CA: Cal. CCW Case Illustrates Problem with 'May Issue' Laws

If the court determines there is enough evidence to go forward with prosecution, the results might be bad for the suspects but perhaps worse for anyone defending the “may issue” philosophy. Concealed carry activists believe “may issue” never was a good idea, and in several cases, has apparently turned into a very bad system.

California is one of a minority of states where local officials have broad discretion in the issuance of carry licenses. More states have adopted the “shall issue” approach, where applicants who meet specific qualifications are issued a license/permit. These qualifications may include taking a gun safety course, or simply passing a background check to determine whether the applicant has a clean record.

With the reversal, which was rendered Friday, the order goes into effect in the village immediately, as the permanent injunction meant to prevent the village from enforcing the ordinance has been removed, officials said…

Meza's bill would add a "duty to retreat" clause to laws pertaining to private citizens' use of deadly force when they are not on their own property. It would also remove robbery and aggravated robbery from crimes justifying deadly force when they occur in a location that is not that person's property.

The decision doesn’t apply to McCloskey’s wife but means that a special prosecutor will have to take over the Mark McCloskey case, reports NPR.

Former national security adviser Susan Rice, President-elect Joe Biden’s reported pick to lead the White House Domestic Policy Council, called for a “permanent” ban on so-called assault weapons in a June appearance with two anti-gun groups.

Rice, who served in former president Barack Obama’s administration, appeared in a video with Moms Demand Action and Everytown For Gun Safety and concurred with Biden’s firearm plan that seeks to ban certain semi-automatic rifles, prohibit “high-capacity magazines,” and do away with liability protections for weapons manufacturers and sellers. Rice has reportedly been chosen for the domestic policy role, Politico reported Thursday.

Georgia Democratic candidates for U.S. Senate Reverend Raphael Warnock and Jon Ossoff took part in debates in an attempt to gloss over their gun control agenda and the fact they would be the votes that would usher in President-elect Joe Biden’s radical gun grab agenda.

Despite the theatrics, it didn’t work.

Georgia’s runoff elections on Jan. 5 promise to have monumental impacts on gun owners and Second Amendment rights, including the firearm industry.

The gun debate in America will soon enter a new chapter with a Democrat in the White House after four years under President Donald Trump in which gun control advocates developed a long wish list for reform amid a spate of large-scale mass killings in places like Las Vegas, El Paso and Parkland, Florida.

But any hope that Joe Biden will usher in a new era of restrictions on firearms is highly unlikely because of the same polarization in Washington that has tripped up similar efforts under past administrations.

There are many reasons to vote to re-elect Senators David Perdue and Kelly Loeffler. Their solid pro-Second Amendment records are one good reason. Another is to protect the Supreme Court from being packed with anti-Second Amendment extremists. Then there is the hostility that Jon Ossoff and Raphael Warnock have shown to those who defend our freedoms.

No one in Kyle Rittenhouse’s family seems to understand the gravity of what he did. At least, they won’t admit it.

The 17-year-old killed two people and wounded another. Someone in the Rittenhouse family should be remorseful for that. But so far, all his mother has done is blame the victims.

Though it may or may not be true, it is a smart defense to claim that Rittenhouse shot the men in self-defense during a protest over a police shooting in Kenosha, Wis.

At the Tuesday County Commission meeting, District Attorney Kenny Wright advised the commissioners to allow him to review the language before voting on whether to adopt it.

In the meantime, Wilkerson has been replaced by Mark Berry. However, Berry also has stated his support of the same action.
