MN: Gun Sanctuary Counties In The Spotlight

For those that are not familiar with the term “Sanctuary Counties”, It means local government, and law enforcement refuse to appropriate resources to enforce unconstitutional restrictions on the right to keep and bears arms, and that they will use all legal means to protect their citizens 2nd Amendment Rights.

Also known as a gun sanctuary, they are counties that have put in place specific legislation stating they will not enforce some or all federal gun safety laws.

The legislation is often called, “Constitutional Sanctuary,” “Bill of Rights Sanctuary”, “Second Amendment Preservation Act,”.

A Williamson County jury has found a Round Rock woman not guilty in the 2019 shooting death of her husband.

Ty'Esha Tanner was found not guilty of murder in the death of her husband, 43-year-old Justin Silas, on Jan. 26, according to court records. One of her attorneys said the jury found she acted in self-defense.

"Ty'Esha has waited for over three long years for the full truth to come to light," said one of her attorneys, Ryan Deck. "She never considered any plea offers whatsoever. We knew that when a jury heard all the facts surrounding this tragedy, she would be acquitted of all charges. And that's exactly what happened."

Wisconsin law forbids individuals from carrying or operating a firearm while they are “under the influence of an intoxicant,” though no numerical definition of intoxication is provided. The law defines “under the influence” as the state in which a person’s alcohol consumption makes it so that their ability to “handle a firearm or airgun is materially impaired.”

State legislators will consider a bill this spring that would tighten who can apply for a concealed carry weapon permit and where a permit holder is allowed to bring a concealed firearm.

State Bill 2, authored by Sen. Anthony Portantino, D-Burbank, would raise the age minimum for a concealed carry gun permit from 18 to 21 and would prohibit permit holders from bringing a gun into “sensitive places,” including polling places, health care facilities, playgrounds and public transit.

The bill also expands the training requirement for a concealed carry permit from a maximum of 16 hours to a minimum of 16 hours.

It would also add subjects to the permit training course like the safe storage and legal transportation of guns.

Lisonbee has also introduced HB107, which would waive the fees for any school employee who seeks a concealed carry permit. According to the Utah Department of Public Safety, Utah's concealed firearm permit allows an individual to carry a firearm fully loaded and concealed. The permit also allows an individual to carry a firearm into public schools.

Guns rights proponents spoke in favor of the bill.

Mitch Vilos, an attorney who specializes in personal injury and weapons law, said his research on a book on self-defense laws revealed that since Utah allowed teachers to carry concealed weapons in classrooms in the late 1990s, he could find no evidence that a co-worker or a student had been injured as a result of that statute.

“It appears that it was in front of the yard of a residence nearby, and it was as a result of a possible domestic dispute ongoing,” Abollo said.

No arrests have been made, he said.

Abollo said the person who fired the weapon was at the scene.

“It appears to be a self-defense claim,” Abollo said. “The person was cooperative with the Sheriff's Office detectives, traveled back to the Sheriff's Office interview rooms and provided a statement on the record and was interviewed by detectives.”

Gov. Kathy Hochul is seeking a number of "technical" revisions to New York's contested concealed carry laws, including allowing armed security guards at places of worship and providing clearer guidelines for retired law enforcement officers in good standing to possess a firearm in a "sensitive location."

The "Concealed Carry Improvement Act" is the target of numerous challenges in federal court by pro-Second Amendment groups. Some judges have already ruled it is an unconstitutional reach on people's right to possess a firearm following the landmark decision in the Supreme Court case — New York State Rifle & Pistol Association v. Kevin Bruen, the then-superintendent of the State Police.

Kyle Rittenhouse was acquitted in November 2021 of all charges in the shootings that led to the deaths of a convicted domestic abuser and a pedophile as well as the maiming of of an armed leftist during the 2020 leftist riots in Kenosha, Wisconsin.

Despite a jury determining that the young man had acted in self-defense, a federal judge ruled this week that the father of one of the deceased can move forward with a wrongful death suit against Rittenhouse.

