CA: Censoring Gun Owners

But those opposed to our right to keep and bear arms ignore the fact that the Second Amendment acts as a bulwark for all of our freedoms, protecting our other rights from legislatures, in courts and in public opinion.

California’s legislature and governor just unwittingly showed us that, indeed, the Second Amendment is a cornerstone of American liberty. Last June, a majority of California’s legislators passed, and Gov. Gavin Newsom (D) signed, AB 2571, a bill titled “Firearms: advertising to minors.” This legislation, now a law, is a direct assault on the First and Second Amendment rights of residents of California.

Right now, guns are still banned throughout the state in just about all public places — except for places of worship in some circumstances. But as these cases move through the courts, the rules about where people can bring guns and what requirements gun owners must meet to obtain a carry permit remain in constant flux. Gothamist has created a case tracker to keep New Yorkers up to date on where they can expect permit holders to be carrying guns, as well as what requirements still stand for concealed carry permit applications. It will be updated regularly.

Ed.: From the anti's, but a fairly reasonable overview of where things stand as litigation proceeds.

Across the country, openly carrying a gun in public is no longer just an exercise in self-defense — increasingly it is a soapbox for elevating one’s voice and, just as often, quieting someone else’s.

This month, armed protesters appeared outside an elections center in Phoenix, hurling baseless accusations that the election for governor had been stolen from the Republican, Kari Lake. In October, Proud Boys with guns joined a rally in Nashville where conservative lawmakers spoke against transgender medical treatments for minors.

State Rep. Kyle Koehler, R-Springfield, introduced House Bill 383 in August 2021 and it has been in the House Government Oversight Committee ever since. It came up for hearings in October 2021, December 2021 and May 2022, but not again until Nov. 17, and has not received a committee vote. In the course of hearings he replaced the original with a closely related substitute bill.

But Koehler said House Speaker Bob Cupp, R-Lima, told him it could get a committee vote Tuesday and pass the full House later in the week. Indications from the Senate are positive, he said; but in that chamber the bill would have only about three weeks to get through committee hearings and a floor vote if it’s to reach Gov. Mike DeWine’s desk by year’s end.

Biden takes aim at most of America’s guns

President Biden just said he wants to “get rid of” tens of millions of firearms owned by law-abiding Americans. Biden, of course, is not known for making sense when it comes to guns (this was true even pre-senility), but his latest rant can’t be dismissed as another glitch in the ol’ gaffe machine.

“The idea we still allow semiautomatic weapons to be purchased is sick. It’s just sick. It has no social redeeming values. Zero. None. Not a single, solitary rationale for it except profit for the gun manufacturer,” Biden said on Thanksgiving Day. He added, “I’m going to try to get rid of assault weapons.”

With a trio of high-profile mass shootings in Virginia and Colorado in the last two weeks, we wanted to find out what safety measures are being taken for the public and vendors at the fairgrounds this weekend.

About 700 vendors are getting ready for the Florida Gun Shows in Orlando this weekend.

Nearly 10,000 people are expected to attend the two-day event at the Central Florida Fairgrounds, the last one this year in Orlando.

"The number one thing at Florida Gun Shows is safety and security and one of the unique things with Florida Gun Shows is that we require anyone selling guns here to be a federally licensed dealer," Robert Geisler, the Florida Gun Shows general manager, said.

MD: Should failing to pay child support bar a person from having a gun?

Maryland’s highest court has agreed to weigh the constitutionality of state laws that bar gun possession by a person sentenced to more than two years in prison for a nonviolent crime — in this case, a man whose failure to make child-support payments set off several legal events that left him ineligible to carry a firearm.

Strictly speaking, it wasn’t just Robert L. Fooks’s adjudicated financial neglect as a parent that made it illegal for him to have a gun. The problem was, according to court records, his child-support delinquency so angered a judge on Maryland’s Eastern Shore in 2016 that Fooks, now 53, was sentenced to four years behind bars for “constructive criminal contempt of court.”

The Oregon Firearms Federation, along with the Sherman County sheriff and a Keizer gun store owner, late Wednesday night filed an emergency motion seeking to bar Oregon’s gun control Measure 114 from taking effect Dec. 8.

On Thursday morning, U.S. District Judge Karin J. Immergut scheduled a hearing on the motion for Dec. 2, six days before the measure is scheduled to take effect.

On November 22, 2022, eleven weeks after the case was filed, Judge John L. Sinata, Jr. posted a decision and order on the request for a preliminary injunction.
The decision struck down the private property ban on carry.

Preliminary injunctions are granted when the Plaintiffs are likely to succeed on the merits, irreparable harm would result without the injunction, and the public interest would be served.
Any time interval of infringing on fundamental, Constitutionally enumerated rights is considered to be irreparable harm.

The decision and order found the ban on carrying on private property, without the express consent of the property owner, was unconstitutional. From the decision:

Less than two weeks remain for Oregon officials to hammer out a complex permitting regime for firearm ownership under Measure 114, and that could put the state in a constitutionally precarious spot.

Some gun rights advocates worry that if a permit mandate takes effect before a process is in place to acquire those permits, it could halt gun sales in Oregon.

When President Joe Biden speaks about the "scourge" of gun violence, his go-to answer is to zero in on so-called assault weapons.

America has heard it hundreds of times, including this week after shootings in Colorado and Virginia: The president wants to sign into law a ban on high-powered guns that have the capacity to kill many people very quickly.

