QUEENS, NEW YORK -- "Queens prosecutors 'jumped the gun' when they charged an auxiliary cop with stockpiling weapons in his Forest Hills home, a lawyer for the man said yesterday."

"Phillip Bernstein - charged with 82 felony counts for illegally possessing an 'arsenal' of 16 firearms, including shotguns, handguns and assault rifles in July - pleaded guilty to just a disorderly conduct charge Oct. 4 after prosecutors realized he had gun permits for all the weapons."

"Judge Dorothy Chin-Brandt ordered Bernstein to pay $60 in court costs, keep out of trouble for a year and stay away from his former girlfriend."

"A dispute with the girlfriend - who said he'd pulled a gun on her - led cops to confiscate the weapons from Bernstein's home June 26."

"Defense lawyer Brian Griffin said the DA should have acted sooner to clear the name of his client, a lawyer who moonlights as an auxiliary cop and is also a certified firearm safety instructor and antique gun collector."

" 'It's clear that he was never a danger to anybody,' Griffin said."

The shooting occurred on May 1 following a car chase involving the victim, Egbert Dewgard. The suspect had crashed his car and was trying to flee on foot when Tanella, his gun drawn, tackled him, authorities said.

Grand jury witnesses testified that during an ensuing struggle, Tanella shot Dewgard in the back.

A call to the DEA was not immediately returned.

"Whenever concealed-carry permit holders go awry, as Robert S. Flores did Oct. 28 when he carried five handguns and 200 rounds of ammunition into a University of Arizona nursing school and killed three teachers and himself, the gun lobby and its supporters call it an aberration. While the incident in Tucson was unfortunate, they say, it must be measured against what they claim is concealed-carry laws' greater good: They deter crime." ...

Here's the kicker, which will surely fall on its face when held to the light of honest, critical review:
"While there might have been some superficial statistical evidence that supported Lott when he did his initial work, now that we've got the experience of the `90s behind us, we see that we'd gotten these huge drops in crime everywhere--much bigger in the states that did not adopt these laws," Donohue told Join Together Online. He said that supporters of concealed-carry laws "are not enthusiastic about noting that crime fell more in the states that didn't adopt these laws. So they just look at the states that passed them and say, `Look at how crime fell.' "
We sure look forward to seeing Mr. Lott's response to these people's work. If their "research" is anything like Emory professor Michael Bellesiles', they might consider looking for new work.
