And it can’t be the National Guard since the government arms them. In a word then, there is no such militia anymore. So, if we’re being originalist, doesn’t lacking the justification negate the right?
But of course, that’s not the right wing argument, is it? They prattle on about the “Constitutional Right to Rebel”. Let’s see how that’s worked out. We’ve had rebellions. |

An Ohio man is accused of beating his girlfriend and then stabbing her to death after she stabbed him in self-defense, police said. Tyler Stiers, 23, is charged with the murder of Kylene A. Young, according to a Facebook post by the Columbus Division of Police. Attorney information for Stiers was not available. Around 1 p.m. Dec. 16, police were called to a home to perform a welfare check. Fire crews forced their way into the home and found Young dead inside, officials said.

More than two years after the U.S. Supreme Court fundamentally expanded its interpretation of the Second Amendment, federal courts throughout the country continue to strike down state restrictions on gun ownership.
Since the high court’s 2022 decision — in New York State Rifle & Pistol Association Inc. v. Bruen — that firearm regulations must have some historical comparison going back to the country’s founding, some state restrictions have been ruled unconstitutional. But lower courts are still figuring out the limits of that historical test and have not yet come to a broad agreement on key gun-related laws. |

Rifles with removable magazines (which store extra rounds) and full hand grips (allowing more comfort and better aim) are used by many hunters (one is pictured in the Journal). Of the thousands of military-like weapons in use during hunting season nationwide, next to none are misused, and even accidental deaths are amazingly low. Americans, including your neighbor, can be trusted. They do not need a psychological test before purchase, a background check when they buy ammunition, a government license to trade their firearm, and should not be targeted and put on watch lists for owning one. |

“Government can regulate to seek to keep firearms out of the hands of people who are dangerous and therefore likely to misuse them,” said attorney Jane Elinor Notz representing Illinois State Police Director Brendan Kelly. “That applies to public carry and at home protection.”
Judge Craig DeArmond pushed back on Notz, saying recent U.S. Supreme Court precedent dealt with allowing some regulations for public carry, not for keeping firearms in the home. DeArmond and Notz went back and forth on a variety of issues.
“I know your [sic] doing your best to not answer the question, but it’ll go faster if you do,” DeArmond said when questioning Notz on the state’s position.

Senate President Ben Albritton wants to gather input from law-enforcement officials before locking in his opinion on a proposal to lower the minimum age to buy rifles and other long guns.
The Wauchula Republican has signaled opposition to another proposal (HB 31) that would allow people to openly carry firearms in Florida, saying he is aligned with law enforcement officials who have opposed the idea. Some Second Amendment advocates have long pushed for “open carry.”
Albritton told reporters this week he will be equally as “cautious” on a proposal (SB 94) by Sen. Randy Fine, R-Melbourne Beach, to repeal a law that prevents people under age 21 from buying rifles and other long guns. |

Two of our allies, Canada and Poland, are pursuing vastly different approaches to gun ownership and training. While both heavily restrict firearms ownership with extreme licensing systems and offer no constitutional guarantees, the latter is giving a masterclass in smart and responsible firearms usage.

Florida Rep. Christine Hunschofsky filed legislation in the state house Wednesday that would require universal background checks for gun sales and ban “ghost guns,” among other reforms.
House Bill 65, known as the “Responsible Gun Ownership Act,” would also mandate that gun sales and transfers be conducted through licensed dealers, strengthen gun storage laws, and mandate that guns be sold by dealers with trigger locks or gun cases.
The legislation, which stands little chance of passage in the Republican-dominated legislature, would make it illegal to possess or manufacture unfinished firearms without serial numbers. |

Lowering the age to buy a gun
Fine wants to remove a gun-safety law passed by the Republican-led Legislature in 2018 after the Parkland school massacre. The bill, SB 94, would lower the minimum age to purchase a gun from 21 to 18.
Red flag law
Rep. Joel Rudman, a Navarre Republican, is proposing to roll-back a different Parkland provision that allows law enforcement to petition for a court order to remove firearms from those who are believed to be a threat to themselves or others.
The bill, HB 31, also allows owners to openly carry otherwise legal guns. But Albritton, the senate president, has already said he doesn’t support the concept. |
