No, said an Eighth Circuit panel in U.S. v. Jackson earlier this year; yesterday, the court refused to rehear the case en banc, so the answer is still no in the Eighth Circuit. Judge David Stras, joined by Judges Ralph Erickson, Steven Grasz, and Jonathan Kobes (a total of four of the eleven judges on the court), dissented from the denial of rehearing:

I have no special affection for felons either, but the Second Amendment does not care. It says what it says, and so do the Supreme Court decisions interpreting it. See generally U.S. v. Rahimi (2024); N.Y. State Rifle & Pistol Ass'n v. Bruen (2022). And what Jackson [II] [the panel decision] says about as-applied challenges conflicts with both.

A Colorado law banning gun sales to people younger than 21 can now take effect, a federal appeals court ruled Tuesday.

The 10th Circuit Court of Appeals overturned an injunction in the lawsuit and ordered the case be sent back to the district court for further consideration.

Gun-rights organization Rocky Mountain Gun Owners and two men younger than 21 filed the lawsuit against Gov. Jared Polis in 2023, claiming that the law recently passed by state lawmakers infringed on their Second Amendment right to bear arms.

The silver lining of Donald J. Trumps re-election as the 47th President Tuesday is that for the next two, and possibly four years, he will be able to fill federal court vacancies, including any open seats on the U.S. Supreme Court, with Second Amendment-friendly judges and justices.

It was a repudiation of the policies of anti-gun President Joe Biden and his equally anti-gun Vice President Kamala Harris. It was also a triumph over Democrats from the Biden-Harris administration on down who had waged a war against the former president beginning when he first took office in 2017 and have not relented over the past four years in an effort to prevent him from running for another term.

On Friday, NRA-ILA and other sportsmens groups filed a formal protest against the Biden-Harris administrations plan to close recreational shooting access to 1.3 million acres in the Bears Ears National Monument in Utah.

Last month, the Bureau of Land Management (BLM) announced a final Resource Management Plan that directs the closure of 1.3 million acres to recreational shooting in the Bears Ears National Monument in Utah. NRA-ILA, joined by other members of the Hunting and Shooting Sports Roundtable, filed a formal protest against the management plan.

Such a sweeping closure throughout Bears Ears fails to comply with a 2019 law specifically written to head off such actions by the federal government.

An 11-year-old girl in Boulder, Colorado, escaped a kidnapping attempt by hitting her assailant with a tree branch in self-defense, according to law enforcement.

The girl was walking to school on Oct. 28 when an unknown man riding a bicycle began following her. He then grabbed her shoulder upon catching up with her, reported WLBT3.

The girl, who instinctively picked up a tree branch, started hitting the man with it until he let go. She then sprinted to school and later informed her mother of the incident, police said.

"The child ... grabbed a tree branch and hit the man, which caused him to let go," the Boulder Police Department said in a news release. "The child then ran to school."

The final investigation report concludes that Jason Sanchez (age 23) shot and killed Samuel Lozada during an altercation in a parking lot in the vicinity of 25 Nordic Wilderness Road, Bartlett. Mr. Lozada and Mr. Sanchez were both armed with pistols, and both shot each other. Mr. Sanchez claims that he acted in self-defense.

The report concludes that based on the totality of facts and evidence in the case, the State cannot disprove Mr. Sanchezs self-defense claim beyond a reasonable doubt, and therefore no charges will be filed against him in connection with Mr. Lozadas death.

A man was found not guilty of murder in the death of another man at a gas station on North College Avenue last year after his attorneys argued he acted in self defense.

Duane Brown, 40, died July 21, 2023, after being stabbed during an altercation with 37-year-old Saman Zare at a Loaf 'N Jug gas station and convenience store, 318 N. College Ave. Brown's death was ruled a homicide from stab wounds by the Larimer County Coroner's Office.

Zare was charged with second-degree murder, a Class 2 felony, and first-degree assault, a Class 3 felony, in Brown's death. A jury found Zare not guilty of both charges Tuesday following a seven-day trial.

The incident occurred around 1:30 a.m. on Saturday near West Second Avenue and 29th Street, where 36-year-old Michel Lope Montes de Oca had called a mobile tire service to repair his vehicle. The mechanic, 29-year-old Brandon Hurst, arrived and began work.

According to police reports, Montes de Oca became irate upon realizing that the tire installed on his vehicle was a used one, not a new replacement as he might have expected.
