Unanimous Supreme Court Rules Police Searches Need Only Brief Warning

"Police officers executing a search warrant do not violate constitutional rights by waiting only 15 to 20 seconds after knocking and announcing their presence before using force to enter a suspect's residence, the U.S. Supreme Court ruled on Tuesday."

"The unanimous decision written by Justice David Souter held that officers who searched for cocaine in a suspect's apartment in Las Vegas did not violate the constitutional protection against unreasonable searches and seizures of evidence."

"He said the officers, who forced their way in after only a brief pause were justified because of the 'exigent circumstances' that the drugs could be disposed of if they waited any longer."

"The ruling was a victory for the U.S. Justice Department, which argued that 'prolonged delay' could lead to the easy destruction of drugs and could expose officers to 'undue danger' from 'violent, armed' criminals."

Debate at right to bear arms not over

"But the debate over the Second Amendment is far from over, as the federal courts are weighing a constitutional challenge to the District of Columbia's restrictions on handguns. And it could be years, if ever, before the Supreme Court resolves the debate." ...

"Constitutional rights are not absolute - meaning they can be regulated. The First Amendment right of speech, for example, doesn't allow one to yell 'Fire' in a crowded theater when no such fire exists, nor does it allow for marketing child pornography."

-------
Of course, said regulation doesn't include background checks for the purchase of a camera or registration of your larynx prior to entering the theater. But that's a detail enemies of freedom like to overlook.

"Americans for Gun Safety called on Congress today to keep Brady background check records for 90 days instead of the proposed 24 hours to ensure that law enforcement can continue to find out if criminals or terrorists are buying firearms. Late Tuesday, a provision was added to the omnibus-spending bill in conference committee that would limit the amount of time the FBI is required to retain background check records for firearm purchases from 90 days to 24 hours."

"In the letter addressed to all U.S. Senators and Members of Congress, AGS asked Congress to use whatever legislative means available to remove the provision from the budget bill." ...

"The Miller case has been either ignored or misinterpreted dozens of times since then, by lawmakers and judges alike, particularly because the Supreme Court never said, in so many words, 'Individuals have the right to own guns.' Gun-control advocates continue to argue, incorrectly, that only members of the militia -- which anti-gun groups define as a state-sanctioned, formally trained military force -- can legally possess firearms without government supervision."

"The Supreme Court was asked to reconcile the divergent views of gun ownership handed down by two federal appellate courts."

"What do the forces allied against freedom demonize the most? The militia movement. The militia movement has been demonized in the media, in schools, by almost all the politicians and even in neo-conservative publications and magazines. One would ask why would they demonize the militia movement so much. Is it because it stuck at some point that the freedom movement in general was missing out?"

"...The question is put to the ordinary public whether they would choose liberty or security? Brave people who lived in early America would obviously choose liberty. But public indoctrination centers have made cowards out of most of the population and they would invariably choose security."

The First Law of Nature Demands a Second Amendment

"Questions regarding the First Law of Nature were resolved at the time the Second Amendment - preeminent defender of our Bill of Rights - was ratified on December 15th, 1791. This fundamental law reigns supreme over every law contrived by politicians. And, the continuous and very real protections that the Second Amendment affords cannot logically be interpreted as antiquated necessity. Its purpose remains sound and noble. Accordingly, constitutional law and commonsense should render further discussion respecting the absolutes of self-defense as unwarranted. However, as this essential law is now under an unnatural attack by the encroaching United Nations, faithless public servants, and other debilitating influences of Socialist activism, an uncompromising attitude and a defensive awareness are indispensable. Diligently exposing the fraudulent nature and weaknesses of our demoralizing adversaries and their emotionally vulnerable admirers is no less vital to national security and the preservation of individual freedoms." ...

"It is crystal clear that the enforcement of the Bill of Rights has become inconsistent. Prior to the recent enactment of the "USA Patriot Act," if a state or local government were to violate the human rights of any individual, the federal government and courts - often self-exempted from the same laws - would in most cases chastise that offending state or city. Excepting, of course, the unalienable individual rights guaranteed by the Second Amendment. The Second Amendment is the only constitutional protection to be singled out for state and local recognition or lack thereof, inaccurate or vague interpretation, and unconstitutional infringements. Whereas, the states are rarely permitted to infringe upon the human rights contained within the remaining nine Amendments, they are encouraged by the federal government and courts to assault the principles of the Second Amendment." ...

