Why The Innocent Flee From The Police

... "Given that police claim the supposed authority to pre-empt potential violence in the name of 'officer safety,' we're entitled to ask: Why isn't 'citizen safety' a legally effective defense for preemptive violence by law-abiding people to protect themselves against unjustified violence by police?"

"At present, the only form of 'preemption' considered legally and morally acceptable is unqualified submission. People wrongfully on the receiving end of police violence are given the same advice that used to be given to potential rape victims: Don't resist, don't fight back -- it will only turn out much worse, and you may be killed." ...

"Governance in this country is really nothing more than service to the electorate. We govern ourselves by way of executives we hire to do things for us on our authority, and it is nothing more. It is not any greater wisdom of theirs, it is not greater information, and it is not greater knowledge. It is in other countries, but not here."

"Public servants operate in the United States under supervision and consent; ours. They do not supervise us, we supervise them. When they squawk about this, we have an indicator of a real problem, and more problems to come. Their refusal to honor the wishes and sometimes demands of the electorate signals their intention to rule us and not the other way around." ...

"The forcible citizen disarmament lobby is well aware that they're unlikely to win the War on Guns in the immediate future. That's alright with them, though, because they have the patience to fight the long war. One of the fronts on which they fight the war on private gun ownership is the push to make gun ownership less, well . . . private."

"We see it with the efforts to close the mythical 'gun show loophole,' which is not only not a 'loophole,' but is also not confined to gun shows--they want to ban all private sales, whether at gun shows or not."

"Heading off another manifestation of this attack on gun owners' privacy is the purpose of a bill introduced in Florida ..." ...

Does Padilla shooting mean athletes should swear off guns?

"We saw a poor example of athletes and guns recently, with Plaxico Burress negligently shooting himself, and then having New York City add insult--and a two year sentence--to injury. Now Los Angeles Dodgers pitcher Vicente Padilla gives the image of atheletes and guns another shot in the...uh...leg."

"Depending on which news source you consult, he was in Nicaragua when he shot himself at a firing range. No, he shot himself while hunting. No, it was his instructor who shot him."

"Oh, and guess what?"
"He handed the pistol to a shooting instructor, a former police captain, who didn't realize there was a bullet in the chamber and shot himself in his hand ... The bullet grazed the pitcher's leg." ...

Time Will Only Prove Folly Of New Gun Law For U.S. National Parks

"Always, the first question responsible legislators should ask when writing a law is this: What significant problem is being solved by putting another code on the books?"

"This is the nut of a conundrum now before the U.S. National Park Service as it prepares to deal with a new gun law ..."

"It caught many by surprise. Public Law 111-24 will allow tourists, beginning in 2010 if not sooner, to openly tote the legal gun of their choice through national parks such as Yellowstone, Grand Teton and other bustling crown jewel preserves."

"In contrast to how the legislation was originally proposed, it is not a provision that only empowers licensed individuals with concealed weapons permits." ...
-------

Submitter's Note: Nope, it just says that state laws apply to the parks (which actually is "how the legislation was originally proposed"). Just because your MSM buddies are idiots who didn't do their research, don't blame us gunnies.

"In a November 3 Washington Post article about increased sale of guns and ammunition since the election of President Barack Obama, Wayne LaPierre, Chief Executive Officer of the National Rifle Association, said something curious. Asked to explain this buying spree, he stated, 'I think it's Katrina. I think it's terrorism. I think it's crime. And I also think that it's people worrying about [whether] they'll be attacked by politicians. They're suspicious, and justifiably so.'"

"Americans are stockpiling handguns, assault weapons and ammunition because they are going to be 'attacked by politicians'? Attacked how? And exactly what kind of 'defense' are these individuals planning?" ...

Submitter's Note: Well Josh, if you and your ilk don't start a civil war, then you will never have to find out, will you.

"The philosophy of self-reliance seems to have always been a curiously American trait and one that evidently still strongly exists in the cultural gene pool, despite what some would argue have been energetic efforts by do-gooder social engineers to wipe it out."

"Simply put, the roster of would-be robbers who discovered the hard way that they have made a terribly flawed choice in the victim selection process would probably fill a library. Like it or not, America is an armed society, and they know how to fight back when the chips are down." ...

"At the time of the revolutionary war one of the serious burdens that americans faced was the organized disarmament of the citizens of Boston which led to the later opression of those, then defenseless, citizens."

"The fact that guns are effective killing devices encourages many people to feel that the guns themselves are evil rather than giving credit to those who use them for evil or for good. They also rarely have any knowledge that firearm statistics are routinely manipulated and misrepresented - even the U.S. Centers for Disease control include suicides in their gun death statistics (which geatly inflates the apparent death toll). ..." ...

"ABC News is reporting that a murderous rampage killing was carried out today at Texas' Ft. Hood Army base by American Army Major Malik Nadal Hasan."

"... eleven soldiers were killed and 31 wounded in the shooting. Hasan was also killed in an exchange of gunfire with a civilian police officer, and two other suspects, who are also soldiers, have been apprehended." ...