The Second Amendment protects an individual’s right to possess a gun while under a restraining order for domestic violence, the 5th U.S. Circuit Court of Appeals ruled on Thursday in a decision with alarming implications for gun violence in America. Although mass shootings and intimate partner murders are heavily linked to domestic violence, the 5th Circuit held that the government cannot disarm alleged abusers solely because they are subject to a civil protective order. The court vacated the conviction of a man, Zackey Rahimi, who possessed a gun after allegedly assaulting his girlfriend, and invalidated the federal law that prevents alleged abusers from bearing arms.

Oklahoma state Sen. Nathan Dahm (R-District 33) has introduced Senate Bill 818, which he says aims to protect Second Amendment rights.

Under the "Firearms Freedom Act," any weapon or ammunition manufactured commercially or privately in Oklahoma would be shielded from federal law as long as it remains in the state.

Dahm said he filed the bill to prevent federal overreach and to protect the rights of Oklahomans.

"Nathan Dahm is one of the greatest guys I've seen at protecting the citizen's rights and second amendment," said state Rep. Justin Humphrey (R-District 19). "If we don't have Second Amendment Rights, we can't keep all the rest of them."

Federal Judge Renee Bumb issued a temporary restraining order (TRO) in their case. The TRO expands the number of sections of the new “carry killer” law (Chapter 131 or A4769) that the state temporarily may not enforce until further court order. The TRO also restrains certain pre-existing prohibitions as well. The court also clarified that certain provisions of the law are to be interpreted narrowly, thereby reducing the restrictive scope of the law.

While the State Chamber, Greater Oklahoma City Chamber and Tulsa Regional Chamber are all supportive of the Second Amendment and of gun owner rights, they’re also supportive of businesses in Oklahoma that choose to prohibit guns.

The chambers also support policies adopted by colleges and other academic institutions in Oklahoma that prohibit firearms on campuses.

The organizations, which advocate on behalf of thousands of member businesses across the state, issued a legislative agenda this week in anticipation of next week’s opening of the 2023 session of the Oklahoma Legislature.

About two million guns linked to crimes were recovered by law enforcement officials around the country from 2017 to 2021 — many of them semiautomatic pistols modeled on Glock 9-millimeter handguns, according to the most comprehensive national accounting of crime guns in decades.

The Bureau of Alcohol, Tobacco, Firearms and Explosives analyzed data in a federal gun tracing system to create a statistical portrait that law enforcement agencies can use to address new threats, such as the increased use of untraceable homemade firearms known as “ghost guns.”

A group of U.S. Senate Democrats will introduce legislation on Thursday directing the Federal Trade Commission to create rules banning the marketing of firearms to children, including the JR-15, which has become a target of gun control advocates.

The planned legislation comes roughly a week after Democrats publicly called on the FTC to probe the marketing techniques of gun manufacturer Wee 1 Tactical, maker of the JR-15 .22 Long Rifle. The similarly named AR-15-style rifle has been used in a number of high-profile deadly shootings in the United States in recent years.

When officers arrived, they found a 20-year-old and a 16-year-old with gunshot wounds.

Both were taken to a hospital and the teen was pronounced dead, police said. The man who survived was described as alert.

Homicide commander Lt. Germain Dearlove told Channel 2 Action News that the shooting was the result of an argument that escalated. The two people shot at each other, and investigators are trying to determine if the man will face charges or if he fired in self-defense, Dearlove said.

Pulaski County authorities released more information Thursday about an altercation earlier this week that left one man dead and another injured — saying it occurred as a community services worker conducted a home visit and was attacked by his client, who was in the midst of a mental health crisis.

Both men were stabbed multiple times with knives and the client died, Commonwealth’s Attorney Justin Griffith said.

The prosecutor said that no criminal charges would be placed, calling the client’s death a justifiable homicide that occurred in self-defense.

A man arrested on October 7, 2022, for shooting and killing his father-in-law had all charges against him dropped. An in-depth investigation revealed reasonable defense under numerous statutes, such as stand-your-ground, defense of habitation, and self-defense.

The shooting occurred after a domestic incident where the defender was placing his wife’s belongings outside while she and her father collected them. Words were exchanged between the defender and his father-in-law during this process.

There was video evidence that showed the defender going back into his home to avoid conflict with his more sizable father-in-law. The father-in-law followed the homeowner into the house.

