"The Ninth Circuit is still bound by a previous panel decision (Hickman v. Block) that adopted a states' rights view, and Hickman can only reversed by an en banc panel. Such en banc rehearing would require a majority of the Ninth Circuit judges to vote to rehear a suitable case (not this one); then an 11-judge panel would be assigned, and would have the power to overrule Hickman, if it chooses. Given the current composition of the Ninth Circuit, I doubt that will happen. Still, the panel's decision is a powerful signal that even on the Ninth Circuit, and even among Ninth Circuit judges appointed by Democrats, the individual rights view has significant persuasive power."

I'm probably wasting my time, but I'd like to give the person who wrote the recent Furthermore article on Smith & Wesson's .50 caliber handgun some advice: Don't alienate your readers by thinking that we're all liberal, anti-gun pussies like yourself. Many of us actually own and have an interest in guns -- including those of the 'grotesque,' 'penis extension' type. I'm sure you've heard this before, but just in case you’ve forgotten, let me remind you that my right to own a gun is no less important than your right to whine about it. I won’t try to take away your rights or freedoms, so don’t mess with mine! Thank you.

Sincerely, Jason -- A law abiding, non-wife beating, non-redneck, electronics engineer, who owns his own company, has an adequate penis and likes guns.

If the government's job - what we hire them to do - is to protect our life, liberty and property, then how were they fulfilling their function by prosecuting and jailing Ed Rosenthal? Whom have they protected, and from what? How could the jurors do their job as a part of the government system of justice after being denied half the facts and never advised of their power to judge the merits of law, and to judge how the law was applied?
