MI: Van Buren County man claims self defense in shooting death

It turned out she was engaged in a sex act with her boyfriend, Tim Henley nearby in his Jeep and was discovered by her daughter.

In the upset and anger that followed, police said Henley began punching the windows in Taylor’s BMW, shattering the driver’s side window.

That’s when Taylor pulled out a hand gun and fired three times at Henley, who would die from the wounds.

On Tuesday, Taylor’s son, who was sitting in the backseat, testified he was scared.

A 40-year-old Taylor woman will not be charged in connection with the fatal shooting of an acquaintance at a Marathon gas station.

The Wayne County Prosecutor's Office said Wednesday it has determined that the shooter acted in lawful self-defense when she fatally shot Tanya Marie Davidson, 40, of Taylor.

"There is insufficient evidence to prove beyond a reasonable doubt that the shooter committed a crime," the prosecutor's office said in a statement.

According to the county code, firing guns in the county’s urban area is prohibited, with the exceptions of firing at a shooting range approved by the county’s firearms safety committee. Guns can be shot in a private basement, for self-defense, for hunting in designed areas and for ceremonial purposes with blank ammunition, such as at military funerals.

The county’s urban boundary laws do not conflict with the Second Amendment because a 2008 Supreme Court ruling in District of Columbia vs. Heller allows local governments to restrict firearm use, according to a memo prepared for the County Council.

As state lawmakers race toward the end of this lame duck legislative session, they’ve been considering two bills that Governor John Kasich opposes – the six-week “Heartbeat Bill” abortion ban and the “Stand Your Ground” self-defense bill.

Breitbart News reports that the New Jersey State Police have “refused to rule out house-to-house enforcement of the state’s ‘high capacity’ magazine ban,” in correspondence from the Garden State’s law-enforcement agency to the news organization.

As of December 11, it is a fourth-degree felony in New Jersey to possess a “large capacity ammunition magazine,” which is defined as “a box, drum, tube or other container which is capable of holding more than 10 rounds of ammunition to be fed continuously and directly therefrom into a semi-automatic firearm.”

Speaking as a mother, Burleigh seemed to think owning a gun was something only done out of fear, and why would Loesch want to pass on fear to her children by carrying a weapon?

Since Jan. 1, 2018, there have been 11 mass public shootings in which three or more people other than the shooter were killed, parameters derived from Congress’ definitions of “mass shooting” and “mass killing.”

These 11 mass public shootings occurred across seven different states, but three occurred in California, the only state with an “A” rating from the Giffords Law Center to Prevent Gun Violence. Two more occurred in Maryland, with an “A-” rating. Another two occurred in Pennsylvania, whose “C” rating still accounts for the 13th strictest gun control framework in the country.

A Brownsville man who had been charged with murder and aggravated assault has been sentenced to four years in prison for violating probation. District Judge Gloria Rincones ruled this week that 38-year-old Robert Galvan acted in self-defense when he stabbed two men, killing one of them.

However, because Galvan had been drinking at the time, he had violated his probation from a previous assault conviction. It was back on April 11th when Galvan was getting a ride home and a fight broke out over gas money. Galvan maintained he was attacked first with a pair of scissors. Galvan then grabbed the scissors and stabbed the two men, killing 54-year-old Horacio Eguia.

After nearly two decades of severe restrictions on gun rights and record levels of violence in their country, Brazilian firearm owners are ready for a change.

Previously reported by A1F.org, President-elect Jair Bolsonaro made comments during his campaign and following his win in a post-election interview that he wants to follow through on his intention to ease gun-control restrictions.

“We have to stop this politically correct thing, saying that disarming everyone will make Brazil a better place—it won’t,” Bolsonaro said in the interview.

The past year has seen 93 gun-related incidents in K-12 schools across the United States, the highest number since recording began in 1970 and more than double the number of shootings in 2017.

The previous record was 59 incidents, set in 2006, according to data from the Center for Homeland Defense and Security Naval Postgraduate School.

The data counts any time a gun “is brandished, is fired, or a bullet hits school property for any reason.” It includes shootings where there was no victim.

Consider this counterfactual.

At around 9 p.m. on July 6, 2016, Officer Jeronimo Yanez shoots Philando Castile five times at point-blank range during a traffic stop after Castile calmly and voluntarily informs the cop that he has a gun. Diamond Reynolds, Castile's girlfriend in the passenger seat, knows Castile has done nothing wrong. In fear for her life and the life of her four-year-old daughter in the backseat, she grabs the gun from Castile's pocket and shoots Yanez. Yanez's partner, positioned beside Reynolds at the passenger side window, goes for his gun. She shoots him, too.

This hypothetical alternative ending to the Castile tragedy raises an important question:

Dynamic women empowerment, safety and solidarity are the primary merits of a newly-formed Lake Martin sisterhood, A Girl and A Gun.

The Lake Martin chapter of this nationally recognized organization, facilitated by Jodie McGirt, is a ladies-only shooting league established by women shooters for pistol, rifle and shotgun operators. The group is designed to teach beginners the basics of firearm handling and accurate shooting by providing training in a comfortable atmosphere. The Trump Administration says it will soon place a federal ban on bump stocks, the gun attachments that allow semi-automatic rifles to fire faster. Ten states banned the plastic device after it was used by a gunman in Las Vegas to shoot and kill 58 people in 2017.

Without any enhancement, semi-automatic rifles fire one bullet per trigger pull. Bump stocks harness the gun’s recoil to speed up the rate of fire, allowing the gun to pump out bullets faster.

Five years ago, Publisher Brent Schacherer and my predecessor, Doug Hanneman, began a solemn tradition.

Every December since 2013, the Leader editorial page marks the anniversary of the Sandy Hook Elementary School shooting with a reminder of the unfortunate resolution passed by members of the McLeod County Board in the wake of that tragedy. The resolution claims to nullify federal laws infringing on gun rights, but as County Attorney Mike Junge advised at the time, county commissioners have no jurisdiction in this realm. The Board of Commissioners essentially diminished itself to the level of a kangaroo court.

Democrats in the Oregon Legislature plan to introduce a bill in 2019 that would require gun owners to securely store their weapons using locks.

The Oregonian/OregonLive reports that gun owners who fail to follow through could be fined as much as $500, or $2,000 if a child gets unauthorized access to the firearm, according to a summary of the proposal released by supporters. They did not include a copy of the actual legislation, which will be introduced by Rep. Barbara Smith Warner, a Portland Democrat and and Sen. James Manning, a Democrat from Eugene.
