drive is not.

2 - Registration has not stopped accidents or vehicular homicides. It was never meant to do so. It was a way to track stolen vehicles.

"A. The industry being defended is the industry as a whole, not any particular company;

"B. The threat to that industry comes from numerous local governments set out to abuse the tort system;

"C. The issue at hand directly relates to one of the Amendments to the Constitution in the Bill of Rights; and

"This has gotten me to thinking about Proposition H. Sure, it's currently being challenged by the National Rifle Association (Motto: Don't make us shoot you), but it doesn't mean that some GOOD things can't come from this measure."

"One man is dead and another is in the hospital after a Delaware homeowner shot them."

"Police said Thomas Morganstern, 60, was sleeping in an upstairs bedroom of his Roselle home when two men entered his home early Thursday morning. Morganstern, who is an avid hunter, grabbed a handgun and chased the men downstairs. Police said the men fired on Morganstern in the living room area and he shot back."

"Morganstern was not injured and he called police and reported the home invasion and shooting."

"Susan Gaylord Buxton, 66, said she's a good shot and could have killed the man because her gun instructors taught her well. Instead, she said, she aimed for his leg and fired a second shot to warn him as he hobbled off."

Police arrested a student at another Delmarva school for pointing a handgun at a 75-year-old-woman.

The gun later turned out to be a toy. This happened in the parking lot of South Dorchester High School in Cambridge. Officers say they didn't realize it wasn't real until after the arrest.

The 17-year-old still faces second degree assault and reckless endangerment charges.

Earlier in the year, officers arrested three 17-year-olds for bringing a pair of rifles on school grounds.

This morning, police are investigating two cases of kids with guns threatening their classmates.

A 9th grader at Terry Parker High is under arrest for bringing a loaded gun to school. Police say the 15-year old was arrested yesterday in the dean's office reading a bible.

The student told police he was reading because he was afraid he was going to do something.

Police say the student told a friend that he brought the gun to school to protect another classmate.

A 15-year-old Boone County high school student has been charged after bringing a gun to school and trying to sell it.

Boone County say the teenager gave the gun to another 15-year-old last Friday at the school in Florence.

The recipient was supposed to give $10 to that teen as a handling fee, then $120 to an 18-year-old, whose father owned the gun.

The 18-year-old's father realized the gun was gone Sunday and called police.