"One would like to think that, of all the government-controlled properties in America that have been turned into 'no-guns' victim zones, our Army bases would not be among them."

"If you thought that, however, you thought wrong."

"According to a source quoted by ABC News, 'it is rare for firearms to be on the base because they are locked up.' ..." ...

"Two community college students who favor carrying concealed weapons are challenging their school's restrictions on campus protests."

"Clayton Smith and John Schwertz Jr. announced Thursday that they have filed a federal lawsuit in Dallas against the Tarrant County College District. They contend the college system restricts their First Amendment rights by controlling the time, place and manner of protests."

"The students plan to participate in a nationwide demonstration next week known as 'empty holster protests,' calling attention to policies forbidding concealed weapons on campus. School officials limited the protest to a designated area and prohibited students from wearing empty holsters." ...

"According to a report published on the Tenth Amendment Center's web site, 'Introduced in the Ohio House on October 16, 2009, the 'Firearms Freedom Act' (HB-315) seeks 'To enact section 2923.26 of the Revised Code to provide that ammunition, firearms, and firearm accessories that are manufactured and remain in Ohio are not subject to federal laws and regulations derived under Congress' authority to regulate interstate commerce and to require the words 'Made in Ohio' be stamped on a central metallic part of any firearm manufactured and sold in Ohio.'"

"The report went on to say, 'While the HB315's title focuses on federal gun regulations, it has far more to do with the 10th Amendment's limit on the power of the federal government ..." ...

"Chicago aldermen with their noses out of joint Friday demanded to know why they are searched along with the masses at the city's central headquarters for administrative hearings."

"Scott Bruner, director of Administrative Hearings --the department Chicagoans love to hate -- was put through the wringer again during City Council budget hearings, but for different reasons."

"Normally, Bruner gets pummeled for presiding over a 'kangaroo court' of rude, cavalier and predominantly white hearing officers who don't give the accused a fair shake, critics say."

"This time, he was ambushed by aldermen, some of them attorneys, who show up at 400 W. Superior and are searched and put through metal detectors like everyone else." ...

"A Cook County judge today threw out an indictment against a Chicago Police officer accused of falsifying drunken driving arrests."

"Judge James M. Obbish said prosecutors were wrong to rely on statements Officer John Haleas gave to police investigators during an internal investigation of his conduct."

"Under union rules, such statements cannot be used against an officer in a criminal case, the judge said, ruling on a defense motion to dismiss the case."

"Haleas received a one-day suspension as a result of the internal department investigation. He was criminally charged in 2008 with perjury, official misconduct and obstructing justice, and was stripped of his police powers." ...

"Do prosecutors have total immunity from lawsuits for anything they do, including framing someone for murder? That is the question the justices of the Supreme Court face Wednesday."

"On one side of the case being argued are Iowa prosecutors who contend 'there is no freestanding right not to be framed.' They are backed by the Obama administration, 28 states and every major prosecutors organization in the country."

"On the other side are two black men — Terry Harrington and Curtis McGhee — men who served 25 years in prison before evidence long hidden in police files resulted in them being freed." ...

FULL TEXT BELOW:

Jefferson Parish Sheriff Newell Normand said Wednesday a deputy was fired and charged with aggravated rape and abuse of office.

Normand said 36-year-old Brett Casimir was arrested shortly after 2 p.m. Wednesday.

Normand said Casimir made a traffic stop around 4 a.m. Wednesday. The driver had an attachment out for her arrest. Normand said Casimir told the driver he would not arrest her if she performed a sex act.

Normand said, after questioning, the deputy admitted wrongdoing.

Casimir joined the Jefferson Parish Sheriff's Office in September of 2007. He began patrolling in the second district in April of 2008.

"The amazing video below was taken on October 19 in Arizona's Maricopa County Superior Court."

"As defense attorney Joanne Cuccia discusses her client's sentencing hearing with the judge, Maricopa County Sheriff's Department detention officer Adam Stoddard walks up behind her, and begins sifting through one of her files, which she has placed on the defense table. Remarkably, Stoddard then removes a document from the file and hands it off to another deputy, who then leaves the courtroom with it. They don't even bother to inform Cuccia, who has her back turned the entire time. The judge appears to have missed the incident as well."

"But it was all captured on video:" ...

"The right of Oregonians to use marijuana for medical reasons and also to obtain concealed handgun permits is being challenged by local sheriffs who say federal law prevents those people from packing heat."

"The Middlesex district attorney's office argued today in the state's highest court that a state law that requires trigger locks on stored guns is valid. But the attorney for a Billerica man charged with keeping his guns unlocked said the law should be invalidated by a recent decision of the US Supreme Court."

"While the Supreme Court struck down a tough handgun ban last year in the District of Columbia, the court 'went out of its way to make clear that the right to bear arms, like all rights, is not unlimited. It can be curtailed by regulatory measures,' said Assistant District Attorney Loretta M. Lillios." ...
