BRYAN – A former reserve officer with the Bryan Police Department has been indicted on child porn charges.
Dennis Fraley was indicted Thursday by a Brazos County Grand Jury on 57 counts of possession of child pornography and 1 count of indecency with a child. He was arrested late Thursday afternoon by Texas Rangers.
When Fraley was arrested in September, the Brazos County Sheriff's Office told News 3 investigators found pornographic pictures on Fraley's cell phone of girls under the age of 17.

A federal appeals court in Cincinnati deemed a law unconstitutional that kept a Michigan man who was committed to a mental institution from owning a gun. The three-judge panel of the Sixth U.S. Circuit Court of Appeals unanimously ruled that a federal ban on gun ownership for those who have been committed to a mental institution violated the Second Amendment rights of 73-year-old Clifford Charles Tyler. Tyler attempted to buy a gun and was denied on the grounds that he had been committed to a mental institution in 1986 after suffering emotional problems stemming from a divorce. He was only in there for a month. |

A federal law prohibiting anyone who has ever been committed to a mental institution from owning a firearm is unconstitutional, the 6th Circuit ruled.
"The government's interest in keeping firearms out of the hands of the mentally ill is not sufficiently related to depriving the mentally healthy, who had a distant episode of commitment, of their constitutional rights," U.S. Circuit Judge Danny Boggs said, writing for the three-judge panel.
U.S. Circuit Jude Julia Gibbons joined the majority, but also wrote her own concurring opinion. |

On December 18 2014, a three-judge panel of the Sixth U.S. Circuit Court of Appeals ruled that a ban on gun purchases for anyone who has been “adjudicated as a mental defective or has been committed to a mental institution” violated the Second Amendment rights of a Michigan man who was denied a gun purchase because of a mental institution commitment in 1986. |

On July 8, Park City's Attorney received a letter from the Second Amendment Foundation challenging the constitutionality of Park City's firearms ordinances. According to the Salt Lake Tribune, the SAF has sent similar letters to forty-nine (49) local Utah governments, including cities such as Draper and Sandy. The SAF has an estimated thirty (30) lawsuits pending nationally. |

On the state scene, the Ohio General Assembly passed HB234, which allows the use of suppressors or silencers for hunting. The bill is awaiting Gov. John Kasich’s signature. Some groups are campaigning to have the governor veto the bill. The bill has the backing of the Buckeye Firearms Association, NRA and NSSF.
If the bill becomes law, Ohio will become the 34th state to allow suppressors to be used for the hunting of all game animals. Organizations which backed the bill claim sportsmen will benefit from the reduced noise. |

The ordinance states that no person shall discharge a firearm before 8 am or after sunset. Also, any person who wishes to discharge a firearm must notify local police by phone of their intent to discharge a firearm 15 minutes prior to beginning such activity.
Fifteen minutes after the time of the phone call as recorded in the Newtown Police log shall begin a four-hour window in which such activity will be allowed on the subject property each day.
Among other restrictions in the ordinance are new safety provisions seeking to have any outdoor shooting activity overseen by the owner of the property on which the discharge is taking place, a guest of the owner who is present, or have written permission from the property owner. |

The brutal killing earlier this year of a 30-year-old commercial truck driver has an industry group pushing for a nationwide federal firearms business carry permit.
The move, termed “Mike’s Law” with the blessing of the wife of murdered driver Mike Boeglin, is backed by the Small Business in Transportation Coalition. It would establish a federal program so truckers can carry firearms for personal and load protection nationwide regardless of state and local regulation. |

Within hours of a guilty verdict at the Markus Kaarma murder trial, the lead defense attorney announced his intent to appeal the case to the Montana Supreme Court.
"We're fighting this not only for Marcus, but every homeowner, so they have guidance on what they can do in the house," said attorney Paul Ryan. "Because I think seriously right now, there's a lot of people in Montana, people have been asking me since the verdict, what can and can't we do in our house and that's not the intent of the law. But now they're going to have to sit there and question what they can and can't do." |

A three-judge federal panel in Cincinnati unanimously ruled Thursday that a federal law banning gun ownership for a Michigan man who had been previously been committed to a mental institution violated his Second Amendment rights.
In the process, the court applied strict scrutiny to its analysis, noting, “we reject intermediate scrutiny here because it has no basis in the Constitution.” The court further said it used strict scrutiny because it “is more appropriate for assessing a challenge to an enumerated constitutional right, especially in light of Heller’s rejection of judicial interest-balancing.” The 2008 Heller ruling by the U.S. Supreme Court affirmed that the Second Amendment protects a fundamental individual civil right. |
