An Illinois law banning semiautomatic guns like AR-style rifles is unconstitutional, a federal judge ruled Friday, citing recent U.S. Supreme Court decisions that strictly interpret the Second Amendment, including a watershed 2022 ruling that law-abiding Americans have a right to carry a handgun outside the home for self-defense.
Judge Stephen McGlynn for the U.S. District of Southern Illinois determined that the Protect Illinois Communities Act, which outlaws hundreds of firearms and accessories such as bump stocks and high-capacity magazines, violates an individual’s right to bear arms. McGlynn stayed his order for 30 days, during which time the Illinois Attorney General’s Office plans to appeal the judge’s decision. |

As if gun rights activists have not had enough winning for one week after President Trump’s election landslide. Now, a major victory for gun rights advocates has unfolded in Illinois as a federal judge issued a permanent injunction against the Protect Illinois Communities Act (PICA), which had criminalized the possession of certain popular firearms and large-capacity magazines.
The ruling prevents Illinois from enforcing its semi-auto gun and magazine ban, marking a significant win for the Second Amendment Foundation (SAF) and its allies.
Alan Gottlieb, founder and Executive Vice President of SAF, announced the victory with a statement emphasizing the win for constitutional rights. |

A federal judge in Illinois ruled that the state’s assault rifle ban is unconstitutional, arguing that the decision violates the Second Amendment.
In U.S. District Judge Stephen McGlynn’s opinion, he issued a permanent injunction prohibiting enforcement of the ban, though he stated the injunction won’t take effect for 30 days, meaning it’s paused to give time for an appeal. |

I guess this tale started a couple of months ago when I posted an image of myself on social media, holding a blue grouse I had dispatched with a shotgun, and there on my right hip was a revolver.
Over the years, photos of me in the woods with a sixgun strapped on are about as common as bags of potato chips in a grocery store, but one observer made the observation, “Interesting that the hunter is carrying a sidearm.” Huh? What the heck is so “interesting” about that, some folks wondered. |

Over the past year, it seemed that young gun owners aged 18 to 20 were building some momentum in getting their Second Amendment rights recognized. In April, a Pennsylvania judge ruled that 18- to 20-year-old residents could apply for concealed carry permits, and in July, the 8th Circuit Court ruled that Minnesota’s carry ban on young adults under 21 was unconstitutional.
Now, however, the tide seems to be turning. On Tuesday, the Denver-based 10th Circuit Court of Appeals ruled in the case Rocky Mountain Gun Owners v. Polis that Colorado’s law limiting gun sales to people 21 or over could take effect. The law had been on hold since last year when a federal district judge blocked enforcement of the law the day it was set to take effect. |

Due to the rise of ghost guns, the ability to produce unregistered firearms, and the lack of reporting requirements for lost, stolen, or damaged guns, we must rely on NICS records and surveys to estimate the number of firearms in America.
The growth of firearms in America began gradually. In 1996, the ATF estimated there were 242 million firearms in the U.S. By 2000, that number had increased to 259 million.
In 2007, the estimate rose to 294 million; by 2009, it had surpassed 310 million. 2
By 2018, the reported number of firearms in the U.S. was 393 million. 3
Our most recent estimates suggest there are now more than 500 million civilian-owned firearms in the U.S. |

California Attorney General Bonta today, as part of a coalition of 22 attorneys general, filed a brief with an en banc panel of the U.S. Court of Appeals for the Ninth Circuit in support of the U.S. government’s defense of a federal law, 18 U.S.C. § 922(g)(1), which prohibits felons from possessing firearms. The case, United States v. Duarte, presents the question of whether federal law that prohibits the possession of firearms by individuals convicted of felonies violates the Second Amendment. The defendant in the case, Duarte, had previously been convicted of five separate California felonies when he was arrested for unlawfully possessing a gun under federal law.