Letter from ArmaLite to a dealer regarding whether customers should buy now or wait until the AWB expires

"We've been told that some of your customers are confused about whether to purchase rifles from you today or wait for possible expiration of the 'Assault Weapons Ban.' "

"Their problem is how to balance the risk of buying a rifle that won't be quite what they want if the ban expires and the risk of not getting a rifle at all if the ban is worsened. Your problem is how to sell rifles in the face of their indecision."

"ArmaLite has initiated an important program that allows you to sell rifles that comply with the law today, yet allows the customers to easily apply 'pre-ban' features if the ban expires. Perhaps most importantly, it allows them to avoid being locked out of a rifle if the ban worsens." . . .

"If I have a 'hot button' issue, this is definitely it. Don't even THINK about taking my guns! My rights are not negotiable, and I am totally unwilling to compromise when it comes to the Second Amendment."

"Let me reiterate an axiom of my philosophy. Rights and privileges are polar opposites. A right is something that I can do without asking. A privilege is something that a higher authority allows me to do. It is utter nonsense for us to accept government permits in order to exercise an unalienable right. Allow me to point out some fallacies in the arguments frequently used by the anti-gun movement."

"First, it is impossible for the Second Amendment to confer a 'community right', because communities HAVE no rights. Individuals are real. Communities are abstract concepts. You can have individuals without communities, but you cannot have communities without individuals. Ergo, individuals must come first, and only the individuals that make up a community can have rights."

-------
We are, of course, disappointed with the recent SCOTUS denial to grant certiorari to Silveira vs. Lockyer. But we must continue to make our voices heard, rather than watch our rights disappear. It is an uphill battle for sure, but things can get better.

Many have said they will not even vote next November. I can understand this, but many men and women have given all they had so that we may have the freedom to choose our government. Rather than not vote because you are "throwing your vote away," I suggest that you vote for someone whose platform is based upon protecting the Second Amendment. Michael Badnarik (Libertarian) is that candidate.

I invite you to vote your conscience, vote your passion with me and vote Badnarik. Make your voice heard.

"Surely the right to keep and bear arms, outside a militia, shouldn't include Uzis, AK-47s, and similar assault weapons. The high court's decision should also firmly set Congress on course to renew the federal ban on assault weapons when it expires next year."

"Nearly a decade after a federal law mandated expulsion for students who bring guns to school, state officials fear that misunderstanding still lingers over what the law means."

"A recent review of Wisconsin's data on firearm-related student discipline turned up a rash of over-reporting, said Steve Fernan, the state Department of Public Instruction's consultant for safe and drug-free schools."

"The DPI's findings may indicate that school officials have misconceptions about the Gun Free Schools Act and the federal definition of a firearm, he said. That's because, in many cases, school districts reported that they meted out discipline for students who brought BB guns, toy guns or other non-firearm weapons to school."

"Let's adopt the principle that punishment should fit the crime. Let's decide that 'cruel and unusual' should be no more or less 'cruel and unusual' than what the perpetrators themselves imagined and inflicted on their victims, who numbered in the millions. Not just 16. Let's also acknowledge that we should not be 'cruel and unusual' to the victims, victimizing them again by giving these monsters peaceful deaths, last meals, comfort and security. That's not fair. And Mr. Greenspun is absolutely correct - it doesn't help anyone."

"Here's a death plan, tailored just especially for Muhammad and Malvo."

"Find a few acres of forest, fenced in with razor wire. Dress Muhammad and Malvo up like turkeys. Paint some bullseyes on their chests and heads. Release them into the forest and let them wait there for a few weeks. Nuts and berries. Not filet mignon. Now go to the biggest Gun and Knife Show in the DC area. It would have to be in the Virginia area probably. Sell tickets. Have an auction. Say there will be 50 hunters allowed inside the fence to do as they see fit with those men. Proceeds are split between the victims families and reimbursing the taxpayers for legal expenses of their trials. And then the sanctioning of these killings *will* benefit somebody."

"Another Orlando Police Department officer is in trouble for leaving a weapon in a public place. This time, it was a high-powered assault rifle forgotten on busy Curry Ford Road, near Primrose."

"The officer had a flat. So, to get to the spare, he had to pull out everything from his trunk, including the bag that contained his AR-15 assault rifle and ammunition. It was dark, so when he pulled away, he just didn't see the bag."
