Our Constitution established a list of “negative” rights; things government is prohibited from depriving citizens of without due process. For example, the First Amendment protects the freedoms of religion, speech, the press, peaceable assembly, and petitioning government for a redress of grievances. The Second Amendment protects our right of self-defense, the Fourth our right to personal property. And so on.
In each case, the right is protected simply by having government leave us alone. In fact, of all the rights protected by the Constitution, the only one requiring a positive action by another citizen is the right to a trial by a jury, for which jurors are compensated. |

Should you be allowed to carry a gun at the beach as long as you've got a fishing pole?
It's a loophole that the Palm Beach Police Department Chief Nicholas Caristo wants to close and it has some gun owners seeing red.
Right now under Florida law, if you go fishing, you can openly carry a gun to the beach or the lake or wherever the fish are. |

After dropping an attempt to keep secret the identities of two plaintiffs, the National Rifle Association has relaunched a federal court challenge to a Florida law that raised the age to purchase rifles and other long guns.
The NRA filed the lawsuit last year, immediately following the passage of a sweeping school-safety law enacted in response to the mass shooting at Parkland’s Marjory Stoneman Douglas High School that killed 17 students and faculty members. |

Maryland has gotten the NRA’s attention. The National Rifle Association is backing an appeal to the Supreme Court that claims the state’s concealed carry law is too restrictive.
As is stands now the applicant needs to provide good and substantial reasoning as to why they need to conceal carry. According to Bob Arthur, owner of Arthur’s Shooters Supply in Berlin those accepted reasons can be that you’re a business owner with cash flow, you’re an assumed risk professional like a judge or security guard or that you’re a threatened or victimized individual. |

To his credit, Sen. Bernie Sanders (I-Vt.) has once again injected some much-needed sanity into a Democratic presidential primary. Speaking at a November 10 campaign rally in Charles City, Iowa, the candidate was asked about his opinion on a “mandatory buyback” (properly understood as confiscation) of commonly-owned semi-automatic firearms like AR-15s. Sanders responded by stating, “I don’t support, a mandatory buyback is essentially confiscation, which I think is unconstitutional.” The senator went on to add, “It means that I am going to walk into your house and take something whether you like it or not. I don’t think that stands up to constitutional scrutiny.” |

After the Texas Legislature failed to act this session to protect the rights of law-abiding gun owners, a growing number of Texas counties are declaring themselves Second Amendment “sanctuaries.”
In the past week, seven Texas counties, including Metroplex-area Kaufman, passed resolutions affirming citizens’ right to keep and bear arms, as protected by the U.S. and Texas Constitutions. The total is now 15, and more counties are set to join the list. |

The County Commissioner’s Court held Tuesday, Nov. 12, found unanimously for Stephens County to be added to the list of counties in Texas to adopt the Second Amendment Resolution.
This ensures the safety of the members of Stephens County against the threats made by Democratic presidential candidate Beto O’Rourke, or anyone else who may try to confiscate assault-style weapons. |