A federal judge prohibited Illinois from enforcing its ban on assault weapons, marking a victory for Second Amendment activists and reversing a law signed by Gov. J.B. Pritzker (D-IL).
U.S. District Judge Stephen McGlynn ruled Friday in favor of plaintiffs who argued that the Protect Illinois Communities Act (PICA) was “an unconstitutional infringement” of Second Amendment rights.
“Government may not deprive law-abiding citizens of their guaranteed right to self-defense as a means of offense,” McGlynn wrote in a 168-page opinion that suggested people use guns to defend themselves because “sometimes,” there is “no one” else to protect them. |

A federal judge in East St. Louis found Illinois’ gun and magazine ban is unconstitutional and enjoined the state from enforcement, but stayed the ruling for 30 days for the state to appeal.
“[The Protect Illinois Communities Act] is an unconstitutional affront to the Second Amendment and must be enjoined,” federal Judge Stephen McGlynn wrote Friday in a 168 page ruling. “The Government may not deprive law-abiding citizens of their guaranteed right to self defense as a means of offense. The Court will stay enforcement of the permanent injunction for a period of thirty (30) days from the date of this Order.” |

U.S. Federal Court Judge Stephen McGlynn struck down Illinois’ so-called “Protect Illinois Communities Act” gun and magazine ban Friday afternoon. The court ruled that banning America’s favorite rifle, the AR-15, and a myriad of other hot-selling guns commonly used for self-defense is unconstitutional. The ruling proved a very satisfying cap to a week that saw Donald Trump’s election and all that entails for rolling back gun control schemes nationwide.
Erring on the side of caution, Judge McGlynn stayed his permanent injunction for 30 days to allow the State of Illinois to reach out to the Seventh Circuit Court of Appeals for an appeal. |

Former US Speaker of the House Nancy Pelosi said that US President Joe Biden’s delayed exit from the 2024 US presidential election race cost the Democrats “dearly.” The proclamation from Pelosi came days after the party’s presidential nominee, US Vice President Kamala Harris, lost the November 5 polls to the new President-elect Donald Trump.
“We live with what happened,” Pelosi told The New York Times as she pondered upon exactly what went wrong. “Had the president gotten out sooner, there may have been other candidates in the race. The anticipation was that, if the president were to step aside, there would be an open primary,” Pelosi said in the podcast called The Interview. |

A recent ruling by the U.S. Court of Appeals for the Tenth Circuit Court upheld Colorado’s law restricting firearm sales to individuals under age 21, sparking a significant debate around Second Amendment rights for young adults.
The case stems from Colorado’s Senate Bill 23-169, which Gov. Jared Polis signed in 2023, raising the minimum age for all firearm purchases to 21. While the lower court previously blocked the law, citing concerns about its constitutionality, the Tenth Circuit overturned this decision, allowing the restriction to take effect. |

The background of the gun is well established. In a nutshell, Fritz Walter, the heir to the famed Carl Walther rifle works, moved in the early 1900s to expand the company into handguns with a line of simple blowback pocket pistols to compete with models like the Colt Vest Pocket and Pieper Bayard. Moving to more advanced designs using a workable single-action/double-action trigger system by the 1920s, the Polizei Pistole, or PP series, soon became a smash hit, despite it being twice as much as the company's earlier models. |

Devout supporters of the Second Amendment argue that it is a fundamental right that should not be contingent on citizenship. They see the restriction on undocumented immigrants as setting a troubling precedent that could lead to further erosion of Second Amendment rights for other groups. This concern echoes Mygatt-Tauber’s argument, where he highlights that “historical laws disarming individuals were focused on preventing arms falling into the hands of those deemed dangerous,” not on blanket bans based solely on one’s legal immigration status. |

QUOTES
TO REMEMBER |
There are other things so clearly out of the power of Congress, that the bare recital of them is sufficient, I mean the "...rights of bearing arms for defence, or for killing game..." These things seem to have been inserted among their objections, merely to induce the ignorant to believe that Congress would have a power over such objects and to infer from their being refused a place in the Constitution, their intention to exercise that power to the oppression of the people. —ALEXANDER WHITE (1787) |
