Right here, in pdf. Author raises the point that the present test for self defense (did the defender reasonably believe he was in danger or lethal danger?) misses much of true self defense. I.e., when the defender is attacked by surprise and reacts by reflex, not really having a belief about anything. Courts generally treat that as self defense anyway, but the author suggests we ought to modify the doctrine to fit. He also notes that German law is more liberal toward self-defense; a person under criminal attack is not required to use only a reasonable amount of force, but rather is allowed to use force unless it is grossly disproportionate to the attack. |

Kennebunk Police Officer Chris Russell will be in York District Court on Nov. 13 to face arraignment on a charge of operating under the influence of alcohol.
Russell was charged following a single-car accident Aug. 19 in Wells.
The department's juvenile officer and senior citizen liaison, Russell has been on paid administrative leave since the accident.
Any officer charged with a crime may face censure from the Maine Criminal Justice Academy, which could include losing certification as an officer.
Russell also could receive a waiver from the Academy to remain an officer, with a conditional three-year license that comes with conditions the officer must meet. The KPD is conducting its own internal investigation. |

Cape Breton Regional Police have once again arrested and charged one of their own officers.
Const. James Lloyd Riggs, 40, faces two counts of criminal harassment and one count of trespassing at night.
The charges stem from an investigation into a complaint from a woman in the Alder Point area.
Riggs, a 15-year veteran of the force, has been suspended with pay and is scheduled to appear in provincial court Jan. 26.
Earlier this year, regional police charged Const. Jason Doyle, 30, with two counts of criminal harassment involving two women.
He is scheduled to stand trial in May. |
