In January 2021, Petitioner Eva Marie Gardner, who has a valid Virginia handgun-carry permit, was driving from her Virginia home to visit her mother in Pennsylvania. While driving through Maryland, another driver struck her Jeep twice—she believed he was trying to run her off the road. Ms. Gardner called 911, saying she was afraid and had her gun with her. When the other driver approached, Ms. Gardner displayed her gun and told him to go back to his car. After hesitating, he complied.

A company that sells non-lethal self-defense weapons has brought a lawsuit against the State of California, alleging a state heavy on gun restrictions, was violating the Second Amendment because it is making it difficult for people to buy their products. Byrna Technologies, who’s weapons look like handguns but shoot powerful chemical irritants rather than lethal bullets are legal in 50 states, but California has blocked sales of Byrna’s ammunition and launchers. The complaint compares Byrna’s products to Tasers and other stun guns which both received Second Amendment protections by the Supreme Court.

But on Thursday morning, prosecutors, citing new information, dropped charges against Sanon, who throughout the case maintained she acted in self-defense. Sanon’s alleged victim, Sapp, a then-42-year-old, had been arrested on a slew of charges, including human trafficking and lewd and lascivious acts with a victim between 12 and 16. Since November, Sapp has been at the Broward Main Jail. In July, investigators discovered that Sapp had sent a 14-year-old girl sexually explicit messages and met with her in person on several occasions, according to a warrant obtained by the Herald in a public records request. In one of the messages, Sapp offered the young girl money to engage in sex acts with one of his friends.

Cannamela also called for the state to reclassify pets as family, rather than property.

"Currently, Connecticut law considers pets as property and thus, they do not afford animals a right to self-defense. This must change and the incident in Norwalk is a perfect example of why," Cannamela said.

Ed.: CT should first focus on the right to self-defense for humans. I can just imagine a dog on trial for failing to prove they upheld their duty to retreat.

Officers with the Pine Bluff Police Department were called out late on the night of December 7 after a resident saw something no one wants to see on their home security feed. Around eleven at night, the resident noticed an unknown man sitting inside her vehicle parked on the 2000 block of West 24th Avenue and immediately notified police.

When she checked the vehicle in person, she realized her 380 caliber pistol, which had been stored in the driver side door, was gone. That missing firearm became the center of a tense confrontation. The resident demanded that the man give the pistol back, and an argument broke out between the two.

The brief urges the Court to grant certiorari in Gardner v. Maryland, a case that could set a national precedent on the recognition of firearm carry permits across state lines.

Criminal charges will not be filed against a fisherman for another fisherman’s violent drowning death in Moss Landing Harbor, the Monterey County District Attorney announced.

“Based on the current state of the evidence, no charges will be filed against Joshua Holtzclaw concerning the death of Trenton Black,” District Attorney Jeannine Pacioni’s office wrote Thursday.

The two fishermen got into a fight on June 11 before Black drowned, investigators said. Circumstances surrounding his death have been questioned by his friends and loved ones for months.

The DA’s office released the following timeline of events from June 11:

In the landmark Second Amendment case District of Columbia v. Heller, the Supreme Court did refer to "law-abiding citizens." It said the amendment "does not protect those weapons not typically possessed by law-abiding citizens for lawful purposes." And it upheld "the right of law-abiding, responsible citizens to use arms in defense of hearth and home." But the Court also recognized that the phrase "the people," which appears in the First, Fourth, Ninth, and 10th amendments as well as the Second, "unambiguously refers to all members of the political community, not an unspecified subset." According to Heller, that language creates a "strong presumption" that the right to arms "belongs to all Americans."

A federal lawsuit filed this week in San Diego is challenging California's prohibition on less-lethal pepper projectile weapons, arguing that the state's ban violates Second Amendment rights. The suit names San Diego County resident Sandy Schiller as one of three plaintiffs and is filed against California Attorney General Rob Bonta.

The pepperball weapons fire non-lethal projectiles filled with chemical compounds designed to incapacitate without causing death. California currently classifies these projectiles as a form of tear gas, making them illegal for civilians to own and possess, with exceptions for law enforcement.

All eyes are turning toward the University of Wyoming, which recently received nearly $1 million in federal dollars to create Second Amendment curriculum for high school students that “highlights ongoing debates about firearms education in American schools and the federal government’s role in shaping how constitutional issues are taught,” according to a UW press release.

The U.S. Department of Education awarded a $908,991 grant to the college this year to develop what university officials have promised would be “historically grounded school curriculum on the Second Amendment.”

The court will hold an en banc hearing on February 11, 2026, but this will be one of the most closely watched cases next year. Back in September, a three-judge panel upheld a preliminary injunction issued by a District Court judge, which dealt with carrying unloaded, operable firearms in private vehicles, and carry on private property open to the public. However, the ruling upheld other tenets of the “sensitive places” law. In October, the gun rights groups filed for the en banc hearing.

The rehearing affects cases filed by the Second Amendment Foundation (Koons v. Attorney General of New Jersey) and supported by the National Rifle Association (Siegel v. Platkin).

Howard Cook said there will be no retail sales from his property at 1350 Douglas Turnpike, noting the process is heavily governed by federal and state law.

“It would be by appointment only,” Cook said. “I’ve gone through the inspections. I’ve had the police chief sign off, fire, building…”

His analysis of every vehicle gun theft reported to the San Antonio Police Department in 2024 shows clear patterns, including that more than 54% of thefts occurred Friday through Sunday.

Many gun owners told him they thought they were making the responsible choice by leaving their firearm in the car before going into a bar, restaurant or busy event.

“They consistently thought they were actually taking the safer option,” he said.

Ed.: This is on the businesses for not allowing lawful carry in their establishments, not on gun owners forced to leave their guns secured in their car.

The Third Circuit Court of Appeals has agreed to an en banc review of the Second Amendment Foundation’s (SAF) challenge to New Jersey’s “sensitive places” firearms carry restrictions.

The case, Koons v. Attorney General of New Jersey (No: 23-2043), challenges laws New Jersey enacted in response to the 2022 landmark Supreme Court Bruen decision. The laws create multiple overlapping categories of so-called “sensitive places” where even those with a concealed carry permit are prohibited from carrying a firearm. The restrictions, in essence, cover almost every square inch of the state, severely limiting where residents can exercise their Second Amendment rights.

A Texas gun retailer that allegedly contributed to increased gun violence in New York by selling “ghost guns” is not owed coverage under its liability policy, a federal appeals court ruled.

In Granite State Insurance Co. v. Primary Arms LLC, the U.S. Court of Appeals for the 2nd Circuit upheld a lower decision Tuesday ruling that various city and state lawsuits filed against Primary did not constitute an “accident” under the terms of the policy issued by Granite State, a unit of American International Group.

 QUOTES TO REMEMBER
If angels were to govern men, neither external nor internal controls on government would be necessary. In framing a government that is to be administered by men over men, the great difficulty lies in this: you must first enable the government to control the governed; and in the next place oblige it to control itself. — JAMES MADISON