"The idea we still allow semi-automatic weapons to be purchased is sick. Just sick," Biden said on Thanksgiving Day. "I'm going to try to get rid of assault weapons."

A gun rights group, sheriff and gun store owner filed an emergency motion in federal court late Wednesday seeking to stop enforcement of one of the strictest gun control laws in the nation.

The gun control measure narrowly approved by Oregon voters is set go into effect on Dec. 8. U.S. District Judge Karin Immergut on Thursday scheduled a hearing on the motion for Dec. 2. The state has until next Wednesday to file a response to the emergency motion for preliminary injunction.

The Oregon Firearms Foundation, Sherman County Sheriff Brad Lohrey and Adam Johnson, owner of Coat of Arms Firearms, filed a federal lawsuit against the Oregon governor and attorney general on Nov. 18 saying Measure 114 is unconstitutional.

A U.S. Navy officer stationed in Hawaii cannot be denied a firearms permit solely because he sought counseling for feeling depressed and homesick, a federal judge ruled.

Michael Santucci, a cryptologic warfare officer from Fort Myers, Florida, saw a medical provider at a military hospital for feelings of depression and homesickness a few months after arriving in Hawaii last year, according to his lawsuit, filed in April.

He wasn’t diagnosed with any disqualifying behavioral, emotional or mental disorder, the lawsuit said.

He later filled out forms to register his firearms with the Honolulu Police Department and indicated that he had been treated for depression, but noted it was “not serious.”

We can challenge people in a position to do something meaningful. Write or call a member of Congress and say you respect the Second Amendment but it shouldn’t block a ban on weapons made for war, or red flag laws, or expanded background checks.

Earlier this year, Congress passed and President Biden signed a measure sending $750 million to states for crisis intervention efforts, which could be used to establish and operate red flag programs. That new law, passed with bipartisan support, “represents the most significant federal legislation to address gun violence” since the 1994 assault weapons ban, CNN reported.

We should bring back the assault weapons ban.

Federal District Judge David Counts in the Western District of Texas has ruled the controversial federal law banning gun possession by a person who has been served with a restraining order for domestic violence is unconstitutional under the Second Amendment.

The statute in question is 18 U.S.C. § 922(g)(8). This statute makes it a crime to possess a firearm if the person is subject to a court issued restraining order about domestic violence. The maximum term of imprisonment for violation of the statue is up to 10 years in prison. The actual wording of 18 U.S.C. §922(g)(8) is this:

Walsh was joined in a recent 97percent annual conference panel centered on the “roadmap” with other names associated with “gun rights,” including trainer and former Brady Campaign president ally Rob Pincus, the Heritage Foundation’s “properly crafted red flag”-endorser Amy Swearer, and Stephen Gutowski of The Reload and now of CNN, all joining in to “legitimize” the show and demonstrating, wittingly or not, how “inclusive” those paying for it are. (Just to clarify: I do hope Gutowski continues to use his elevated platform to the best effect possible, and I support his efforts to educate a wider audience, but I also believe there’s something in it for “them” in terms of steering the direction of the discourse.)

CNN Is Mute as Biden Still Doesn't Understand Meaning of 'Semi-Automatic Weapons'

Joe, let's keep this simple for you. Here's the Cliffs Notes version of the meaning of a "semi-automatic weapon:" you pull the trigger, it fires one round. Got that?

Many popular hunting rifles—not just "assault" rifles but also the non-scary-looking ones—are semi-automatics. And the great majority of pistols are semi-automatic, as well.

Americans already lawfully own countless millions of such weapons. Would Biden make it illegal to buy a typical deer rifle? Or make criminals of individuals who for reasons of their own decide to sell such weapons?

INEC in the new guidelines said no political party member or supporter must bear arms during campaigns except the Nigerian police.
Accordingly, it urged political parties to make registered voters the targets of their campaigns.
INEC advised the parties to make their programmes, policies, and projects available to voters.
The guidelines read in part, “The target audience of political campaigns shall be registered voters.
“No person attending a political campaign shall be in possession of any offensive weapon, except a Police Officer or a member of a security agency authorised to carry arms and is specifically posted to be present at that political campaign.”

Last I checked, a shotgun with a 30-inch barrel was not designed for the battlefield. Ninety-nine point nine per cent of the weapons listed in the (government’s) ban were not designed for war. The only rifles in Canada that ever saw war were the SKS and the M1 garand, back in the First Worlds War. (They were) plain jane, old, wood-stock, semi-automatic centerfires.

...

We don’t have assault weapons in Canada, regardless of what the (prime minister) says. He is just using scary words and renaming our legal firearms to freak out those who don't know better. That is called lying. What a surprise from this regime.

U.S. President Joe Biden celebrated Thanksgiving on Thursday by announcing his plans to ban all semi-automatic firearms. The Second Amendment, which protects Americans’ right to bear arms, has once again come under fire following recent high-profile shootings.

Biden made his remarks in the wake of a mass shooting at a gay nightclub by a man who identifies as “non-binary” with “they/them” pronouns.

A report out of Chicago shows a woman whom four people attempted to carjack fought back and shot one of the men who attempted to carjack her. Another of the suspects shot back, striking her in the arm.

A group of four men in the area of 89th Street and Kenwood Avenue, in the Calumet Heights neighborhood, must have thought a young woman sitting in her car around 2 a.m. would be an easy target. However, when they attempted to allegedly carjack her, they found out quickly that she had no intention of being anyone’s victim.
