SAF Joins in Amicus Brief Supporting Challenge to New Jersey Claim

The Second Amendment Foundation has joined several other parties in filing an amicus brief with the U.S. Supreme Court, asking the court to accept for review a case that challenges the “justifiable need” standard that is at the heart of New Jersey’s restrictive carry law.

The case is Rogers v. Grewal. Attorneys general from 22 states have also asked the high court for review in a separate brief.

Anti-gunners in and outside of South Dakota cringed Thursday when recently-sworn Gov. Kristi Noem signed legislation that legalizes concealed carry without a permit, beginning July 1.

The Mount Rushmore State becomes the 14th state to allow so-called “Constitutional Carry,” and not everyone is happy about it. According to KSFY News, a spokesperson for a local chapter of the anti-gun Moms Demand Action for Gun Sense in America declared, “We are frustrated and embarrassed that Governor Noem has decided to sign this into law.”

All of which is the reason that I prefer a defensive bullet and charge that will have plenty of penetration to get to the vitals of my attacker regardless of his stance. And, yes, the simple truth is that these loads will often exit the attacker’s body. I consider it my job, not the bullet’s, to see that I don’t endanger non-combatants. It is also the reason that, just because we are being shot at, we may not feel it is a good idea to return fire.

Imagine being attacked on a busy street or in a crowded shopping mall. People are everywhere and they might even run between me and the attacker once the fireworks start. Most assuredly, they will be behind him.

At approximately 12:15 p.m., jurors indicated that they had a question on one of the instructions, one dealing with the legal definition of self-defense in Missouri. The jury was asked to consider whether to find Cespedes guilty of second-degree murder, voluntary manslaughter, first-degree involuntary manslaughter or second-degree manslaughter.

Buchanan County Sheriff’s officials worked later Friday afternoon to complete the processing necessary to allow Cespedes to be released from what amounted to about 1½ years in custody.

During the executive session on February 1st, the Washington state House Committee on Civil Rights & Judiciary voted to pass House Bill 1068 to ban many standard capacity ammunition magazines and House Bill 1225 for firearm seizures without due process. Legislation proposed in the Tennessee General Assembly would provide both civil and criminal immunity for a person who uses or threatens force in self-defense.

Rep. Bruce Griffey, R-Paris, introduced HB409 on Thursday. The bill clarifies a person who uses force in self-defense could not be criminally prosecuted for using force. This includes any detainment, arrest, charging, indicting or any other "adverse" action against the person under local, state or federal law.

It's commonly known as a 'Stand Your Ground' law, but it has some specific criteria.

This Case of the Week focuses on a real-world example of the application of the self-defense law doctrine of “regaining innocence.”

One of the five elements of a claim of self-defense justification for a use-of-force against another person is the element of innocence, which denies the justification of self-defense to a person who was the initial aggressor in a fight. “Initial aggressor” generally means the person who was the first to threaten or use unlawful physical force against another.

Police say the shooting death of a 23-year-old in a Logan home Thursday morning will remain under investigation while they determine whether it is self-defense or homicide.

"There are many aspects of this investigation that will take some time to sort through," Logan police said in a Facebook post.

Senate Bill 17, sponsored by Sen. Trent Garner, will reduce the fee for a license to carry a concealed handgun for self-defense. If enacted, the current fee of $100 would be reduced to $50 for first-time applicants, and $25 for renewals and those over 65 years of age.

In late January, I signed my first bill into law. I’m proud to say that this bill – Senate Bill 47 – further protects the constitutionally given freedoms of law-abiding South Dakotans.

Constitutional carry, also called permitless carry, is a policy change that has been under consideration in Pierre for several years. The policy was debated and vetted. My administration – as well as many legislators – took time to listen to South Dakotans, law enforcement, and industry experts on this issue. That robust and thoughtful process produced the version I signed into law. I’m grateful to the legislative leadership who pulled the bill across the finish line.

During the signing ceremony of Senate Bill 47, she added that citizens still have to fulfill the legal requirements of who can own, carry, and conceal a firearm. Noem said many South Dakotans still will obtain a concealed-carry permit to allow them to carry in other states with reciprocal agreements.

The law making it legal to carry a concealed gun in the state without a permit will go into effect July 1.

A southwest Iowa man — the first person granted immunity from prosecution by the state's new "stand your ground" law after he fatally shot an attacker — has been sentenced to more than six years in federal prison for a firearm violation.

Kevin Staley, 30, of Red Oak was sentenced to six and a half years after he pleaded guilty to possession of a firearm by a prohibited person. A methamphetamine user, he admitted having a .40-caliber pistol, court records show.