Gov. Ned Lamont on Wednesday rolled out the third phase of an already-ambitious effort to strengthen Connecticut’s gun laws, adding waiting periods, safe storage and improved design safety to the list of initiatives that he wants lawmakers to address this year. 

In a pair of press conferences last week, Lamont pledged to address both community gun violence and the threat of mass shootings by cracking down on open-carry, and ending the proliferation of “ghost” guns and military-style rifles through new registration requirements.

Military doctrine holds sway on comparisons of the AK-47s and AR-15 rifles, with each tactical rifle making a solid push into other shooting disciplines. Riflemen are soldiers trained to use a rifle and find both weapons competent.

Both guns are highly accurate out to about 350 yards; 500 yards if you have good aim. The AK was designed to fire thousands of rounds by an untrained peasant army with questionable marksmanship skills. The poorly aimed firepower was meant to get in close and spray the enemy with bullets.

The AR is an accurate rifle with few moving parts; it is designed to be used by a well-trained accurate ground force.

In Ada, Oklahoma, at about 9 p.m. on December 31, 2022, a few hours before the new year, Jassmone Ashton was minding his own business outside the Sunset Market Valero gas/convenience establishment. Jassmone had filed a protective order against Denavarie Brooks in 2021. Jassmone is 35 years old. Denavarie Brooks was 37 years old. It is not clear what the issues between them were.

According to police, who did a 10-day investigation and intensely examined surveillance video, Jassmone was pumping gas at the Valero store before the shooting. From the prosecutor, District Attorney Erik Johnson:

The graphic shooting of Philando Castile in 2016 shocked many of us and reminded us of the interplay between race, racism, and law. Castile was a Black man in Minnesota who had a permit for his firearm, when he was shot and killed by a police officer during a traffic stop.

“Sir, I have to tell you that I do have a firearm on me,” Castile declared before the officer shot 7 rounds, 5 hitting Castile at point blank range.[1] The following year, that same officer was acquitted on all charges.[2]

The story of Philando Castile is one of the many stories that are all too common among Black Americans, particularly those who have sought a carry permit since the June 2022 decision by the U.S. Supreme Court.

A long list of gun-control groups recently signed a letter telling President Joe Biden (D) that his gun-control actions are not enough. In his upcoming State of the Union Address, they want him to agree to much more.

Titled “#TheTimeIsNow,” the letter begins by applauding Biden’s radical appointment of Steve Dettelbach to head the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), as well as signing into law a gun-control bill and more, but that’s where the pleasantries end.

The letter then pivots to how Biden needs to “act boldly” to restrict our freedom. These gun-control groups want Biden to announce a “comprehensive plan of action to reduce gun deaths” in his coming State of the Union.

The People of Color and Indigenous Caucus issued the following statement on the anniversary of Amir Lock’s death:

“It has been one year since Amir Locke was shot and killed during a no-knock warrant. Amir was wrongfully executed by the Minneapolis Police Department.

Amir Lock was a lawful gun owner, abruptly awoken by an unknown intruder, and was gunned down without regard for who he was or why he was there. Amir Locke was not a resident of Minnesota, but Minnesota took his life and shattered his family. His death is a painful reminder of the hate, politicization, and apathy that persist and harm our community through the continued deaths of Black people and people of color at the hands of police.

The Second Amendment Preservation Act, which would nullify some federal gun laws in Nebraska, got a hearing Thursday before a legislative committee.

If the bill is passed, law enforcement would be prohibited from enforcing federal firearm laws if they conflict with Nebraska law.

Sen. Steve Halloran, who introduced the bill, said that Nebraska’s own constitution guarantees the right to keep and bear arms and that this bill would keep those rights from being infringed upon.

A panel of judges on an exceedingly reactionary federal appeals court ruled on Thursday that the federal law prohibiting individuals from “possessing a firearm while under a domestic violence restraining order” is unconstitutional.

Under Judge Cory Wilson’s opinion in United States v. Rahimi, people with a history of violent abuse of their romantic partners or the partners’ children now have a Second Amendment right to own a gun, even if a court has determined that they are “a credible threat to the physical safety of such intimate partner or child.”
